AMENDING AND SUPPLEMENTING A NUMBER OF PROVISIONS ON ADMINISTRATIVE PROCEDURES IN THE CIRCULAR NO.19/2005/TT-BTM DATED NOVEMBER 08, 2005 GUIDING A NUMBER OF CONTENTS PROVIDED FOR IN THE DECREE NO.110/2005/ND-CP DATED AUGUST 24, 2005 OF THE GOVERNMENT ON THE MANAGEMENT OF MULTI-LEVEL SALE OF GOODS

Pursuant to the Law on Competition dated December 03, 2004;

Pursuant to the Decree No.189/2007/ND-CP dated December 27, 2007 of the Government on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Resolution No.59/NQ-CP dated December 17, 2010 of the Government on simplification of administrative procedures under the scope of management of the Ministry of Industry and Trade;

Pursuant to the Circular No.19/2005/TT-BTM dated November 08, 2005, guiding some contents provided for in the Decree No.110/2005/ND-CP dated August 24, 2005 of the Government on management of multi-level sale of goods;

At the proposal of the Director of Competition Administration, Minister of Industry and Trade amends and supplements a number of provisions on administrative procedures in Circular No.19/2005/TT-BTM dated November 08, 2005 guiding a number of provisions in Decree No.110/2005/ND-CP of August 24, 2005 of the Government on management of multi-level sale of goods as follows:

Article 1. To amend and supplement a number of provisions on administrative procedures in the Circular No.19/2005/TT-BTM dated November 08, 2005 guiding a number of provisions in the Decree No.110/2005/ND-CP dated August 24, 2005 of the Government on management of multi-level sale of goods:

1. To amend point a, clause 4 of Circular No.19/2005/TT-BTM as follows:

"a) The dossier requesting for registration paper of multi-level sale of goods includes papers as specified in Article 15 of Decree No.110/2005/ND-CP dated August 24, 2005 of the Government on the multi-level sale of goods, in which the copy of the certificate of business registration and certificate of sufficient conditions to do business are the certified copies (in the case filed by mail); the copies together with the originals (for cases filed directly); or the scans of the originals (in the case filed by email);

2. To annul the requirement of "Certification of commune-level police office on the declaration of loss of registration paper for multi-level sale of goods" in point a clause 8 of Circular No.19/2005/TT-BTM.

3. To supplement the provision "Number of dossiers required to submit: 01 set" in clauses 4, 7 and 8 of the Circular No.19/2005/TT-BTM.

4. To annul the provision "enclosed to the application" in the Form MD-1, MD-2, MD-3 in Appendix II issued together with Circular No.19/2005/TT-BTM.

Article 2. Effect

1.This Circular takes effect from November 08, 2011.

2. During the implementation of this Circular, if any problems arise, concerned organizations and individuals promptly reflect to the Ministry of Industry and Trade for amending and supplementing accordingly./.
