CIRCULAR
ON AMENDMENT AND SUPPLEMENT OF A NUMBER OF PROVISIONS OF CIRCULAR NO.37/2005/TT-BLDTBXH DATED 29/12/2005 OF THE MINISTER OF LABOR - INVALIDS AND SOCIAL AFFAIRS GUIDING ON OCCUPATIONAL SAFETY AND HEALTH TRAINING
Pursuant to Decree No.06/CP dated 20/01/1995 of the Government detailing some Articles of the Labor Code on occupational safety and health;
Pursuant to Decree No.110/2002/ND-CP dated 27/12/2002 of the Government amending and supplementing some Articles of Decree No.06/CP dated 20/01/1995 of the Government detailing a number of Articles of the Labor Code on occupational safety and health;
Pursuant to Decree No.186/2007/ND-CP dated 25/12/2007 of the Government regulating functions, duties, powers and organizational structure of Ministry of Labor - Invalids and Social Affairs;
Ministry of Labor - Invalids and Social Affairs amends and supplements some provisions of the Circular No.37/2005/TT-BLDTBXH dated 29/12/2005 guiding on occupational safety and health training (hereinafter referred to as Circular No.37/2005/TT-BLDTBXH) as follows:
Article 1. To amend and supplement some provisions of Circular No.37/2005/TT-BLDTBXH as follows:
1. Point a, Clause 2, Section VI
Occupational safety cards shall be printed and administrated by employers (as defined in Article 6 of the Labor Code) as referred to a given form in Annex I of this Circular. Where employers are unable to self-print the occupational safety cards, they shall contact with the Department of Labor - Invalids and Social Affairs to be provided.
2. Point b, clause 2 of Section VI
The employers shall be responsible for issuing occupational safety cards to employees (including self-employed persons) who perform jobs with strict requirements on occupational safety and health after the employees are trained for the first time and meet requirements of the tests
3. Point f, Clause 1 of Section VII
Every year, establishments shall report the list of employees involved in jobs with strict requirements on occupational safety and health to the Department of Labor, Invalids and Social Affairs, and their governing agencies for administration and monitoring; review and periodically report on occupational safety and health training as stipulated in Joint-Circular No.01/2011/TTLT-BLDTBXH-BYT dated 10/01/2011 of the Ministries of Labour, Invalids and Social Affairs, Health guiding the implementation organization on occupational safety and health in the labor establishments.
Article 2. Effect
1. This Circular takes effect from March 01, 2012.
2. Occupational safety cards issued before the effective date of this Circular, shall continue to be valid until expiry as stipulated in Circular No.37/2005/TT-BLDTBXH.
3. During the implementation, if any problems arise, the concerned organizations, individuals promptly reflect to the Ministry of Labor - Invalids and Social Affairs for study and settlement.
