CIRCULAR
PROVISION ON PROVISION OF MEANS OF FIRE PREVENTION AND FIREFIGHTING FOR NIGHT WATCH FORCES , INTRAMURAL FIRE PREVENTION AND FIGHTING FORCES, AND PROFESSIONAL FIRE PREVENTION AND FIGHTING FORCES
Pursuant to the Law on fire prevention and fighting, 2001; Law on amending and supplementing a number of articles of the Law on fire prevention and fighting in 2013;
Pursuant to Decree No. 79/2014 / ND-CP dated July, 2014 detailing the implementation a number of articles of the Law on Fire Prevention and Fire and Law amending and supplementing a number of articles of the Law on Fire Prevention and Fire (hereinafter referred to as Decree No. 79/2014 / ND-CP);
Pursuant to Decree No. 79/2014 / ND-CP dated July, 2014 detailing the implementation a number of articles of the Law on Fire Prevention and Fire and Law amending and supplementing a number of articles of the Law on Fire Prevention and Fire (hereinafter referred to as Decree No. 79/2014 / ND-CP);
At the request of the Director of Central Department of Fire safety, Firefighting, and rescue and salvage;
The minister of public security promulgates this circular, defining provision of means of fire prevention and firefighting for night watch forces, intramural fire prevention and fighting forces, and professional fire prevention and fighting forces
Chapter I
GENERAL PROVISIONS
Article 1: Scope
This Circular shall define fund for and quantity of fire prevention and firefighting means provided for night watch forces, intramural fire prevention and fighting forces, and professional fire prevention and fighting forces
Article 2. Regulated entities
This circular applies to:
1. Night watch forces
2. Intramural fire prevention and fighting forces
3. Professional fire prevention and fighting forces
4. Police units and local police authorities;
5. Agencies, organizations and individuals involved in provision of means of fire prevention and firefighting for night watch forces, intramural fire prevention and fighting forces, and professional fire prevention and fighting forces
Article 3: Provision of means of fire prevention and firefighting for night watch forces, intramural fire prevention and fighting forces, and professional fire prevention and fighting forces:
1. Comply with the provisions of this Circular and other relevant provisions of law.
2. Ensure improvement of the quality, effectiveness of fire prevention and fighting of night watch forces, intramural fire prevention and fighting forces, and professional fire prevention and fighting forces
3. Ensure frugality, rationality, conformity with standards, proper purposes, and proper users.
4. Stick to local budgets in each stage and suit the conditions, the budget of each facility.
Chapter II
PROVISION OF MEANS OF FIRE PREVENTION AND FIREFIGHTING FOR NIGHT WATCH FORCES , INTRAMURAL FIRE PREVENTION AND FIGHTING FORCES, AND PROFESSIONAL FIRE PREVENTION AND FIGHTING FORCES
Article 4: List of fire safety and firefighting means provided for night watch forces
1. List of fire safety and firefighting means provided for night watch forces shall be as follows:

2. Depending on characteristics of each administrative division and the ability of the local budget, night watch forces can be provided with other fire prevention and fire fighting equipment , such as fire pumps, walkie - talkie radios, firefighting respirator gas mask , isolation gas masks and some other necessary means of fire prevention and fire fighting means.
3. Based on the equipping norm for night watch forces specified in paragraphs 1 and 2 of this Article, the Directors of Department of public security of central-affiliated cities and provinces, or the Director of Fire Department of central-affiliated cities and provinces shall report the People’s Committee of the same level to request the People’s Council for decision on provision fire prevention and fighting equipment for night watch forces in accordance with the conditions of local budget.
Article 5: List of means of fire safety and firefighting provided for intramural fire prevention and fighting forces

2. For the facility equipped with motorized fire-fighting vehicles, the quantity of fire prevention and firefighting equipment and motorized fire fighting vehicles shall be under the guidance of the Central Department of Fire safety, Firefighting, and Rescue
3. Based on the nature and seriousness of the risk of fire, explosion and the budget of each facility, the head of the agency or organization directly managing the facility can provide other necessary fire-fighting means for intramural fire prevention and fighting forces, such as fire pump, fire truck, fire boat, portable battery loud-speaker, respirator gas mask , isolation gas mask, and other necessary fire prevention and fire fighting means other necessary and review and decide on specific fire prevention and fighting equipments for the captain, vice-captain and team members of intramural fire prevention and fighting forces when performing duties in fire prevention and fire fighting.
Article 6. List of means of fire prevention and firefighting means provided for professional fire prevention and fighting forces shall be as follows:

2. Based on the nature and seriousness of the risk of fire, explosion of each facility, the head of the agency or organization directly managing the facility can provide other necessary fire-fighting means for professional fire prevention and fighting forces, such as fire pump, fire truck, fire ladder, fire boat, fire plane, demolition tools and other necessary fire prevention and fire fighting means and review, decide on the specific fire prevention and fighting equipment for the captain, vice-captain and team members of professional fire prevention and fighting forces when performing duties in fire prevention and fire fighting.
Article 7. Fund for providing means of fire prevention and firefighting for night watch forces, intramural fire prevention and fighting forces, and professional fire prevention and fighting forces
1. Fund for providing means of fire prevention and firefighting for night watch forces shall be included in annual defense and security budget of People’s Committees at all levels and exercised under the provisions of the State budget Law
2. The head of each agency and organization directly managing the facility shall cover the funding for providing the means of fire prevention and fighting for intramural fire prevention and fighting forces, and professional fire prevention and fighting forces as prescribed in clause 2, article 32 of decree no. 79/2014 / ND-CP.
The funding for providing means of the fire prevention and fighting for intramural fire prevention and fighting forces, and professional fire prevention and fighting forces belonging to state agencies, public service providers, armed forces and other units funded by the state budgets in center and localities shall be provided by the state budget and must comply with the provisions of the Law on state Budget.
Chapter III
ORGANIZATION OF IMPLEMENTATION
Article 8. Effect
1. 1. This Circular takes effect on December 30, 2014
2. 2. night watch forces, intramural fire prevention and fighting forces, and professional fire prevention and fighting forces provided with means of fire safety and firefighting with quantity equal to or higher than those prescribed in this Circular before this Circular takes effect shall continue to use the equipment until the service life expires; this Circular will be implemented if such forces have not been provided or the equipment quantity is lower than those prescribed in this Circular.
Article 9. Implementation responsibilities
1. The Director of Central Department of Fire safety and rescue, salvage shall direct, inspect, expedite the implementation of this Circular.
2. Base on the requirements and the actual situation, Central Department of Fire safety, Firefighting, and Rescue shall take charge and coordinate with the relevant units of amending and supplementing the provisions of providing means of fire prevention and fighting for night watch forces , intramural fire prevention and fighting forces, and professional fire prevention and fighting forces as prescribed in this Circular and request the Minister of Public Security for consideration and decision.
3. The Fire Police of central-affiliated cities and provinces shall:
a) Provide guidelines, inspect and annually report on December to the Ministry of Public Security (through Central Department of Fire safety, Firefighting, and Rescue ) on the implementation of provisions on providing means for fire prevention and fighting for night watch forces , intramural fire prevention and fighting forces, and professional fire prevention and fighting forces
a) Review proposals for amendment or supplement of the quantity of providing means of fire prevention and fighting for night watch forces , intramural fire prevention and fighting forces, and professional fire prevention and fighting forces and report to the Ministry of Public Security (through Central Department of Fire safety, Firefighting, and Rescue).
4. The General Directors, Heads of Units directly under the Ministry of Public Security, the Director of The Fire Police of central-affiliated cities and provinces and organizations and individuals involved shall implement this Circular
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Public Security (through Central Department of Fire safety, Firefighting, and Rescue) for guidelines
