CIRCULAR
GUIDING THE IMPORT OF USED AUTOMOBILE ENGINES
Pursuant to Decision No.11/1998/QD-TTg of
January 23, 1998 of the Prime Minister on the 1998 export and import management
mechanism;
Proceeding from the opinions of the Ministry of Communication and Transport (in
Official Dispatch No.1140/GTVT-PCVT of April 22, 1998), the Ministry of
Science, Technology and Environment (in Official Dispatch No.1010/BKHCNMT-CN of
April 28, 1998), the Ministry of Finance (in Official Dispatch No.1185/TC-TCT
of April 14, 1998) and the General Department of Customs (in Official Dispatch
No.1060/TCHQ-GSQL of April 3, 1998), and after consulting the concerned
ministries and branches;
Following Circular No.01/1998/TM-XNK of February 14, 1998 of the Ministry of
Trade guiding the implementation of Decision No.11/1998/QD-TTg of January 23,
1998 of the Prime Minister;
The Ministry of Trade hereby guides the import of used automobile engines as
follows:
I. PROVISIONS ON THE IMPORT AND USE:
- The enterprises having appropriate export and import business licenses shall be entitled to fill in the procedures at the customs offices for the import of used automobile engines of various kinds (construed as gasoline engines, diesel engines and semi-diesel engines used for automobiles and tractors of headings No.8701, 8702, 8703, 8704 and 8705 of the Import Tariff).
- The import of used automobile engines shall comply with Decision No.2019/1997/QD-BKHCNMT of December 1st, 1997 of the Ministry of Science, Technology and Environment.
- The imported automobile engines shall only be used to replace those of assorted automobiles and tractors which are lawfully circulated or used as agricultural and fishery mechanical machines in service of agricultural and fishery production according to the relevant regulations of the concerned ministries and branches. The concerned enterprises and agencies shall have to pay special attention to the use of imported goods for the above-said purposes, not for other purposes.
- The import tax on used automobile engines shall be imposed according to the current regulations of the State on the basis of reasonable protection of domestic production.
II. IMPLEMENTATION PROVISIONS:
The Ministry of Trade requests the ministries, the ministerial-level agencies, the agencies attached to the Government, the central bodies of the mass organizations, the People's Committees of the provinces and cities directly under the Central Government to inform the content of this Circular to the enterprises under their respective management and coordinate with the Ministry of Trade and the concerned ministries and branches in directing the enterprises to make efficient import and use, thus avoiding negative phenomena and trade frauds. Any problems arising in the course of implementation must be promptly reported to the Ministry of Trade for sum-up review and appropriate readjustments.
This Circular takes effect from the date of its signing to March 31, 1999.
