CIRCULAR

PROMULGATION OF NATIONAL TECHNICAL REGULATIONS ON FOOD HYGIENE AND SAFETY CONDITIONS IN FISHERIES PRODUCTION

Pursuant to the Law on Standard and Technical Regulation dated June 29, 2006;

Pursuant to the Fisheries Law dated November 26, 2003;

Pursuant to Decree No. 01/2008/CP dated January 3, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development; Decree No.75/2009/ND-CP dated September 10, 2009 of the Government amending Article 3 of Decree No.01/2008/ND-CP of January 3, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Article 1. Issuing together with this Circular 02 National Technical Regulatiosn on food safety and hygiene conditions in the fisheries production:

National technical regulations: food production facilities for aquaculture industry - conditions to ensure food safety, veterinary hygiene and environmental protection

Article 2.This Circular takes effect after six months from its signing date.

Article 3. Director of the National Agro-Forestry-Fisheries Quality Assurance Department, heads of agencies, organizations and individuals concerned are liable to execute this Circular.

Any problem arising in the course of implementation should be promptly reported to the Ministry of Agriculture and Rural Development for consideration, amendment or supplementation.

FISHERY FEED MILL – CONDITIONS FOR FOOD SAFETY, VETERINARY HYGIENE AND ENVIRONMENTAL PROTECTION

Introduction:

QCVN 02-14:2009 / MARD was written by the South Research Sub-Institute for Marine Fisheries (SORESIMF), submitted for approval by Department of Science, Technology and issued under Circular No: 82/2009 /TT- BNNPTNT dated December 25, 2009 by the Minister of Agriculture and Rural Development.

 

NATIONAL TECHNICAL REGULATION

FISHERY FEED MILL – CONDITIONS FOR FOOD SAFETY, VETERINARY HYGIENE AND ENVIRONMENTAL PROTECTION

1. GENERAL REGULATION

1.1. Scope of adjustment

This regulation prescribes the conditions to ensure veterinary hygiene safety for fishery feed mill.

1.2. Subject of application

1.2.1. This regulation applies to the fishery feed mill with industrial scale nation-wide.

1.2.2. This regulation does not apply to the fishery feed mill with self-service farming household scale without non-commercial nature.

1.3. Explanation of term

In this regulation, fishery feed is understood as feed processed in the form of dry balls with long-term storage and convenient for use; produced in the mills with industrial scale.

2. TECHNICAL REGULATION

2.1. Requirement on infrastructure

2.1.1. Location:

2.1.1.1. The mill to be built is located in the planning of the State and shall not be flooded and stagnant with convenient for travel and transport.

2.1.1.2. There must be clean water and power supply source to meet the requirements on production and operation.

2.1.1.3. It must be isolated from residential areas and the source of infection.

2.1.2. Layout of workshop ground

2.1.2.1. The layout of workshop ground must ensure the production chains (from input raw materials to finished products) shall be linked, one-directional and avoid infecting products.

2.1.2.2. The workshop must be of sufficient size for the layout of equipment and have access to clean both inside and outside of machine; the minimum distance between the device and the wall or partition is 45 cm and 15cm from the floor.

2.1.2.3. Production lines must be arranged so minimize the possibility of cross-contamination between production stages.

2.1.2.4. The wet areas (if any), heat treatment area (boilers, hydrolysis, steaming, crushing or grinding) must be designed to ensure ventilation, quick heat, humidity and smell removal, easy to clean and disinfect.

2.1.2.5. The yard and internal paths must be concretized and tiled or with slope to ensure water drainage, cleaning and disinfection.

2.1.2.6. There is enclosing wall separating the mill from outside

2.1.3. Structure of production workshop

2.1.3.1. Workshop must have solid structure, consistent with the nature and scale of the mill to ensure safety and fire prevention;

2.1.3.2. Workshop must be designed to minimize dust and have ventilation system to get rid of heat, water vapor, dust and waste gas;

2.1.3.3. Walls, ceilings, partition and roof of workshop and warehouse must be made of durable material which is impermeable and without cracks; the floor of workshop must be hard, flat, load bearing, non-slip, easy cleaning and well drain off.

2.1.3.4. Doors and windows must be made of durable material to prevent insects and pests, easy to clean and disinfect.

2.1.4. Equipment and instruments

2.1.4.1. Machinery, equipment and instruments must be installed by a designed sanitary requirement.

2.1.4.2. Equipment in direct contact with raw materials and products must be made of durable materials, non-toxic, stainless with structure easy to operate, use and clean.

2.1.4.3. Instruments and equipment used for steaming, fermentation, wet grinding and containers must be made of material which is stainless, non-corrosive and easy to clean and disinfect.

2.1.4.4. Equipment and instruments must have regular maintenance and sanitation schedules

2.1.4.5. Production equipment shall be arranged in oder to check the technical parameters and have safety protection system for the users.

2.1.5. Storage system

2.1.5.1. The mill must have own warehouse to store raw materials; products; equipment; instruments; petroleum and chemicals.

2.1.5.2. The storage of finished products must ensure coolness and dryness and be designed to be convenient for input and output of products. The storage does not create a place for insects and pests. It must have shelves and racks to place products at least 20 cm high and periodic anti-termite measures and is easy to clean and disinfect.

2.1.5.3. In case the mill uses both dry and wet materials, there must be separate storage of raw materials or area for two types. The arrangement in the storage must ensure that raw materials first stored shall be put into production first. The daily hygiene must be maintained daily.

2.1.5.4. Storage of equipment and instruments must be placed conveniently for use. The instruments must be placed on racks at least 30 cm high.

2.1.5.5. The petroleum and chemical storage must be located separately from the production area.

2.2. Requirements in production

2.2.1. Material

2.2.1.1. The mill must have mandatory standards applied for each type of input material.

2.2.1.2. The material standards must meet the requirements by the following contents

- The raw material for fishery feed production must ensure good quality, not being adulterated and contaminated. Do not use materials that contain substances banned from use;

- The raw material must be of clear origin without termites and insects; do not use material from dead animals from sickness or diseases;

- Materials must achieve the targeted nutrition, micro-organisms and toxins

2.2.1.3. For imported material, there must be certificate of import quality standards issued by the competent authority.

2.2.1.4. The use of raw material on the principle: raw material first stored shall be first produced and vice versa. The material of each batch of the product must be taken sample and stored until all products are sold out.

2.2.2 Process of production

2.2.2.1. The production lines must comply with the principle of going in one direction and having continuity. Where the production line is open, the path of the line shall not be interrupted by other activities or passage way causing cross contamination to the products.

2.2.2.2. Developing blending formula for each type of food products; checking and controlling load balancing system regularly to ensure the correct amount of raw materials prior to mixing.

2.2.2.3. Machinery, equipment and workshop in direct contact with raw materials and products must be maintained and ensure good operation without damage and interruption, stagnating production affecting product quality.

2.2.3. Management of finished products

2.2.3.1. The fishery feed must be published in accordance with the quality standards of products registered under the Law on the quality of products and goods No. 05/2007/QH12 dated November 21, 2007.

2.2.3.2. The quality of feed produced must be consistent with the published quality and the components must not contain any substances harmful to human health and aquatic animals.

2.2.3.3. The product packaging must maintain product quality and suitable for intended us, the labeling must be in accordance with the provisions of Government’s Decree No. 89/2006/ND-CP of August 30, 2006.

2.2.4. Additive

2.2.4.1. Additives must be included in the list of permitted uses for fishery feed in accordance with current regulations of the State.

2.2.4.2. Absolutely no use of toxic substances and the ones which are not permitted for use or permitted for use but beyond the permitted limit in the production of fishery feed.

2.2.5 Detergent and disinfectant

2.2.5.1. Detergent and disinfectant must be consistent with the purpose of use. Use only detergent and disinfectant in accordance with the Ministry of Health;

2.2.5.2. Do not use chemicals to kill the animals and insects in the production areas, storage areas and packaging products.

2.3. Waste treatment system requirements

2.3.1. Mill must have a wastewater treatment system. The wastewater after treatment must meet the standard TCVN 5945-2005 on industrial wastewater or TCVN separately applied for the mill of feed production.

2.3.2. The mill must have tools for collection and transportation of solid waste out of the production area after each production shift. The waste container must be closed and isolated from production areas. The instruments for collection and containing and transportation must be easy to clean and disinfect.

2.4. Requirements on quality control system

2.4.1. The mill must apply GMP quality control system in production.

2.4.2. The mill must have quality control room equipped with all the tools and specialized use chemicals or lease contract of accredited laboratory for analysis and control of product quality criteria.

2.5. Regulation on hygiene

2.5.1. Personal hygiene

a. People who work at the production mill must comply with regulations on personal hygiene,

b. And must be in good health upon recruitment and checked health annually.

2.5.2. Hygiene of production mill

a. The production mill must be periodically cleaned, tidied up clean and orderly arranged.

b. The mill must develop program and plan to clean and disinfect the production area and equipment and instruments. There must be equipment to control insects and pests.

c. The mill must be equipped with adequate septic toilet system with enough water and hand soap and bathroom for workers.

d. There must be a person who is mainly responsible for the labor safety and hygiene.

3. REGULATION ON MANAGEMENT

3.1. Certification and announcement of conformity

3.1.1. The fishery feed mill must perform the conformity certification to standards of conditions to ensure food hygiene and safety under Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 "Regulation on activity of conformity certification to standards to standards, certification and announcement of standard conformity".

3.1.2. The National Agro-Forestry-Fisheries Quality Assurance Department and the Service of Agriculture and Rural Development of provinces are responsible for conducting conformity certification to standards of food safety conditions of the fishery feed mill as assigned by Decision No.117/2008/QD-BNN dated December 11, 2008 of the Minister of Agriculture and Rural Development concerning Regulation on inspection and recognition of fishery feed mill eligible for food safety assurance.

3.1.3. Method of assessment and certification of fishery feed mill shall comply with Decision No. 117/2008/QD-BNN dated December 11, 2008 of the Minister of Agriculture and Rural Development concerning Regulation on inspection and recognition of aquatic product business and production mill eligible for food safety assurance.

3.1.4. The fishery feed mill shall announce conformity and comply with the provisions of Article 14 of Decree No. 127/2007/ND-CP dated August 01, 2007 on "Detailing the implementation of a number of articles of the Law on standards and technical Regulations ".

3.2. Implementation organization

3.2.1. The fishery feed mill specified in 1.2. shall comply with the provisions of the technical Regulation to ensure food safety and subject to inspection and examination by the competent authorities of the Ministry of Agriculture and Rural Development or the local competent state authorities.

3.2.2. The Ministry of Agriculture and Rural Development shall assign The National Agro-Forestry-Fisheries Quality Assurance Department to assume the prime responsibility and coordinate with the Department of agroforestry products processing and salt production and agencies concerned to dissemininate and guide the implementation of this technical Regulation.

3.2.3. In cases the provisions of this Regulation are changes, supplemented or superseded, the provisions of the new text signed and issued by the Minister of Agriculture and Rural Development shall apply.

AQUATIC BREEDING PRODUCTION FACILITY- CONDITION FOR FOOD SAFETY, BIOSECURITY AND ENVIRONMENT

Introduction:

QCVN 02-14:2009 / MARD was written by the Research Institute for Aquaculture, submitted for approval by Department of Science, Technology – Ministry of Agriculture and Rural Development and issued under Circular No: 82/2009 / TT- BNNPTNT dated December 25, 2009 by the Minister of Agriculture and Rural Development.

 

NATIONAL TECHNICAL REGULATION

AQUATIC BREEDING PRODUCTION FACILITY- CONDITION FOR FOOD SAFETY, BIOSECURITY AND ENVIRONMENT

1. GENERAL PROVISION

1.1. Scope of adjustment: This Regulation specifies the conditions and food safety, biosecurity and the environment of the aquatic breed production facility

1.2. Subject of application: This Regulation applies to the aquatic breed production facilities, the agencies managing activities related to the production of aquatic breed in the country.

1.3. Explanation of terms: In this Regulation, the terms below are construed as follows:

1.3.1. Clean water source: The water source is not contaminated with organic, inorganic toxic substances, microorganisms or other hazardous substances beyond the limits prescribed for aquatic species.

1.3.2. Aquatic breed: The populations of plants and animals living in water of the same species and origin, appearance and genetic structure formed, strengthened and developed due to the impact of human being through selection, domestication or breeding.

1.3.3. Original aquatic breed: The genuin breed selected and raised for productive breeding and stable quality.

1.3.4. Parental aquatic breed: The original aquatic breeding herd used to produce commercial breeds.

1.3.5. Transgenic aquatic breed: Is the aquatic breeds with genetic structure changed by transgenic technology.

2. TECHNICAL REGULATION

2.1. Construction location

2.1.1. Construction place and ground

Construction place: Having clean water source to meet the requirements of the breed production facility, with stable power, convenient transportation and separated from residential area and away from industrial, chemical and food processing plants,.

2.1.1.1. Solid ground, stable strata, outside the eroded areas and in the planning of locality or the written consent of the competent authority.

2.1.2. Water source and quality

2.1.2.1. Water source:

2.1.2.1a. Fresh water includes water, ground water, well water, river and stream water or water from natural irrigation system with salinity <5 ‰.

2.1.2.1b. Coastal water includes seawater, ground water and bittern of salt field with salinity ≥ 5 ‰ salinity.

Water quality to produce breeds: Being clean and ensuring physical water, chemical and biological factors in accordance with the process of breed production of each object.

2.1.2.2a. Freshwater quality must satisfy the requirements specified in Table 1.

2.1.2.2b. Salty water quality must be stable and ensure the requirements specified in Table 2.

The value of the parameters and the concentration of pollutants in coastal water should be in limits specified in TCVN 5943-1995 (water quality - coastal water quality standard).

 

 

2.2. Infrastructure and works items

2.2.1. Works systems, equipment for reproduction service

2.2.1.1. System of feed-water treatment such as reservoir, settling ponds, water purification system and reproduction tank system, larva and feed rearing tank must ensure the appropriate area, consistent with the breed production process of each object.

2.2.1.2. Equipment and instruments used for production facility must be made ​​of material which is stainless, non-toxic, convenient, hygienic and specialized.

2.2.1.3. Factory system, tanks, equipment and production instruments must be cleaned and disinfected periodically or after use to ensure aquatic veterinary hygiene. The production instruments after cleaning and disinfection must be dried and put in a dry place.

2.1.3. Wastewater, waste material and wastewater treatment system

2.1.3.1. Wastewater of aquatic breed production facilities before being discharged into the external environment must be treated to meet TCVN 6986:2001 and the current regulations.

2.1.3.2. Domestic wastewater must be treated to satisfy TCVN 6772:2000

2.1.3.3. The solid waste and organic waste in production and daily life must be collected, classified in safety containers and placed in the specified location, convenient for activities not causing environmental pollution and adversely affecting water source.

2.1.3.4. Wastewater treatment tank must be covered and located away from production areas or ground water to avoid cross-contamination.

2.1.3.5. Wastewater pipeline system to the treatment place must be closed with certain slope, good drainage, easy to clean and not cause unpleasant odors and pollution.

2.1.3.6. Treatment tank and wastewater sewage system is designed in accordance with the operating capacity of the production facilities.

2.1.4. Raw material storage

2.1.4.1. Storage of raw material in the production facility must be designed in the appropriate location with separate areas. The area contains chemicals, preventing and treating medicine must be tight closing, the food and fertilizer area must be ventilated to prevent insect and pest intrusion and avoid infection.

2.1.4.2. Shelves for raw materials in storage must be at least 0.3 m above the ground.

2.2.3.4. Storage of gasoline and oil must be placed in the appropriate location, away from water source supplied to rearing ponds to prevent contamination and fully equipped with fire-fighting equipment in accordance with regulations.

2.3. Technical labor force

2.3.1. The level of technical officer: Being trained and having certificate in accordance with profession and meeting requirements and assigned tasks.

2.3.2. Workers and other professional and technical requirements: People who work in production facility must be equipped with adequate labor protection as prescribed with certain professional and technical understanding of operation area and well implement the rules of the aquatic breed production facility.

2.4. Requirements on preventing and treating medicine, biological products, chemical and feed

2.4.1. The preventing and treating medicine, biological preparation, microorganisms, chemicals used in the production of seeds must be in the list permitted for circulation in Vietnam.

2.4.2. Feed used must ensure quality and meet the aquatic veterinarian hygiene standard.

2.5. Requirements on aquatic parents and breeds

2.5.1. The aquatic parental breeds for breeding must have a clear origin and ensure quality under Regulation on management of aquatic breed production and business.

2.5.2. The breeds of aquatic breeding production facility before circulation must be quarantined and labeled under Regulation on management of aquatic breed production and business.

3. SPECIFIC REGULATION FOR EACH SUBJECT OF AQUATIC BREEDING PRODUCTION

3.1. In addition to the general conditions requiring all aquatic breeding production facility must comply with the provisions of this Regulation, the breeding production facilities depending on specific subject shall apply specific conditions in accordance with the breeding production in accordance with current regulations of the State.

4. REGULATION ON MANAGEMENT

4.1. Conformity certification to standards

4.1.1. The aquatic breeding production facilities must implement conformity certification to standards of the general conditions to ensure food safety, biosecurity and environment under Regulation on conformity certification to standards and conformity announcement to standards issued together with the Decision No. 24/2007/QD-BKHCN dated September 28, 2007 of the Minister of Science and Technology

4.1.2. The conformity certification to standards organizations are organizations specified by the competent state agencies at points a and b, Clause 1, Article 13 of the Regulation on conformity certification to standards and conformity announcement to standards issued together with decision No. 24/2007/QD-BKHCN to make decision on appointing the conformity certification to standards organization.

4.1.3. The conformity assessment method: The conformity assessment is done by the method of system assessment and monitoring

4.1.4. The order and procedures for conformity certification to standards of food safety conditions, biosafety and the environment shall be developed by the conformity certification to standards organization..

4.1.5. The conformity certification to standards costs: Under the current regulations on the collection of fees and charges.

4.2. Conformity announcement:

4.2.1. The aquatic breeding production facilities shall carry out the conformity announcement to standards on the conditions for food safety, biosecurity and environment under regulation on conformity certification to standards , and conformity announcement to standards issued together with Decision No. 24/2007/QD-BKHCN dated September 28, 2007 of the Minister of Science and Technology.

4.2.2. The orders and procedures for conformity announcement to standards are under Article 18 of the Regulation on conformity certification to standards , conformity announcement to standards issued together with Decision No. 24/2007/QD-BKHCN.

4.2.3. The Record to announce conformity specified in Clause 1, Article 19 of the Regulation on conformity certification to standards and conformity announcement to standards issued together with Decision No. 24/2007/QD-BKHCN.

4.3. Method of inspection:

Application of methods of inspection prescribed for the specialized and interdisciplinary management agencies, appropriate for each subject of aquatic breeding production.

4.4. Testing and sampling methods:

Under current regulation corresponding to each target of inspection

4.5. Management record

4.5.1. In the process of breed production, the facility must monitor and record information relating to production, prepare and keep record on the breed quality include the following contents: Origin, quantity and quality of parental breed, production breed; production time; quantity and type of food, drugs, biological preparation, microorganisms and chemicals used; quality of water of rearing tanks and ponds; health status and disease control measures.

4.5.2. The documentation must be kept on file. The time to keep records must be longer than a production cycle depending on the aquatic subject.

4.6. Other regulations

4.6.1. The aquatic breeding production facility must take preventing and curing measures and disease prevention as prescribed by the current regulations.

4.6.2. The aquatic breeding production facility must immediately notify the diseases occurring at its facility to the authorities to take timely appropriate treatment measures.

4.6.3. The aquatic breeding production facility must develop rules and measures to ensure aquatic veterinary hygienic conditions for the facility.

4.6.4. Transgenic aquatic breeding production facility GMO must be issued the certificate of biosafety. On the packaging of the product s which are transgenic organisms, it must be added the words: "Products using GM technology." In the production process, regularly monitor and supervise their safety level for human health, environment and biodiversity.

4.6.5. The aquatic breeding production facilities must have strict management measures, not allow the transgenic aquatic anh introduced varieties which are produced on trial escape into the external environment.

5. MONITORING HANDLING IMPLEMENTATION OF REGULATION

5.1. The competent State management agencies shall carry out the examination and inspection of the aquatic breeding production facilities

5.1. The organizations and individuals violating the provisions of this Technical Regulation, depending on the nature and seriousness of the violation will be handled in accordance with current laws.

6. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

The aquatic breeding production facilities shall comply with regulations of this technical Regulation to ensure food safety conditions, biosafety and the environment.

7. IMPLEMENTATION ORGANIZATION

7.1. The Ministry of Agriculture and Rural Development shall organize and direct the functional units to disseminate and guide the implementation of this Technical Regulation.

7.2. Any problem arising in the course of implementation should be promptly reported to the Ministry of Agriculture and Rural Development for consideration, amendment or supplementation.
