CIRCULAR

AMENDING AND SUPPLEMENTING REGULATION ON ORGANIZATION AND MANAGEMENT OF SECURITIES TRADING OF UNLISTED COMPANIES AT HANOI SECURITIES TRADING CENTER ISSUED WITH DECISION No. 108/2008/QD-BTC DATED NOVEMBER 20, 2008 OF THE MINISTER OF FINANCE

Pursuant to the Law on Securities No. 70/2006/QH11 dated June 29, 2006;

Pursuant to Decree No. 14/2007/ND-CP dated January 19, 2007 of the Government detailing the implementation of a number of articles of the Law on Securities;

Pursuant to the Decree No. 118/2008/ND-CP dated November 27, 2008 of the Government stipulating functions, tasks, powers and organizational structure of the Ministry of Finance;

The Ministry of Finance makes guidance on amending and supplementing a number of provisions in the Regulation of Organization and Management of securities trading of unlisted public companies at Hanoi Securities Trading Center issued together with Decision No. 108/ 2008/QD-BTC dated November 20, 2008 of the Minister of Finance as follows:

Article 1. Superseding the phrase " Hanoi Securities Trading Center" and "Hanoi ASTC" in Decision No.108/2008/QD-BTC dated November 20, 2008 by the corresponding phrase "Hanoi Stock Exchange" and " Hanoi SE ".

Article 2. Article 7 is amended as follows:

 “Article 7: Trading registration condition

Securities shall be registered for trading at Hanoi Stock Exchange (SE) ​​ upon meeting the following conditions:

1. Being the unlisted securities of a public company under the provisions of Article 25 of the Law on Securities at the Stock Exchange.

2. Being the securities registered at Vietnam securities depository center (hereafter referred to as SDC)

Article 3. Annulling clause 2 of Article 8 concerning trading registration dossier

Article 4. Annulling point d, clause 1 of Article 13 concerning temporary suspension of trading of securities registered for trading.

Article 5. Amending Article 14 concerning the trading methods as follows:

 “Article 14: Trading methods

1. Hanoi SE shall organize trading for the securities registered for trading through the trading registration system by two methods which are continuous order matching method and mode of agreement trading.

2. Hanoi SE and Vietnam SDC shall specify the details of trading methods and the way to fix the transaction error in the form of continuous order matching after having approval from the SSC. "

Article 6. This Circular takes effect from the date of signing.

Article 7. The amendment and supplementation of this Circular shall be decided by the Minister of Finance. /.
