Bộ Công nghiệp nhận được văn bản số YPM-MECO-0821-MOI ngày 03/10/2003 của Bộ trưởng đề nghị hỗ trợ xin giấy phép nhập khẩu dầu DO và hỗ trợ xin miễn nộp phí xăng dầu khi nhập khẩu dầu (số lượng, chủng loại và thời gian nhập khẩu được MECO thông báo bổ sung tại văn bản số YPM-MECO-0826-MOI ngày 08/10/2003). Về việc này, Bộ Công nghiệp có ý kiến như sau:

1. Số lượng, chủng loại và thời gian nhập khẩu dầu DO của Công ty được nêu trong văn bản số YPM-MECO-0826-MOI ngày 08/10/2003 phù hợp với Hợp đồng BOT ngày 18/9/2001 (đã được Thủ tướng phê duyệt tại văn bản số 747/CP-CN ngày 16/8/2001), Hợp đồng BOT sửa đổi ngày 31/10/2002 (đã được Thủ tướng phê duyệt tại văn bản số 1367 CP-CN ngày 30/10/2002) và Báo cáo NCKT (quyết định phê duyệt số 1174/QĐ-KHĐT ngày 04/6/2001 của Bộ Công nghiệp).

2. Công ty Năng lượng MêKông (MECO) thực hiện các thủ tục theo quy định về xin giấy phép nhập khẩu dầu DO cho các năm 2003 và 2004 tại Ban quản lý các khu công nghiệp Bà Rịa - Vũng Tàu (bao gồm cả việc kê khai giá và xuất xứ nguồn dầu nhập khẩu).

- Các năm vận hành còn lại (kể từ năm 2005 trở đi) sẽ được Bộ Công nghiệp xem xét xác nhận sau.

3. Dầu nhập khẩu chỉ được phép dùng để vận hành nhà máy, không được nhượng bán tại Việt Nam trừ khi có ý kiến thoả thuận của Cơ quan quản lý Nhà nước có thẩm quyền.

4. Căn cứ Nghị định số 62/1998/NĐ-CP ngày 15/8/1998 của Chính phủ về Quy chế BOT, Căn cứ Hợp đồng BOT ngày 18/9/2001 (đã được Thủ tướng phê duyệt tại văn bản số 747/CP-CN ngày 16/8/2001), Hợp đồng BOT sửa đổi ngày 31/10/2002 (đã được Thủ tướng phê duyệt tại văn bản số 1367 CP-CN ngày 30/10/2002) và văn bản số 441/CP-KTTH ngày 28/4/1999 của Văn Phòng Chính Phủ, Công ty Năng lượng MêKông được miễn thuế nhập khẩu và được miễn phụ thu đối với nhiên liệu nhập khẩu (dầu DO)

5. Trường hợp gặp vướng mắc trong quá trình thực hiện, Công ty báo cáo Bộ Công nghiệp để giải quyết.

Re: Phu My 2.2 BOT Power Plant Project - Authorization in order to import Distillate Oil as Secondary Fuel

Dear Mr. Hung,

We are getting back to you with relation to the distillate oil to be imported by Mekong Energy Company Ltd., (“MECO”).

As you know, the distillate oil will be used by MECO during the testing period of the Phu My 2.2 BOT Power Plant, and during MECO’s commercial operation as Secondary Fuel backup.

Therefore, and pursuant to Article 12.1-(i) of the BOT Contract executed on September 18, 2001 (the “BOT Contract”), we would like to request your support to obtain the Government’s Authorization for the direct import of distillate oil.

For your reference, our forecasts as regards distillate oil imports are the Following:

- For the testing period as from January 2004: 46,200 tones;

- For the commercial operation: 42,000 tones per year, according to the BOT Contract and Power Purchase Agreement between Electricity of Vietnam and MECO dated September 18, 2001.

Regarding these distillate oil imports, MECO will be exempt from import duties, as provided for by Article 5 of Decree No. 62/1998/ND-CP of the Government dated August 15, 1998 (as modified on January 27, 1999, by Decree No. 02/1999/ND-CP of Government), and by Article 17.2-(vii) of the BOT Contract, and from theo surcharge as stipulated by Official Letter No. 441/CP-KTTH of the Government dated April 28,1999.

Nevertheless, the distillate oil imports will be, pursuant to Decree No. 78/2000/ND-CP of the Government dated December 26 , 2000, Subject to a Petrol fee.

Hence, we also request your support for exemption of the said petrol fee in order to avoid any impact on the tariff calculation.

DISTILLATE OIL FOR PM 2.2 POWER PLANT

1. Quantities

Based on the Feasibility study (F/S), BOT and PPA

In normal operation Secondary Fuel shall be used as back up but not exceed 5 days per year (PPA and F/S). The tanks shall be sized for seven days (F/S). The tanks are of 26000 M3 or 21000 tones.

Commercial operation date (COD) of the plant: September 2004.

1.1. For Commissioning for Pre-testing of component and testing in both Single Cycle and Combine Cycle:

Pre-testing components: 4200 tones

Single/ Combined Cycle testing and commissioning: 2 x 7 days = 14 days.

Total: 46200 tones

1.2. For Operation after COD quantity per year.

Calculations are based on the maximum of the capacity of the tanks and on the worst timing for the use of oil.

PM 2.2 uses oil at the end of the year and shall refill the tanks at the beginning of the following year. Then after running again oil, refilling the tanks in the same year to be ready for the next year.

Quantity: 2 time the capacity of the tanks: 42000 tones.

2. Time Schedule

2003- First filling of the Tanks: 21000 tones

2004- For Commissioning and Operation: 67200 tones

2005 and following years- Operation: 42000 tones

3. Distillate Oil Specification

The distillate shall be consistent with:

- Fuel: No 2-GT according to ASTM D 2880

- gas turbine manufacture liquid fuel specifications GE 141407K GE POWER SYSTEMS.

- particular specification on fuel composition stated in here below table

In addition this fuel must belong to kind II fuels according to TCVN 5307.
