DECISION
ON REQUIRED APPLICATION OF VIETNAME STANDARD TCVN7440:2005&area=2&type=39&match=False&vc=True&lan=1" target="_blank">TCVN 7440:2005 – EMISSION STANDARDS FOR THERMAL POWER INDUSTRY
MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
Pursuant to the Law on Environmental Protection dated 27/12/1993;
Pursuant to the Decree No. 175/CP dated 18/10/1994 of the Government guiding the implementation of the Law on Environmental Protection and the Decree No. 143/2004/ND-CP dated 12/7/2004 of the Government on the amendment, addition of Article 14 of the Decree No. 175/CP dated 18/10/1994 of the Government guiding the implementation of the Law on environmental Protection;
Pursuant to the Decree No. 91/2002/ND-CP dated 11/11/2002 of the Government regulating the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to the Decision No. 1793/QD-BKHCN dated 20/7/2005 of the Minister of Science and Technology on issuing the Vietnam Standard TCVN7440:2005&area=2&type=39&match=False&vc=True&lan=1" target="_blank">TCVN 7440 : 2005 - Emission standards for thermal power industry;
Considering the recommendations of the Director General of Department of Environment and the Director General of Department of Legal Affairs,
DECIDES:
Article 1. To require the application of the Vietnam Standard TCVN7440:2005&area=2&type=39&match=False&vc=True&lan=1" target="_blank">TCVN 7440:2005 - Emission standards for thermal power industry which has been issued by the Minister of Science and Technology in the Decision No. 1793/QD-BKHCN dated 20/7/2005 under the following provisions:
- The thermal power plant projects which are newly built, the expansion projects to raise the capacity of active thermal power plants must apply the Vietnam Standard TCVN7440:2005&area=2&type=39&match=False&vc=True&lan=1" target="_blank">TCVN 7440:2005 from the effect of this Decision on required application.
- The active thermal power plants and the thermal power plants whose reports on environmental impact assessment have been approved before the effective date of this Decision on required application must apply the Vietnam Standard TCVN7440:2005&area=2&type=39&match=False&vc=True&lan=1" target="_blank">TCVN 7440 : 2005 from 01/012015, except the plants named in the list of facilities which cause serious environmental pollution and must be thoroughly treated under the provisions of the Decision No. 64/2003/QD-TTg dated 22/4/2003 of the Prime Minister.
Article 2. The regional and area coefficient (Kv), power coefficient (Kp) and the method for calculation of permissible maximum concentration of SO2, NOX and dust in the emission of the thermal power plants using coal or oil fuel specified in the Appendix 1 attached to this Decision.
Article 3. This Decision takes effect 15 days after its publication in the Official Gazette.
The Ministers and Heads of ministerial bodies, Heads of governmental bodies, Chairman of People’s Committee of provinces and centrally-run cities, organizations and individuals are liable to execute this Decision./.

APPENDIX 1
DETERMINING THE POWER COEFFICIENT (Kp), REGIONAL AND AREA COEFFICIENT (Kv), AND THE METHOD FOR CALCULATION OF PERMISSIBLE MAXIMUM CONCENTRATION OF SO2, NOX AND DUST IN THE EMISSION OF THE THERMAL POWER PLANTS USING COAL OR OIL FUEL TO APPLY THE VIETNAM STANDARD TCVN7440:2005&area=2&type=39&match=False&vc=True&lan=1" target="_blank">TCVN 7440 : 2005

1. Formula to calculate the maximum permissible concentration
The maximum permissible concentration of pollutants (SO2, NOX and dust) of the emission in thermal power plants using coal or oil fuel discharged into the air is calculated as follows:
Cmax = Ctc x Kp x Kv
In which:
Cmax is the maximum permissible concentration of pollutants of the emission in thermal power plants using coal or oil fuel discharged into the air and is measured in milligram per cubic meter of emission at standard conditions (mg / Nm3);
Ctc is the maximum permissible concentration of pollutants specified in the Vietnam Standard TCVN7440:2005&area=2&type=39&match=False&vc=True&lan=1" target="_blank">TCVN 7440:2005;
Kp is the power coefficient of thermal power plants (the coefficient depends on the scale of waste source).
Kv is the coefficient of building regions and areas of power thermal plants
2. Value of Kp coefficient
The value of Kp coefficient is specified in Table 1 below.

P is the total capacity of the thermal power plants which are newly built, including one generating unit or a lot of generating units. For the expansion projects to raise the raise the capacity of active thermal power plants, P is the total capacity of new generating units (total expansion capacity of plants).
3. Value of Kv coefficient
The value of Kv coefficient is specified in Table 2 below.

Note:
(1) The urban areas determined under the provisions in the Decree No. 72/2001/ND-CP dated 5/10/2001 of the Government.
(2) The ecologically sensitive areas are the national parks, conservation areas, biosphere reserves, conservation areas of breeds and species, conservation areas of landscape, cultural and historical monuments that are established under the decision of the Prime Minister or the line ministries.
(3) Where the thermal power plants are located in region 4 but the distance between the thermal power plants and the boundary of regions 1, 2 and 3 is smaller or equal to 5 km, the Kv area coefficient corresponding to the regions 1, 2 and 3 (Kv is 0.6, 0.8 and 1 respectively) shall apply.
