DECISION
ON APPROVAL FOR MASTER PLANS FOR DEVELOPMENT OF SYSTEMS FOR RESERVING CRUDE OIL AND PETROLEUM PRODUCTS OF VIETNAM BY 2025 AND THE ORIENTATION TOWARDS 2035
THE PRIME MINISTER
Pursuant to Law on organization of the Government dated June 19, 2015;
Pursuant to the Prime Minister’s Decision No. 1748/QD-TTg dated October 14, 2015 on approval for the strategy for developing the oil and gas industry of Vietnam by 2025 with vision to 2035;
After considering the request of the Minister of Industry and Trade,
DECISION
Article 1. The master plan for development of systems for reserving crude oil and petroleum products of Vietnam by 2025 and the orientation towards 2035 shall be approved with the following contents:
I. VIEWPOINTS
1. Formulate a system for reserving crude oil and petroleum products in accordance with the strategy for socio-economic development of the country and the master plan for development of the oil and gas industry of Vietnam.
2. Develop a system for reserving crude oil and petroleum products of Vietnam to ensure oil supplies, stability of the domestic consumer market of petroleum products, stability of production capacity of refineries and the energy security.
3. Maximize the capacity of various types of oil reserves and ensure the fastest supply in case of emergency situations; develop reasonably the scale and capacity of depots and create the coherence between the scale development and modernization of the petroleum, oil and gas industry; apply scientific and technological advances in construction investment; use reasonably and efficiently available land area, seaport facilities and sources of investment capital.
4. Ensure environmental protection and fire safety.
II. DEVELOPMENT OBJECTIVES
1. General objectives
By 2020, the total capacity of the system for reserving crude oil and petroleum products in Vietnam is expected to reach at least 90 days of net imports, which satisfies the criteria of the International Energy Agency (IEA).
2. Specific objectives:
a) Producers’ preserve: Reserve of refineries includes crude oil and petroleum products reserved by enterprises producing oil to ensure that the regular reserve of crude oil and petroleum products at refineries under normal conditions can serve 25 days of production (equivalent to 30-35 days of net imports), provided the minimum reserve of crude oil is 15 days of production and the minimum reserve of petroleum products is 10 days of production.
b) Reserve of crude oil and petroleum products for commercial activities (hereafter referred to as “commercial reserve”): Petroleum trading companies shall reserve oil for commercial activities at central depots of oil import to ensure the stability of demand of domestic markets.
- From 2017 to 2025: Commercial reserve is expected to reach 30 days of consumption (equivalent to 35 days of net imports), provided the minimum reserve is expected to reach 1.6 million metric tons (equivalent to 37 days of net imports) by 2020 and 2 million metric tons (equivalent to 35 days of net imports) by 2025;
- The orientation towards 2035: The minimum commercial reserve is expected to reach 2.5 million metric tons (equivalent to 32 days of net imports) by 2030 and 3 million metric tons (equivalent to 31-32 days of net imports) by 2035.
c) National oil reserve: The State owns and decides the reserves of crude oil and petroleum products to regulate the market in case of emergencies.
- From 2017 to 2025: The reserve of crude oil and petroleum products is expected to reach 20 days of net imports including 6 days of net imports of crude oil and 14 days of net imports of petroleum products). In particular:
+ The reserve of petroleum products is expected to be approximately from 1.2 million metric tons to 1.4 million metric tons (equivalent to 1.5 – 1.8 million m3) and includes the following types:
. Petrol: 560,000 metric tons;
. Diesel oil (DO): 670,000 metric tons
. Mazut (FO): 56,000 metric tons
. Jet fuel (Jet A1): 153,000 metric tons
+ The reserve of crude oil is expected to be approximately from 1 million metric tons to 1.7 metric tons (equivalent to 1.4 - 2.2 million m3).
- The orientation towards 2035:
+ Enhance the quality, technology and facilities of depots for national oil reserve to reduce losses of crude oil and petroleum products and expenditures on the maintenance of national oil reserve.
+ Continue developing the system for reserving crude oil and petroleum products with the capacity from 25 to 30 days of net imports.
III. DEVELOPMENT ORIENTATION
1. Establish a system for reserving crude oil and petroleum products and distribute it corresponding to demand for oil production and consumption of regions in the whole country; optimize expenditures on investment, management and operation of the reserve system.
2. With regard to producers’ reserve: The scale, investment progress, types of crude oil depots and depots of petroleum products shall be conformable with the processing power, product structure and production plan of refineries.
3. With regard to the commercial reserve: The scale and progress of oil depot systems shall be conformable with consumption demand of each region in each stage of development.
4. With regard to national oil reserve: Places of depots used for national reserve of crude oil and petroleum products shall ensure the security and national defense and optimize routes of transport of crude oil and petroleum products to refineries and consuming regions.
IV. DEVELOPMENT MASTER PLANS
1. The system of producers’ depots
a) The basic plan: Producers’ depots will serve Dung Quat Oil Refinery and Nghi Son Refinery & Petrochemical LLC.
- By 2020, the reserve of crude oil and petroleum products is expected to reach approximately 0.85 million metric tons, equivalent to 20 days of net imports (12 days of net imports of crude oil and 8 days of net import of petroleum products) of the country.
- By 2025, the reserve of crude oil and petroleum products is expected to reach approximately 0.93 million metric tons, equivalent to 16 days of net imports (10 days of net imports of crude oil and 6 days of net import of petroleum products) of the country.
- By 2030, the reserve of crude oil and petroleum products is expected to reach approximately 0.93 million metric tons, equivalent to 12 days of net imports (7 days of net imports of crude oil and 5 days of net import of petroleum products) of the country.
- By 2035, the reserve of crude oil and petroleum products is expected to reach approximately 0.93 million metric tons, equivalent to 10 days of net imports (6 days of net imports of crude oil and 4 days of net import of petroleum products) of the country.
The detailed capacity of producers’ depots serving the existing refineries according to the plan is specified in Section 1 Appendix I issued together with this Decision.
b) The potential plan: After 2020, develop the system of producers’ depots when Vung Ro Refinery and Nam Van Phong Refinery come into operation.
- By 2025, the reserve of crude oil and petroleum products is expected to reach approximately 1.43 million metric tons, equivalent to 23 days of net imports (12 days of net imports of crude oil and 11 days of net import of petroleum products) of the country.
- By 2030, the reserve of crude oil and petroleum products is expected to reach approximately 0.93 million metric tons, equivalent to 22 days of net imports (13 days of net imports of crude oil and 9 days of net import of petroleum products) of the country.
- By 2035, the reserve of crude oil and petroleum products is expected to reach approximately 0.93 million metric tons, equivalent to 18 days of net imports (11 days of net imports of crude oil and 7 days of net import of petroleum products) of the country.
The detailed capacity of producers’ depots serving refineries when Vung Ro Refinery and Nam Van Phong Refinery come into operation according to the potential plan is specified in Section 2 Appendix I issued together with this Decision.
2. The system of commercial depots
a) The demand for capacity of depots for commercial reserves (hereafter referred to as “commercial depot”) of each supplying region.
To ensure the minimum reserve and reserve for circulation of petroleum trading enterprises, the capacity of commercial depots must reach at least 4.09 million m3 in 2020, 4.68 million m3 in 2025, 5.57 million m3 in 2030 and 6.63 m3 in 2035.
Detailed demand for the capacity of commercial depots is defined in Section 3 Appendix I issued together with this Decision.
b) The master plan for the development of the capacity of commercial depots (including central depots and local depots) in each supplying region
- From 2017 to 2020:
+ With regard to central depots: The total capacity of existing central depots is 579,000 m3, 931,000 m3 of depots is being built and 551,500 m3 of depots has been planned.
+ With regard to local depots: The total capacity of existing depots is 25,000 m3, 18,000 m3 of depots is being constructed and 200,000 m3 of depots has been planned.
- From 2021 to 2025:
+ With regard central depots: The total capacity of existing central depots is 663,000 m3, 470,000 cubic of depots is being constructed and 412,500 m3of depots has been planned.
+ With regard to local depots: The total capacity of existing local depots is 96,000 m3, 18,000 m3 of depots is being constructed and 53,000 m3 of depots has been planned.
The list of commercial depot projects that are given priority to be invested by 2025 and the orientations towards 2035 is provided in Section 4 Appendix I and Appendix IV issued together with this Decision.
3. The system of depots for national oil reserves
a) With regard to depots of petroleum products: Continue to rent some central depots in the Northern Vietnam (including Depot 130 in Quang Ninh, Thuong Ly depot in Hai Phong); the North Central Coast (Ben Thuy depot in Nghe An, Vung Ang depot in Ha Tinh); South Central Coast and Central Highlands (Phu Hoa depot in Binh Dinh, Cam Ranh depot in Khanh Hoa) and the Southern Vietnam (Cu Lao Tao depot and Cai Mep depot in Ba Ria Vung Tau, Phuoc Khanh depot in Dong Nai, Nha Be depot in Ho Chi Minh city, Soai Rap depot in Tien Giang , Tran Quoc Toan depot in Dong Thap, Tra Noc depot in Can Tho, etc.) for national reserves.
b) With regard to crude oil depots: Construct depots adjacent to refineries in order to facilitate the oil supply in case of emergency to these refineries. Crude oil depots include Dung Quat depot in Quang Ngai, Nghi Son depot in Thanh Hoa and Long Son depot in Quang Ngai. The capacity of each abovementioned crude oil depot is approximately 1 million m3.
4. Development of means of transportation
a) Gradually improve, upgrade and modernize existing means of waterway, road and rail transport in order to transport crude oil and petroleum products flexibly and safely according to the progress of the master plan.
b) Conduct research and develop pipeline systems used for oil transport when refineries come into operation; construct the new pipeline systems according to the master plan for development of oil pipeline system of Vietnam and focus on the pipelines from Nghi Son Refinery and Petrochemical LLC to Ha Nam and the pipeline from coastal oil terminals in the South Central Coast (Binh Dinh province or Phu Yen province) to Central Highlands.
V. IMPLEMENTATION OF THE MASTER PLAN
1. With regard to investment capital
a) Investors of the producers’ depot system and commercial depot system shall use the investment capital according to specific projects.
b) The investment capital of depots for national reserve which are affiliated to the State shall be provided by the state budget in accordance with regulations.
2. With regard to the organization and management
a) Improve the system of legal documents that provide authorities and enterprises with specific regulations on the capacity of reserved crude oil and petroleum products at refineries, commercial depots and depots for national oil reserves.
b) Closely and flexibly combine types of reserve, exploit efficiently the investment capital, human resources, the experience of the State and domestic and foreign enterprises and take opportunities for the regional cooperation as well as international cooperation. Enterprises that produce and trade in petrol and oil shall reserve oil in accordance with regulations of law.
c) Specify the inspection and supervision as well as penalties related to producers’ reserves and commercial reserves managed by enterprises.
d) Carry out promptly measures for stabilizing retail oil prices in case of market fluctuations
dd) Use the oil reserves in case of short-term decrease in oil supply. In particular:
- If the oil supply decreases by not more than 10%, the existing commercial reserve of enterprises in the region will be used.
- If the oil supply decreases by 10% - 20%, apart from commercial reserve, the existing producers’ reserve of refineries in the region will be used.
- If the oil supply decreases by more than 20%, apart from abovementioned reserves, the national reserve of petroleum products in the region and the national crude oil reserve will be provided to refineries.
e) If the oil supply decreases in a long term and seriously, the oil reserves will be used according to the following order:
- National reserves of petroleum products;
- National crude oil reserves;
- Commercial reserves;
- Producer’s reserve.
3. With regard to the assistance for enterprises
a) Make and issue appropriate financial regulations to facilitate the performance of tasks of national oil reserve of enterprises.
b) Formulate policies on development of facilities used for oil distribution in mountainous regions, islands and remote and isolated areas which face difficulties in land, traffic infrastructure, electricity and raising of capital and the business performance is still low.
c) Formulate methods for stabilization of oil prices, providing assistance to petroleum trading enterprises and ensuring the benefits of consumers in case of complex fluctuations of the world oil market.
d) Identify features of each project in manner that the land use right is transferred to enterprises in accordance with regulations of Law on Land and the enterprises can invest in the construction of terminals effectively; optimize the distribution of land for constructions of oil depots in the industrial zones in order to use effectively systems for dredging narrow passage of water, supplying electricity and water and traffic system.
dd) Use Official Development Assistance (ODA) to construct the pipeline systems for oil transport between different areas such as connecting pipelines from Nghi Son Refinery and Petrochemical LLC with the existing B12 pipeline system and connecting pipelines from coastal oil terminals to Central Highlands.
e) Arrange places for construction of new oil depots for enterprises having their oil depots cleared away or moved; formulate policies on support for transport cost, unmoved property and construction of new depots and on incentives of income tax, land value tax and payment of land levy in industrial zones and places of the master plan.
4. With regard to science and technology
- Promote activities of the scientific research and application of new technology to raise the effectiveness of management, direction and activities of production, trading and reserve of oil and the protection of natural resources and environment for sustainable development.
- Select, apply and develop foreign advanced technologies related to the transport, processing and storage of oil and pay more attention to the application of modern refining technologies and production of domestic equipment and materials to reduce expenditures on the construction of oil refining and petrochemical works and oil reserve works.
5. With regard to the safety and environmental protection
- Control strictly the process of oil production from input of materials to production of oil at the plants and supply of products for consumption and the oil transport and storage to ensure the compliance with procedures and regulations related to fire safety, responses to oil spills and environmental protection; make adjustments to environmental standards in accordance with environmental standards of Vietnam and set long-term environmental targets in accordance with environmental standards of Vietnam, area and the world.
- Intensify the propagation and popularization of knowledge about safety, fire safety and environmental protection to all employees and give incentives to domestic and foreign investment capital for environmental protection
- Join treaties, organizations and alliances related to reserves of crude oil and petroleum products in the area and in the world such as Petroleum Security Agreement, consider the capacity of joining International Energy Agency (IEA) and International Energy Program (IEP) by considering the membership, responsibilities and rights of members. According to IEP, each participating country shall reserve at least 90 days of the previous year’s net oil imports to response to crises and emergencies.
Article 2. Implementation
1. The Ministry of Industry and Trade shall:
a) Provide directions on the implementation of the master plan for development of system for reserving crude oil and petroleum products of Vietnam by 2025 and the orientation towards 2035 and focus on carrying out investment projects by 2025 as specified in the master plan.
b) Take charge and cooperate with relevant ministries in verifying legislative documents on oil and gas and oil reserve and send the competent authority a request for suitable amendments to facilitate the production, trading and reserve of crude oil and petroleum products, concurrently, request the assignment and decentralization in the state administration system from central authorities to local authorities, ensure their validity and efficiency and enable enterprises of all economic sectors to perform the task of national reserve of crude oil and petroleum products.
Take charge and cooperate with ministries in concretizing policies on development of depots for national oil reserves and development of facilities used for oil distribution in mountainous regions, islands and remote and isolated areas which face difficulties in land, traffic infrastructure, electricity and raising of capital and the business performance is still low.
c) Take charge of assessing and approving supplements to the planning for construction of commercial depots having the capacity from 5,000 m3 to under 100,000 m3.
d) Take charge of assessing and submitting a report to the Prime Minister who shall consider deciding to supplement the planning for construction of commercial depots having the capacity of 100,000 m3 or over.
The project on construction of an oil depot whose capacity is under 100,000 m3 that has been approved by the competent authority shall be assessed and reported to the Prime Minister for consideration and decision by the Ministry of Industry and Trade if its post-adjustment capacity is at least 100,000 m3.
dd) Take charge and cooperate with ministries in directing Vietnam Oil and Gas Group, Vietnam National Petroleum Group and petroleum trading enterprises to research and construct national depots of crude oil and petroleum products based on the research findings of the master plan for development of systems for reserving crude oil and petroleum products by 2025 and the orientation towards 2035.
e) Take charge and cooperate with relevant ministries in annual assessment of the implementation of the master plan which is used as the basis for consideration of adjustments.
2. The Ministry of Finance shall
a) Take charge and direct General Department of State Reserves and relevant ministries to formulate and submit policies on oil reserve
b) Formulate and request an annual plan for national reserve of crude oil and petroleum products during the period of the master plan to ensure the progress and practicability of investment projects.
c) Take charge and formulate the policy on the investment capital and finance to satisfy investment requirements and the operation cost of depots for national oil reserves
3.The Ministry of Transport shall:
Update, adjust and supplement the master plan for the system of seaports and narrow passages of water in accordance with regulations to meet the demand for transport, import and export of crude oil and petroleum products and ensure the optimal use of land surface and water surface and the sustainable development of oil and gas industry and maritime industry in the overall strategy for marine economy of Vietnam.
Reach agreements on detailed master plans for specialized seaports that are suggested to be added in the master plan for development of Vietnam’s seaport system.
4. The Ministry of Natural Resources and Environment shall:
Prepare legislative documents related to protection of land and sea environment applied to the storage, import and export of crude oil and petroleum products of oil depots.
5. The Ministry of National Defense, Ministry of Public Security, Ministry of Planning and Investment, Ministry of Science and Technology, the State bank of Vietnam, etc are assigned to carry out relevant tasks and methods.
6. People’s Committees of provinces and central-affiliated cities shall:
a) Cooperate with regulatory authorities and enterprises in supplementing and completing the master plan for socio-economic development of provinces, cities, and economic zones, industrial zones in connection with the implementation of the master plan for crude oil reserve and petroleum products by 2025 and the orientation towards 2035.
b) Formulate or adjust the planning for oil depots whose capacity is under 5,000 cubic square meters in accordance with oil depot system defined in the master plan for reserve of crude oil and petroleum products by 2025 and the orientation towards 2035.
The project on construction of an oil depot whose capacity is under 5,000 m3 that has been approved by the competent authority shall be reported to Ministry of Industry and Trade for consideration if its post-adjustment capacity is at least 5000 m3.
c) Reserve land surface and water surface in the places defined in the master plan for constructing crude oil depots.
7. Enterprises
a) Enterprises producing oil shall construct oil depots and relevant infrastructure to serve the crude oil in accordance with regulations, manage and maintain oil depots. The capacity that is higher than requirement for national reserve can be used for commercial purposes to exploit effectively the depot infrastructure.
b) Enterprises that are assigned to reserve petroleum products by the State shall construct more depots apart from existing central depots, buy petroleum products for reserve on schedule and manage and maintain petroleum product depots that rented by the State.
Article 3. This Decision comes into force from the day on which it is signed and replaces the Prime Minister’s Decision No. 1139/QD-TTg dated July 31, 2009 on approval for the master plan for system for reserving crude oil and petroleum products of Vietnam by 2015 and the orientation towards 2025 and the Prime Minister’s documents on adjustments to the master plan for the system for reserving crude oil and petroleum products of Vietnam before this Decision comes into force.
Article 4. The Minister of Industry and Trade, the heads of relevant ministries, Chairmen/ Chairwomen of People’s Committees of provinces and central-affiliated cities and the heads of relevant authorities and enterprise are responsible for the implementation of this Decision.
