DECISION

PROVISIONAL GUIDELINES ON TRAFFIC ORGANIZATION AND EPIDEMIC MANAGEMENT FOR AUTOMOBILE TRANSPORTATION DURING PERIOD OF COVID-19 EPIDEMIC MANAGEMENT

MINISTER OF TRANSPORT

Pursuant to Decree No. 12/2017/ND-CP dated February 10, 2017 of Government on functions, tasks, powers, and organizational structure of Ministry of Transport;

Pursuant to Resolution No. 78/NQ-CP dated July 20, 201 of the Government Resolving the Government meeting specialized in COVID-19 epidemic management;

Pursuant to Resolution No. 86/NQ-CP dated August 6, 2021 of the Government Resolving urgent solutions for COVID-19 epidemic management for implementation of Resolution No. 30/2021/QH15 dated July 28, 2021 of the 15th National Assembly;

Pursuant to Directive No. 16/CT-TTg dated March 31, 2020 of the Prime Minister on implementation of urgent solutions for COVID-19 epidemic management; Directive No. 15/CT-TTg dated March 27, 2020 complying with direction of the National Steering Committee for COVID-19 epidemic management; Pursuant to Directive No. 19/CT-TTg dated April 4, 2020 on continuation of COVID-19 epidemic management in the new normal;

Pursuant to document No. 1015/TTg-CN dated July 25, 2021 of the Prime Minister; document No. 5187/VPCP-CN dated July 29, 2021 of Prime Minister on facilitating commodity transport during COVID-19;

Pursuant to Decision No. 2553/QD-BYT dated June 18, 2020 of Minister of Health on issuance of Provisional guidelines on medical quarantine for preventing COVID-19 infection for vehicles and operators of vehicles transporting commodities at road, railway, waterway, and airway border checkpoints; Decision No. 2787/QD-BYT dated June 5, 2021 of Minister of Health guiding epidemic management solutions for COVID-19 cases in manufacturing facilities and industrial parks; document No. 5753/BYT-MT dated July 19, 2021 of Minister of Health on testing and facilitating individuals transporting commodities; document No. 5886/BYT-MT dated July 22, 2021 of Minister of Health on commodity transportation; document No. 4349/BCT-TTTN dated July 21, 2021 of Ministry of Industry and Trade on essential commodities and services;

Based on complicated development of COVID-19 in the country and remarks of Departments of Transport, Vietnam Automobile Transportation Association, and Vietnam Logistics Association, general regulations are required for implementation;

At request of Director of Transportation Authority and General Director of Vietnam Road Administration,

HEREBY DECIDES:

Article 1. The “Provisional guidelines on traffic organization and epidemic management for automobile transportation during period of COVID-19 epidemic management” are attached hereto.

Article 2. This Decision comes into force from the date of signing and shall be implemented during the period of COVID-19 epidemic management.

Article 3. Chief of Ministry Office, Chief Ministry Inspectorate, Directors of Departments and Authorities, General Director of Vietnam Road Administration, Directors, Directors of Departments of Transport of provinces and central-affiliated cities, Vietnam Logistics Enterprise Association, Vietnam Automobile Transportation Association, local Automobile transportation associations, transportation entities, and heads of relevant agencies, entities, individuals are responsible for implementation hereof./.

PROVISIONAL GUIDELINES

ON TRAFFIC ORGANIZATION AND EPIDEMIC MANAGEMENT FOR AUTOMOBILE TRANSPORTATION DURING THE PERIOD OF COVID-19 EPIDEMIC MANAGEMENT
(Attached to Decision No. 1570/QD-BGTVT dated August 24, 2021 of Minister of Transport)

Part 1

GENERAL REQUIREMENTS

I. PURPOSE

Ensure effective COVID-19 epidemic management while guaranteeing safe and coherent transportation of humans and commodities in order to protect health, serve the general public, satisfy business operation, reduce traffic congestion when adopting different levels of epidemic management according to regulations and law on epidemic management and Directive No. 16/CT-TTg dated March 31, 2020 of Prime Minister on implementation of COVID-19 epidemic management (hereinafter referred to as “Directive No. 16/CT-TTg”), and other guiding documents of competent authority.

II. REQUIREMENTS

1. Stay active, consistent, and organized during implementation of COVID-19 epidemic management measures when adopting different levels of epidemic management measures according to regulations and law and Directive No. 16/CT-TTg and other guiding documents of competent authority.

2. Assign tasks and responsibilities of agencies, organizations, and individuals relating to automobile transportation of commodities, transportation of workers, experts, and individuals coming from infected areas during the period of COVID-19 epidemic management.

III. SCOPE AND REGULATED ENTITIES

1. Scope

These Provisional guidelines apply to commodity transportation, worker transportation, expert transportation, transportation of people to, from, and across infected areas. Transportation of corpses in infected areas, from infected areas, or to infected areas for cremation or burial serving COVID-19 epidemic management shall conform to guidelines of Ministry of Health.

2. Regulated entities

Regulatory agencies, epidemic management personnel, transport entities transporting commodities, workers, experts, individuals from infected areas, and organizations, individuals relating epidemic management in automobile transportation.

IV. TERM INTERPRETATION

1. “green roads” refers to roads organized for prioritizing and facilitating commodity transportation during period of COVID-19 epidemic management. Green roads consist of roads where commodity transport are allowed as per traffic organization.

2. “green lane” refers to a lane preserved specifically for prioritized vehicles as per the law (ambulance, public affair vehicle, etc.), and vehicles carrying identification documents when passing epidemic control posts.

3. “vehicle identification document carrying QR code” (hereinafter referred to as “identification document”) is used for identifying prioritized vehicles, facilitating transportation during organization, route classification, traffic coordination, and COVID-19 epidemic management when commodity transport enters, exits, or traverses infected areas.

4. “transport entities” consist of transport service providers providing automobile transportation (transportation enterprises, cooperatives, and business households), internal transport service providers, and vehicle owners.

5. “people on vehicles” consist of drivers, personnel serving aboard vehicles, commodity loading/unloading personnel that go along with vehicles, experts and individuals returning from infected areas.

6. “test document” refers to Certificate of negative SARS-CoV-2 test results issued by competent authorities and entities and valid for 3 days (72 hours) from the time in which test results are produced or according to other deadline prescribed by Ministry of Health.

V. GENERAL REQUIREMENTS

1. Transport authority of all levels must promptly advice competent authority in organizing traffic, transport plans, and control epidemic for road transportation during period of COVID-19 epidemic management.

2. Transport entities:

a) Actively develop transport plans, measures for mobilizing vehicles, drivers, materials, and components within their units, acknowledge information on routes, itinerary, epidemic control posts, regulations on epidemic management for vehicles and people on vehicles at epidemic control posts; medical facilities, epidemic control posts providing SARS-CoV-2 test along the way; commodity load and unloading locations; popularize transport plans to people on vehicles for compliance with epidemic management requirements;

b) Stringently implement provisions relating to COVID-19 epidemic management as per guidelines of Ministry of Health under document No. 5753/BYT-MT dated July 19, 2021, document No. 5886/BYT-MT dated July 22, 2021, other relevant documents, and regulations and law on epidemic management; comply with regulations on traffic organization and epidemic management for transport operation during the period of epidemic management according to these Provisional guidelines.

3. Temporary accommodations, delivery location, loading and unloading location must stringently comply with regulations on COVID-19 epidemic management during the period in which people on vehicles reside and delivery commodities.

4. People on vehicles must:

a) Stringently comply with “5K principles”, perform medical declaration according to regulations of Ministry of Health and obtain master registers of valid test documents throughout transport period; declare on website suckhoe.dancuquocgia.gov.vn;

b) Stringently implement provisions relating to COVID-19 epidemic management as per guidelines of Ministry of Health under document No. 5753/BYT-MT dated July 19, 2021, document No. 5886/BYT-MT dated July 22, 2021, other relevant documents, and regulations and law on epidemic management; comply with regulations on traffic organization and epidemic management for transport operation during the period of epidemic management according to these Provisional guidelines.

Part 2

TRAFFIC ORGANIZATION AND EPIDEMIC MANAGEMENT FOR TRANSPORTATION DURING PERIOD OF EPIDEMIC MANAGEMENT

SECTION 1. TRAFFIC ORGANIZATION

I. DEVELOP TRAFFIC ORGANIZATION SOLUTIONS

1. Vietnam Road Administration shall take charge and cooperate with Departments of Transport, Department of Transport – Construction of Lao Cai (hereinafter referred to as “Departments of Transport”), and relevant entities in organizing surveys, selecting expressways and national highways to organize traffic, classify routes for vehicles to avoid areas where social distancing is in effect; establish convenient and visible traffic signs to allow vehicle operators and transport entities to know and comply with when inhabitants of nearby administrative divisions are practicing social distancing as per Directive No. 16/CT-TTg or other levels of epidemic management in order to meet traffic and commodity transportation demands.

2. Departments of Transport shall take charge and cooperate with local departments and relevant entities in surveying and selecting roads, positions for epidemic control posts for organizing traffic, classifying routes for traffic to avoid infected areas in conformity with traffic organization and route classification solutions publicized by Vietnam Road Administration and relevant administrative divisions; establish traffic signs to inform vehicle operators and traffic entities; advise People’s Committees of provinces and central-affiliated cities (hereinafter referred to as “provincial People’s Committees”).

3. Vietnam Road Administration and Departments of Transport shall publicize traffic solutions and route classification for avoiding infected areas on mass media to inform and request implementation of road users and transport entities.

II. POSITION SELECTION AND TRAFFIC ORGANIZATION AT EPIDEMIC CONTROL POSTS

1. Selection of position of epidemic control posts

COVID-19 epidemic control posts on traffic routes must be located in clear, safe, and convenient positions to allow inspection of vehicles and epidemic management.

2. Traffic organization at epidemic control posts

a) Depending on traffic rate on each route, a single epidemic control post may be designated into multiple control stations and an epidemic control post is recommended to designate at least 2 control stations with each control station inspecting specific types of vehicles to prevent overlapping or traffic congestion; assign proper distance to allow authorities to classify vehicles entering into inspection; do not allow vehicles to park on the roads to prevent traffic congestion;

b) Epidemic control posts (especially in routes with large traffic flow) must organize traffic classification, and coordinate traffic from the distance; assign multiple concentration locations to group up vehicles ineligible for operation to avoid traffic congestion at epidemic control posts;

c) For routes with at least 3 lanes in the same direction, rely on traffic flow going through epidemic control posts to organize green lanes;

d) Road segments where epidemic control posts are positioned must have warning signs and directions installed to allow specific type of vehicles to enter inspection safely and conveniently.

3. Publicize locations, traffic organization measures, inspection contents, eligibility for crossing epidemic control posts on mass media to allow vehicle operators to choose appropriate route, and requirements for rapid and convenient commodity transportation.

III. TRAFFIC ORGANIZATION IN QUARANTINED AREAS

Departments on Transport are responsible for:

1. Taking charge and cooperating with relevant agencies and local governments in developing traffic organization measures connecting from the outside of quarantined areas to locations of delivery and transit within the quarantined areas.

2. Cooperating with relevant agencies and local governments in designating adjacent transit locations for essential commodities (situated outside of quarantined areas) to serve quarantined areas.

3. Advising provincial People’s Committees to direct local governments of all levels to cooperate with relevant entities in organizing epidemic control posts on roads to ensure that vehicles only enter and exit commodity delivery, transit locations conveniently:

a) In case commodity delivery, transit locations are ports, docks, railway stations, warehouses, industrial parks, export-processing parks, or manufacturing facilities that are situated in quarantined areas and allowed by competent authority to operate to maintain commodity manufacture, import, and export;

b) In case commodity delivery, transit locations are ports, docks, railway stations, warehouses, industrial parks, export-processing parks, or manufacturing facilities that are situated outside of quarantined areas where vehicles must exit, enter, or go through quarantined areas in order to reach said commodity delivery, transit locations.

4. Cooperating with Departments of Industry and Trade, relevant ministries, and local governments in organizing transportation of essential commodities serving inhabitants of quarantined areas.

SECTION 2. EPIDEMIC CONTROL AFFAIRS

I. TRANSPORT VEHICLE CONTROL AT EPIDEMIC CONTROL POSTS

1. For vehicles with identification documents

Control personnel shall employ smart phones or specialized equipment to scan QR code on identification documents to quickly inspect information on vehicles, people on vehicles, effective period of test documents, transport routes, and:

a) If QR scan reveals sufficient information, allow vehicles to cross epidemic control posts;

b) If QR scan reveals inadequate information and if people on vehicles present master register of valid test documents, driving license (for vehicle operators), Citizen Identity Cards or ID Cards (for people serving on vehicles, commodity loading and unloading personnel who travel with vehicles) and present proper medical declaration, allow vehicles to cross epidemic control posts and request people on vehicles to update information at www.luongxanh.drvn.gov.vn or green road application;

c) If QR scan reveals in adequate information and if people on vehicle fail to present master register of valid test documents or have not performed medical declaration, instruct vehicles to enter vehicle inspection areas at epidemic control posts (do not allow vehicles to park on the road) for inspection and processing as per epidemic management regulations and law. If people on vehicles are found positive to SARS-CoV-2, organize quarantine as per the law.

2. For vehicles that lack adequate identification documents

Control personnel shall request, instruct vehicles to enter vehicle inspection areas at epidemic control posts (do not allow vehicles to park on the road) to examine information and proceed as follows:

a) In case people on vehicles present master register of valid test documents, driving license (for vehicle operators), Citizen Identity Cards or ID Cards (for people serving on vehicles, commodity loading and unloading personnel who travel with vehicles) and have performed medical declaration, allow vehicles to cross epidemic control posts;

b) In case people on vehicles fail to present master register of valid test documents or have not performed medical declaration, continue to instruct and process according to regulations and law on epidemic management. If people on vehicles are found positive to SARS-CoV-2, organize quarantine as per the law.

II. EPIDEMIC CONTROL AT CONCENTRATION LOCATIONS, COMMODITY TRANSIT, DELIVERY, LOADING, AND UNLOADING LOCATIONS

1. Transport authority shall cooperate with medical authority, medical authority, local governments, and relevant entities in organizing inspection at vehicle concentration locations, commodity transit and delivery locations (ports, docks, warehouses, storage, industrial parks, export-processing facilities, manufacturing facilities, etc.), promptly detecting and taking strict actions against violations of COVID-19 epidemic management regulations.

2. Supervisory entities of vehicle concentration locations, commodity transit, and delivery locations (ports, docks, warehouses, storage, industrial parks, export-processing facilities, manufacturing facilities, etc.) are responsible for complying with regulations and law on COVID-19 epidemic management.

3. Local authorities shall inspect and supervise compliance with epidemic management regulations of local governments where temporary accommodations of people on vehicles are located (temporary accommodations shall be organized by transport entities or local governments).

4. Local medical authority shall instruct and inspect compliance with COVID-19 epidemic management measures in temporary accommodations of vehicle operators and people travel with vehicles of transport entities.

5. Transport entities shall request people on vehicles to refrain from leaving the cabins; comply with “5K principle” when leaving the cabins; maintain safety distance of at least 2 m when interacting with other people; sanitize with at least 60% alcohol or clean hands with soap on a regular basis for at least 30 seconds.

Part 3

COMMODITY TRANSPORT WITH AUTOMOBILES DURING PERIOD OF EPIDEMIC MANAGEMENT

I. PRIOR TO TRANSPORT

1. Transport entities shall comply with the followings:

a) Inspect and guarantee technical safety of vehicles; inspect driving license and other documents at request of transport entities, and assign transportation tasks for vehicle operators;

b) Equip protective equipment, face masks, goggles, hats, gloves, and shoe covers for people on vehicles;

c) Inspect and assume legal responsibilities for ensuring adequate master register of valid test documents and medical declaration of everyone on the vehicles before the trip;

d) For vehicles with identification documents, perform medical declaration again or assign people on vehicles to perform declaration again in case of any change to originally declared information.

2. People on vehicles shall comply with the followings:

a) Obtain master registers of valid test documents, driving license (for vehicle operators), ID Cards or Citizen Identity Cards (for people serving on vehicles, commodity loading and unloading personnel who travel with vehicles) and perform medical declaration as per the law;

b) Vehicle operators shall receive tasks and information on the trip: number of people travel with the vehicles, estimated time of transport, transport route, delivery locations, resting locations, SARS-CoV-2 sampling locations, inspection for technical safety of the vehicles.

c) Carry protective equipment, face masks, goggles, hat, gloves, shoe covers;

d) For vehicles with identification documents, use smart phones or specialized equipment to scan QR code on vehicles, and update information on valid test documents as instructed on the software.

II. WHEN OPERATING ON THE ROAD

1. Transport entities:

a) Monitor, supervise, and remind people on vehicles to strictly comply with regulations and law on epidemic management during implementation of transportation tasks;

b) Monitor and request people on vehicles to arrive at the nearest and most convenient medical facilities or epidemic control posts (which organize SARS-CoV-2 testing) to test for SARS-CoV-2 when test documents are close to expire;

c) Cooperate with the authority in controlling people and vehicles operating on the road when requested.

2. People on vehicles

a) Comply with declared routes, deliver, receive commodities, rest, and concentrate vehicles at locations identified in transportation solutions. Arrive at the nearest and most convenient medical facilities or epidemic control posts (which organize SARS-CoV-2 testing) to test for SARS-CoV-2 as per the law when test documents are close to expire before continuing with transport;

b) Remove identification documents from vehicles when the identification documents of vehicles are no longer adequate;

c) Comply with inspection and control requirements of the authority for COVID-19 epidemic management;

d) For vehicles with identification documents: Vehicle operators must transport commodities within the information and transport routes selected; transport and deliver commodities to the correct destinations;

dd) For vehicles without identification documents: Vehicle operators must comply with guidelines of epidemic management authority where the vehicles are currently operating; transport and deliver commodities to the correct destinations.

III. COMMODITY DELIVERY AND LOADING, UNLOADING

1. For vehicles entering, exiting, or going across infected areas

a) People on vehicles shall refrain from leaving the cabins; comply with “5K principle” when leaving the cabins; maintain safety distance of at least 2 m when interacting with other people; sanitize with at least 60% alcohol or clean hands with soap on a regular basis for at least 30 seconds; employ communication devices to contact and limit direct contact;

b) Commodity delivery personnel and entities are responsible for loading, unloading commodities, refraining from making contact with people on vehicles; designating destinations, resting locations, temporary accommodations for people on vehicle while waiting for commodity loading and unloading according to epidemic management affairs as per the law.

2. For vehicles not entering, exiting, or going across infected areas

a) Refrain from leaving the cabins; employ communication devices and restrict direct contact;

b) Comply with “5K principle” when leaving the cabins; maintain safety distance of at least 2 m when interacting with other people; sanitize with at least 60% alcohol or clean hands with soap on a regular basis for at least 30 seconds.

IV. CONCLUDING TRANSPORTATION TASKS OR CONCLUDING WORKING SHIFTS

1. Transport entities:

Develop measures for managing people on vehicles after finishing the transport trip, request limited contact, strictly comply with “5K principles”, and guarantee temporary accommodations for people on vehicles as per guidelines of medical authority and relevant local agencies.

2. People on vehicles

a) In case of delivering, receiving commodities, arriving at, or going from infected areas

- Comply with “5K principle”, maintain safety distance of at least 2 m when interacting with other people; sanitize with at least 60% alcohol or clean hands with soap on a regular basis for at least 30 seconds. In case of not resting on vehicles, immediately move to accommodations and comply with epidemic management measures as per the law;

- In case transport entities provide temporary accommodations, people on vehicles must strictly comply with COVID-19 epidemic management regulations as per instruction of the authority at location of the temporary accommodations. Do not leave temporary accommodations during period of stay; avoid all physical contact with other people staying in the same accommodations;

- In case of going home, stay in separate rooms eligible for quarantine as per instruction of Ministry of Health and do not make physical contact with nearby people;

- In case of no longer performing transportation tasks, comply with epidemic management regulations;

- For vehicles eligible for acting as temporary accommodations, may stay on the vehicles.

b) In case vehicles travel cross without parking, stopping, and making contact with people in infected areas during the journey, strictly comply with “5K principles” and epidemic management recommendations of the medical sector;

c) Monitor body temperature and health on a daily basis, any sign of fever, cough, dyspnea, or fatigue must be reported to supervisory entities and medical authority for timely actions.

Part 4

TRANSPORT OF WORKERS AND EXPERTS WHEN EXITING, ENTERING, OR ACROSS INFECTED AREAS

1. Entities providing transport for workers and experts when exiting, entering, or across infected areas must:

a) Comply with guidelines of provincial People’s Committees and Ministry of Health on COVID-19 epidemic management;

b) Assume responsibilities for monitoring, inspecting, and closely monitoring activity of the vehicles and operators thereof; make commitment and assume legal responsibilities for guaranteeing adherence to transport routes and compliance with epidemic management measures;

c) Send lists of vehicles, time, route of transport, lists of vehicle operators and personnel serving on the vehicles (if any), and identification of vehicles to Departments of Transport and epidemic control posts (if any) along transport routes for cooperative inspection and supervision.

2. Vehicle operators, personnel serving on vehicles, workers, and experts on vehicles

a) Perform medical declaration as per regulations of Ministry of Health and at request for epidemic management of local authorities of points of departure and points of arrival; strictly comply with “5K principles” during the trip; carry master registers of valid test documents; prepare sufficient food, supplies, and personal belongings for the trips; monitor body temperature and health on a daily basis any sign of fever, cough, dyspnea, or fatigue must be reported to supervisory entities and medical authority for timely actions;

b) When operating vehicles, operators must strictly comply with “one route, two destinations” principle; do not park or stop (except for emergencies); carry list and closely control people on the vehicles.

3. Departments of Transport shall advise provincial People’s Committees where workers and experts arrive to assign a local authority to act as the contact point to direct entities to:

a) Manufacturing facilities, commodity delivery locations, construction units working on primary constructions, etc. are legally responsible for ensuring adherence to epidemic management measures of all workers and experts as per the law; producing lists of workers and experts, and lists of vehicles, operators, personnel serving on vehicles (if any) who participate in the transportation;

b) Provide guidelines on epidemic management measures for transport entities, vehicle operators, personnel serving on vehicles; entities transporting workers, experts, and relevant organizations and entities.

Part 5

TRANSPORT OF INDIVIDUALS FROM INFECTED AREAS

1. Transport of individuals from infected areas shall be implemented when provincial People’s Committees where individuals are to be transported from send agreements on transportation solutions to provincial People’s Committees where Directive No. 16/CT-TTg is in effect, the transportation solutions must include information on organization of transport such as: lists of transported individuals, parking and stopping locations, resting locations; whether the vehicles move in groups or individually; number of passengers allowed/trip; solutions for accompanying medical personnel and service personnel (if any), etc. while assigning local authority to act as contact point for implementation.

Solutions for transporting individuals from infected areas must include participation, agreement of medical authority, public security authority, transport authority, and local authority where individuals are transported to, etc. and commitment of transport entities to ensure traffic safety and strict compliance with epidemic management regulations and requirements of Ministry of Health, local governments.

2. Departments of Transport shall advise provincial People’s Committees of departure and arrival to assign a local authority to act as the contact point to direct entities to:

a) Provide guidelines on epidemic management measures for transport entities, vehicle operators, personnel serving on vehicles, individuals coming from infected areas, etc.;

b) Develop measures for performing medical quarantine as per regulations Ministry of Health and local governments; assign personnel to participate in transport in order to provide guidelines and supervise epidemic management affairs during the transportation;

c) Provide guidelines on identification for vehicles, transportation route, and supervision of transportation progress for transport entities and vehicle operators;

d) Send lists of vehicles, time, route of transport, lists of vehicle operators and personnel serving on the vehicles (if any), and identification of vehicles to Departments of Transport and epidemic control posts (if any) along transport routes for cooperative inspection and supervision;

dd) Monitor and closely control progress of vehicles on system for processing data from tracking devices (for vehicles transporting for commercial purposes).

3. Transport entities:

a) Assume responsibilities for monitoring, inspecting, and supervising activities of vehicles and operators throughout transportation process;

b) Make commitment and assume legal responsibilities for guaranteeing adherence to transport routes and compliance with epidemic management measures of vehicles and operators;

c) Sanitize vehicles before and after concluding the journey as per instruction of local Departments of Health.

4. Vehicle operators, personnel serving on vehicles, and individuals arriving from infected areas:

a) Perform medical declaration as per regulations of Ministry of Health and at request for epidemic management of local authorities of points of departure and points of arrival; strictly comply with “5K principles” during the trip; carry master registers of valid test documents; prepare sufficient food, supplies, and personal belongings for the trips;

b) Vehicle operators must carry lists of individuals from infected areas bearing confirmation of medical authority of points of department and documents of provincial People’s Committees of points of arrival.

- Strictly comply and operate vehicles within the time period and route, and stop vehicles according to approved transportation solutions; do not stop or park vehicles in locations not mentioned under transportation solutions (except for emergencies);

- Assume responsibilities of closely examining individuals on vehicles; sterilize vehicles before and immediately after finishing the trip as per guidelines of local Departments of Health;

- Perform epidemic management measures according to Ministry of Health and local governments of destinations.

Part 6

IDENTIFICATION OF COMMODITY TRANSPORT VEHICLES

1. Transport entities that wish to employ identification documents shall declare information in order to obtain identification documents for commodity transport vehicles as per guidelines and assume legal responsibilities for accuracy of declared information.

2. Declaration of information to obtain identification documents shall be implemented as follows:

a) Log in and comply with instruction in www.luongxanh.drvn.gov.vn or in green road application;

b) Perform declaration again or assign people on vehicles to perform declaration again in case of any change to originally declared information;

c) Print identification documents and post in visible spots on declared vehicles (carry 1 backup copy in case the copy posted on the vehicles is damaged).

3. Identification documents shall be invalid if:

a) Test documents of any of the people on vehicles expire;

b) Effective period of Directive No. 16/CT-TTg expires locally.

4. Inspection and reconciliation of information of identification documents shall be implemented by the authority or competent agencies via:

a) Scanning QR code on identification code with smart phones or specialized devices;

b) Looking up information on www.luongxanh.drvn.gov.vn.

5. Vietnam Road Administration shall take charge and cooperate with Departments of Transport in maintaining and updating www.luongxanh.drvn.gov.vn and greed road application to ensure coherent, transparent, and public operation; ensure that declaration, receipt, and return of identification document are implemented automatically.

Part 7

ORGANIZATION FOR IMPLEMENTATION

1. Request Ministry of Health, Ministry of Public Security, and relevant ministries to cooperate with Ministry of Transport and provincial People’s Committees to

a) organize guidelines on traffic organization and COVID-19 epidemic control in automobile transport within their competence;

b) request Ministry of Health and Ministry of Information and Communications to share and link data on medical declaration, SARS-CoV-2 test results, and COVID-19 vaccination of vehicle operators; regulate epidemic management levels in areas to serve safe traffic organization satisfactory to COVID-19 epidemic management;

c) request Ministry of Health to provide specific guidelines on epidemic management measures in transportation of corpses in infected areas, from infected areas, or to infected areas for cremation or burial.

2. Request provincial People’s Committees to

a) rely on practical conditions within their provinces to direct Departments of Transport and relevant entities to implement within these Provisional guidelines;

b) rely on COVID-19 epidemic development within their provinces to direct authorities to research and include other requirements to these Provisional guidelines in case the provinces adopt a more stricter measure than Directive No. 16/CT-TTg and promptly inform Vietnam Road Administration prior to implementation;

c) direct local medical authority to provide guidelines on COVID-19 epidemic management measures for temporary accommodations and vehicle sterilization before and after transportation; prioritize vaccination and SARS-CoV-2 testing for operators of commodity transport;

d) direct interdisciplinary control posts to implement Part 2 and Clause 4 Part 6 hereof;

dd) direct local governments of all levels and Boards for management of industrial parks to inspect commodity transport vehicles that enter and exit concentration areas, transit areas, delivery locations (ports, docks, warehouses, storage, industrial parks, export-processing facilities, manufacturing facilities, etc.) to ensure proper compliance with COVID-19 epidemic management requirements and prevent traffic congestion.

3. Vietnam Road Administration

Comply with tasks assigned above and the followings:

a) encourage and instruct Departments of Transport, transport entities, vehicle operators, and relevant organizations, individuals to implement these Provisional guidelines;

b) take charge developing and providing guidelines on using software for declaring information for identification documents; issue software login accounts for Departments of Transport;

c) Direct Departments of Road Administration to assign forces for cooperating with local authority in establishing epidemic control posts on national highways and classify traffic routes to serve epidemic management and prevent traffic congestion, traffic accidents;

d) Create communication groups (on Zalo, Viber, Facebook, etc.) between Vietnam Road Administration, Departments of Road Administration, Departments of Transport, local authorities, transport entities, and transport associations to promptly publicize, communicate about new policies and new regulations, and acknowledge difficulties in epidemic management in automobile transportation to promptly provide guidelines or consolidate and report to Ministry of Transport for resolution;

dd) Actively acknowledge and receive information on difficulties in implementation hereof and report to Ministry of Transport for corresponding revision.

4. Transport Health Department

a) take charge and cooperate with Vietnam Road Administration, Transport Agency, Departments of Transport in advising Minister of Transport to instruct transport entities and people on vehicles to implement COVID-19 epidemic management in transport as per direction of the Government, Prime Minister, and Minister of Health;

b) take charge and cooperate with Departments of Health and Departments of Transport in directing Transport Hospitals to cooperate with local commodity transport associations and local supporting transport entities in organizing mobile testing for operators of commodity transport vehicles. Comply with regulations of Ministry of Health on sampling and issuance of test documents during implementation and:

- Develop solutions for cases where test results of vehicle operators are positive;

- Inform vehicle operators and transport entities publicly about: Eligibility for receiving quick test kits for free as per the law, eligibility for not receiving quick test kits for free as per the law; test fees for each eligibility, and ensure compliance with regulations of Ministry of Health and other relevant regulations;

- Be ready to vaccinate vehicle operators and workers of transport sector when requested by competent authority.

5. Departments of Transport

Comply with tasks assigned above and the followings:

a) take charge and cooperate with ministries and relevant entities in advising provincial People’s Committees to direct and organize implementation within these Provisional guidelines;

b) develop transport plans to promptly mobilize transport entities and vehicles serving epidemic management (including transporting humans, commodities, equipment) at request of Steering Committees for epidemic management;

c) assign personnel and necessary equipment to examine information on software of Vietnam Road Administration and ensure around the clock operation;

d) publicize transport activities accompanying COVID-19 epidemic management on website of Departments of Transport and mass media; hotline, email address, and Zalo to allow transport entities and vehicle operators to know and comply, receive feedback, and deal with any difficulty;

dd) cooperate with Department of Transport Health and Departments of Health in directing Transport Hospitals to cooperate with commodity transport associations and transport entities in assisting local governments in organizing mobile SARS-CoV-2 testing for operators of commodity transport vehicles; rely on local practical conditions to develop management measures for vehicle operators and personnel travelling with vehicles after finishing the trip to ensure epidemic management.

6. Road administration entities (other than Vietnam Road Administration, Departments of Transport)

a) cooperate with local authority in implementing traffic organization and traffic route classification to guarantee coherent commodity transport;

b) manage, maintain roads, ensure coherent and safe management and extraction of road works;

c) cooperate with authorities in examining and supervising implementation of COVID-19 epidemic management measures at epidemic control posts, commodity suppliers, vehicle rest stops.

7. Vietnam Logistics Enterprise Association, Vietnam Automobile Transportation Association, local Automobile transportation associations

a) publicize to allow local transport entities to know and comply with these Provisional guidelines, guiding documents, and guidelines of relevant ministries and local governments regarding automobile transportation and COVID-19 epidemic management, and ensure coherent and safe transportation satisfactory to epidemic management as per the law;

b) cooperate with Transport Hospitals and transport entities in organizing mobile SARS-CoV-2 testing for commodity transport vehicles within direction of competent authority.

8. Transport entities, people on vehicles, and people coming from infected areas must comply with COVID-19 epidemic management requirements under Section V Part 1, Part 3, Part 4, and Part5 hereof; regulations of Ministry of Health and relevant law provisions./.
