DECISION
APPROVAL FOR THE PLAN FOR ENHANCEMENT OF EFFECTIVENESS OF IMPORTS AND EXPORTS SPECIALIZED INSPECTION
THE PRIME MINISTER
Pursuant to the Law on Government organization dated December 25, 200;
Pursuant to the Government’s Resolution No.19/NQ-CP on major tasks and measures for improvement of business environment and national competitiveness dated March 18, 2014;
Pursuant to the Government’s Resolution No.19/NQ-CP on major tasks and measures for improvement of business environment and national competitiveness for the period 2015 - 2016 dated March 12, 2015;
At requests in the Document No. 143/TTr-BTC dated September 29, 2015 by the Minister of Finance,
HEREBY DECIDES
Article 1. To approve the plan for enhancement of the effectiveness of specialized inspection of imports and exports (hereinafter referred to as “the plan”) as follows:
I. OBJECTIVES
1. Overall objectives:
To complete the State management policies, mechanism, regulations and procedures with the aim of improving the effectiveness of the specialized inspection of imports and exports, reducing the waiting time of customs clearance, saving enterprises’ budgets and public budgets, conforming with the international practice, facilitating Vietnam’s goods exportation, establishing the imports technical standards and protecting people health and the environment;
- To enhance the competitiveness of Vietnamese goods and enterprises.
2. Specific objectives:
a) To facilitate the import and export at checkpoints by simplifying administrative procedures; to save the State budget as well as enterprises’.
b) To shorten the waiting time for customs clearance as Asean-6 countries did. To be specific: In 2016: the waiting time for customs clearance of exports and imports is shorter than 10 days and 12 days, respectively; By 2020 , the waiting time for customs clearance of exports and imports is shorter than 05 days.
c) To facilitate Vietnamese goods exportation; to establish the technical standards on imports (especially for those not promoted by the State); to protect the domestic production, community health and environment.
d) To improve the effectiveness of specialized inspection to ensure the conformity with regulations of laws and international practices in imports and exports; to enhance the national competitiveness and national security and defense.
II. STANDPOINTS
1. Identify sectors and goods subject to the specialized inspection by State regulatory authorities. The goods that may cause damage to community health, environment, national economy or security and defense (such as goods subject to quarantine, animals, plants, hazardous chemicals, pesticides, scrap, weapons, radioactive substances, etc.) shall undergo the strict inspection at checkpoints by the State competent authority.
2. Privatize the specialized inspection
The state competent authorities shall determine sectors and goods subject to privatized specialized inspection, and issue standards, regulations and requirements for the involvement of private sectors in specialized inspection, and regulations on specialized inspection and handling of violations.
3. Apply measures for improving the effectiveness of specialized inspection of imports and exports at checkpoints.
4. Comply with international practices, Conventions and international agreements to which Vietnam is a signatory; apply risk management processes methods to specialized inspection of imports and exports and apply information technologies to exchange electronic data on specialized inspection results between relevant agencies.
III. SPECIFIC TASKS
1. Complete legal systems for specialized inspection:
a) Review and complete legislative documents related to line management and specialized inspection of imports and exports; and remedy shortcomings and inconsistencies according to set forth objectives and standpoints
b) Review, compile and publish the complete list of goods subject to specialized inspection; compile lists of key goods subject to inspection at checkpoints and pre-clearance inspection, and lists of goods subject to post-clearance inspection before being sold on the market.
c) Annually examine the list of goods subject specialized inspection to promptly update according to the requests by the State. All goods on the List must have its HS code in conformity with the Vietnam’s List of Imports and Exports, and Vietnam’s current HS code released by the Ministry of Finance.
d) Issue national technical regulations and standards on goods subject to specialized inspection as the basis for quality control; designate the state authority in charge of goods quality inspection; introduce regulations on recognition of certifying agencies and goods inspection agencies, and guidance documents on procedures for inspection and processing of inspection results within the administration of the Ministry.
Propose incentive policies to encourage conformity-assessing organizations to participate in specialized inspection of imports and exports.
2. Reform specialized inspection methods to facilitate the import and export, reduce costs and shorten waiting time for customs clearance:
a) Apply risk management processes to specialized inspection such as probability inspection or post-customs clearance inspection if it is low-risk goods or the goods is made in developed countries or by law-abiding enterprises.
b) Carry out the specialized inspection of goods containing high risks of infectious diseases or those that may be harmful to people health, community security and environment.
c) Prioritize and facilitate the specialized inspection of goods encouraged to be imported or exported by the State and imports that are not produced in Vietnam.
d) Mutually recognize or accept each other’s inspection results or ease the quality inspection of imports from developed countries such as EU, United States, Canada, Japan, Australia, new Zealand and famous manufacturers recognized by international accreditation organizations.
dd) Construct warehouses at checkpoints to store imports and exports for specialized inspection at checkpoints. Introduce privatization policies for warehousing service providers in order to save the State budget.
e) Step up the application of information technology to the exchange of electronic data on specialized inspection results; develop mechanism for information exchange between inspecting authorities and customs authorities; promptly notify specialized inspection results to customs authorities; manage and inspect goods at the warehouses; and deal with violations against laws on customs and line management.
3. Invest in facilities and human resources to improve the quality and effectiveness of specialized inspection:
a) Invest in facilities, state-of-the-art equipment and machines, improve working environment for specialized inspection; provide training and designate qualified staff to carry out the State management of imports and exports subject the specialized inspection at checkpoints; focus on goods that may contain high risks of infectious diseases or may be harmful to people’s health and environment (such as goods on the list of goods subject to quarantine, hazardous chemicals, pesticide, etc.)
b) Prioritize the investment in machines, facilities and human resources at checkpoints of international airports ( such as Noi Bai, Tan Son Nhat and Danang International Airports), checkpoints on international roads and main checkpoints in Lao Cai, Lang Son and Quang Ninh to carry out the specialized inspection of imports that may contain high risks of infectious diseases or may be harmful to people’s health and environment ( such as goods on the list of goods subject to quarantine, hazardous chemicals, pesticide, etc.).
4. Propagate and providing training in specialized inspection for importers, exporters and relevant entities:
a) Educate rights, responsibilities and obligations to enterprises engaging in import or export of goods subject to specialized inspection.
b) Provide training courses in specialized inspection for entities engaging in specialized inspection.
c) Publish and regularly update information on goods subject to specialized inspection (including lists of goods, place of inspection, inspecting authorities, date of inspection, contact address, etc.) on means of mass media or websites.
Article 2. Implementation organizations
1. The Ministry of Finance shall:
a) Take charge of and cooperate with Ministries, Departments, People’s Committees of provinces and centrally-affiliated cities (hereinafter referred to as “People’s Committee of province”) to expedite and supervise the execution of tasks assigned by the Prime Minister. Annually submit a report to the Prime Minister; summarize and evaluate the achievements and effectiveness of the plan implementation; take charge of and cooperate with relevant agencies to request the Prime Minister to consider adjusting objectives or tasks if necessary.
b) Take charge of establishing an inter-sectoral team leaded by the head of the Ministry of Finance to supervise and expedite the mission execution by Ministries, authorities and relevant agencies.
c) Reform the customs procedures for imports and exports subject to specialized inspection by simplifying administrative procedures and customs management.
d) Direct customs authorities to provide facilities, machines and human resources for Sub-Departments of Customs at checkpoints; provide the Analysis and Classification Center with advanced equipment and qualified staff to facilitate the execution of tasks including specialized inspection of a number of imports and exports that may be harmful to the community health or those under the quality control by the State according to Vietnam’s technical regulations and standards.
dd) Take charge of and cooperate with Ministries, Ministerial-level, and People’s Committees of provinces to allocate annual investments under regulations of laws on the State budget.
2. The Minister of Agriculture and Rural Development, Minister of Health, Minister of Industry and Trade and Minister of Science and Technology shall cooperate with other Ministries, Ministerial-level agencies and relevant People’s Committees of provinces to invest in facilities, machines and human resources for specialized inspection at checkpoints in Hai Phong, Ho Chi Minh, Ha Noi, Danang, Lang Son, Quang Ninh and Lao Cai.
3. According to objectives and tasks specified in this Decision and lists of legislative documents on specialized inspection required to be amended in the Annex here with, Ministries, ministerial-level agencies and People’s Committees of provinces shall prepare detailed plans for specialized inspection and carry out the inspection within their functions, tasks and competence.
4. The plan execution shall be funded from the State budget and other legal funding under regulations of laws. Ministries, ministerial-level agencies, People’s Committees of provinces shall make estimates for the Plan execution according the objectives and missions stipulated in this Decision.
It is encouraged to mobilize finance from ODA projects and programs, domestic and overseas entities participating in specialized inspection under regulations of laws.
Article 3. This Decision comes into effect from the date on which it is signed.
Article 4. Ministers, heads of ministerial-level authorities, Heads of Governmental agencies, Presidents of People’s Committees of provinces , and relevant entities shall be responsible for the implementation of this Decision./.
