DECISION

PROMULGATION OF CRITERIA FOR SAFE TRANSPORT TO FACILITATE COVID-19 CONTROL IN HO CHI MINH CITY

CHIEF OF HO CHI MINH CITY STEERING COMMITTEE FOR COVID-19 CONTROL

Pursuant to the Law on Local Government Organization dated June 19, 2015; the Law dated November 22, 2019 on Amendments to the Law on Local Government Organization;

Pursuant to the Law on Prevention and Control of Infectious Diseases dated July 21, 2007;

Pursuant to the Prime Minister’s Decision No. 447/QD-TTg dated April 01, 2020 on declaration of Covid-19 epidemic;

At the request of the Director of Department of Transport in Report No. 9992/TTr-SGTVT dated September 15, 2021 and opinions of the Director of the Department of Health in Official Dispatch No. 6559/SYT-NVY dated September 14, 2021,

DECIDES:

Article 1. Criteria for Safe Transport to facilitate Covid-19 Control in Ho Chi Minh City are promulgated together with this Decision

Article 2. This Decision comes into force from the day on which it is signed and replaces Decision No. 1368/QD-BCD dated April 23, 2020 of HCMC Steering Committee for Covid-19 Control. Ho Chi Minh City Steering Committee for Covid-19 Control will consider revising the criteria in consideration of Covid-19 prevention and control reality in the city.

Article 3. Chief of Office of the People’s Committee of Ho Chi Minh City, Director of Ho Chi Minh City Police Department, Director of Department of Health, Director of Department of Transport, heads of other Departments and authorities of the city, the President of the People’s Committees of districts and Thu Duc City, Presidents of the People’s Committees of wards, communes and commune-level towns, relevant organizations and individuals are responsible for the implementation of this Decision./.

CRITERIA FOR SAFE TRANSPORT IN HO CHI MINH CITY

(Promulgated together with Decision No. 3324/QD-BCD dated September 15, 2021 of HCMC Steering Committee for Covid-19 Control)

I. TRANSPORT OF GOODS (ROAD AND INLAND WATERWAYS)

1. Criterion 1: All the operator and attendants on the vehicle have received the first dose of Covid-19 vaccine for at least 14 days or have recovered from Covid-19 according to confirmation by a health authority (or instructions of Department of Health).

2. Criterion 2: All the operator and attendants of the vehicle have unexpired negative test results for SARS-CoV-2 according to regulations of health authorities

: Failed.

3. Criterion 3: 5k rules (Facemask – Disinfection – Safety distance – No gathering – Health declaration) are fully complied with

- Yes

: Passed.

- No

: Failed.

4. Criterion 4: Hand sanitizer which contains at least 70% alcohol is available to the operator and attendants; vehicle disinfectant and trash cans with lids are available on the vehicle

5. Criterion 5: Information and instructions for employees on anti-Covid measures on the vehicle

II. PASSENGER TRANSPORT (ROAD AND INLAND WATERWAYS TRANSPORT)

1. Criterion 1: All the operator and attendants on the vehicle have been fully vaccinated against Covid-19 for at least 14 days.

2. Criterion 2: All the operator and attendants of the vehicle have unexpired negative test results for SARS-CoV-2 according to regulations of health authorities

III. OPERATIONS AT BUS STATIONS, FERRY TERMINALS, INLAND WHARVES FOR PASSENGER TRANSPORT; CROSS-RIVER FERRY TERMINALS

4. Criterion 4: There is a Steering Committee (or Working Group) and a plan for Covid-19 prevention and control at the unit, including the plan for handling suspected and confirmed Covid-19 cases as instructed by the Ministry of Health and the People’s Committee of Ho Chi Minh City.

IV. DRIVER TRAINING AND TESTING

4. Criterion 4: Density of employees and students

4.1. Training

A classroom has not more than 50 students. The density of students in 01 classroom is at least 4 m2/student. Students are scheduled for practice alternatively so that there is only 01 instructor and 01 student on a Class B vehicle, and there are not more than 50% of the students on a vehicle of other classes.

4.2. Testing

Distancing is maintained inside and outside of the examination rooms. There are not more than 20 candidates in an examination room. During the road test, there is 01 candidate on a Class B vehicle; not more than 04 candidates on a Class C vehicle; not more than 06 candidates on a Class D vehicle. There are not more than 20 people at the waiting hall in the road test area.

5. Criterion 5: Medical supplies (facemasks, hand sanitizers, etc.) are available for employees where at frequently touched surfaces. There are surveillance cameras, thermometers, sanitizers for employees, shippers and customers before they enter the premises;

(For Class 1 and Class 2 driving test centers, there shall be surveillance cameras and thermometers from January 01, 2022).

6. Criterion 6: There is a contract with a health unit or private health workers for monitoring health of employees at the training/test center. There are temporary isolation rooms at the unit.

V. TRAFFIC WORK CONSTRUCTION (INCLUDING MAINTENANCE)

1. Criterion 1: There is a Steering Committee or Working Group for Covid-19 prevention and control at the construction site, which consists of: the investor (chief), supervision counselor, site commander, safety supervisors of contractors, health workers, etc. (members)

(Duties of the Steering Committee or Working Group are specified in Official Dispatch No. 3373/BXD-GD dated August 23, 2021 of the Ministry of Construction on safety against Covid-19 at construction sites).

2. Criterion 2: There is a construction plan that includes anti-Covid measures

 (According to instructions in Official Dispatch No. 3373/BXD-GD dated August 23, 2021 of the Ministry of Construction on safety against Covid-19 at construction sites, which focuses on: mobilization of personnel, fuel, supplies, building materials, other services serving construction and life of employees at the site; inspection and supervision of conformity with anti-Covid regulations such as: taking body temperature, health declaration, wearing facemasks, maintaining safety distance by all employees at the site, preventing unauthorized people from entering the site, requiring suppliers to comply with anti-Covid regulations).

3. Criterion 3: All employees at the construction site have received the first dose of Covid-19 vaccine for at least 14 days or have recovered from Covid-19 according to confirmation by a health authority (or instructions of Department of Health).

VI. OPERATIONS AT SEAPORTS AND INLAND PORTS

1. Comply with Decision No. 1589/QD-BGTVT dated August 27, 2021 of the Ministry of Transport, which provides interim guidance on organization of maritime transport and Covid-19 control.

2. Manage crewmembers, passengers, inbound and outbound vessels, transiting vessels entering, leaving and operating at seaports in Ho Chi Minh City according to Decision No. 2813/QD-UBND dated August, 11, 2021 and Official Dispatch No. 2702/UBND-VX dated August 13, 2021 on enhanced implementation of anti-Covid measures at seaports and maritime boundary of in Ho Chi Minh City.

3. Vaccination against Covid-19

a. From now to the end of October 31, 2021:

All employees at the construction site have received the first dose of Covid-19 vaccine for at least 14 days or have recovered from Covid-19 according to confirmation by a health authority (or instructions of Department of Health).

b. From November 01, 2021 onward:

All employees at the port have been fully vaccinated against COVID-19 for at least 14 days.

VII. OPERATIONS AT TRAIN STATIONS

1. Comply with Decision No. 1589/QD-BGTVT dated August 30, 2021 of the Ministry of Transport, which provides interim guidance on organization of railway transport and Covid-19 control, and regulations of health authorities.

2. All employees have been fully vaccinated against COVID-19 for at least 14 days

3. All employees at the station are tested periodically according to regulations of health authorities

- Yes

: Passed.

- The criterion is not fully satisfied

: Failed.

VIII. OPERATIONS AT TAN SON NHAT INTERNATIONAL AIRPORT

1. Comply with Decision No. 1654/QD-BGTVT dated September 09, 2021 of the Ministry of Transport, which provides interim guidance on organization of air transport and Covid-19 control, and regulations of health authorities.

2. All employees have been fully vaccinated against COVID-19 for at least 14 days.

- No

: Failed.

3. All employees at the airport are tested periodically according to regulations of health authorities

- Yes

: Passed.

- No

: Failed.

IX. CONDITIONS FOR SAFE OPERATION ACCORDING TO THE CRITERIA

1. Operation is permitted if all applied criteria are “Passed”.

2. Operation is not permitted if any of the applied criteria is “Failed”.

X. ORGANIZATION OF IMPLEMENTATION

1. Facilities, agencies, units individuals that are relevant to the operations specified herein shall carry out self-evaluation and implementation in accordance with these Criteria, regulations on Covid-19 prevention and control of the Prime Minister, the Ministry of Health and the Ministry of Transport; take responsibility for the results of their self-evaluation.

2. Regulatory authorities shall, within the scope of their functions and duties, pursuant to these Criteria and regulations on Covid-19 prevention and control, carry out inspections and take actions as per regulations./.
