DECISION

PROMULGATION OF CRITERIA FOR EVALUATION OF SAFETY AND PREVENTION AGAINST COVID-19 AT FOOD AND DRINK ESTABLISHMENTS, AND FOOD TRADING ESTABLISHMENTS IN HO CHI MINH CITY

THE CHIEF OF HO CHI MINH CITY STEERING COMMITTEE
FOR COVID-19 CONTROL

Pursuant to the Law on Government Organization dated June 19, 2015; the Law dated November 22, 2019 on Amendments to the Law on Government Organization and the Law on Local Government Organization;

Pursuant to the Law on Prevention and Control of Infectious Disease dated November 21, 2007;

Pursuant to the Government’s Decree No. 101/2010/ND-CP dated September 30, 2010 elaborating some Articles of the Law on Prevention and Control of Infectious Diseases regarding quarantine, mandatory quarantine and special epidemic control measures during epidemics;

Pursuant to the Prime Minister’s Decision No. 447/QD-TTg dated April 01, 2020 on declaration of Covid-19 pandemic;

Pursuant to the Decision No. 2194/QD-BCDQG dated May 27, 2020 of the National Steering Committee for Covid-19 Control on promulgation of “Guidelines for Covid-19 Prevention and Infection Risk Assessment in Workplaces and Worker Dormitories”;

Pursuant to the Official Dispatch No. 5522/BYT-MT dated July 12, 2021 of the Ministry of Health promulgating the Model Covid-19 Prevention and Control Plan of businesses and model declaration of Covid-19 prevention and control at worker dormitories;

Pursuant to the Official Dispatch No. 6666/BYT-MT dated August 16, 2021 of the Ministry of Health providing guidelines for Covid-19 prevention and control at workplaces;

At the request of the Head of the Food Safety Management Authority of Ho Chi Minh City in the Statement No. 1564/TTr-BQLATTP dated September 15, 2021 and opinions of the Director of the Department of Health in Official Dispatch No.6625/SYT-NVY dated September 15, 2021,

HEREBY DECIDES:

Article 1. The Criteria for Evaluation of Safety and Prevention against Covid-19 at Food and Drink Establishments, and Food Trading Establishments in Ho Chi Minh City are promulgated together with this Decision, including:

- Criteria for evaluation of safety and prevention against Covid-19 at food and drink establishments in Ho Chi Minh City.

- Criteria for evaluation of safety and prevention against COVID-19 at food stalls in supermarkets, food stores and convenience stores in Ho Chi Minh City.

Article 2. This Decision comes into force from the day on which it is signed and supersedes the Decision No. 1369/QD-BCD dated April 23, 2020 of Ho Chi Minh City Steering Committee for Covid-19 Control.

Ho Chi Minh City Steering Committee for Covid-19 Control will consider revising the criteria in consideration of Covid-19 situation in the city.

Article 3. Chief of Office of the People’s Committee of Ho Chi Minh City, Director of Department of Health, Director of Department of Industry and Trade, Head of the Food Safety Management Authority of Ho Chi Minh City, heads of other Departments and authorities of the city, the President of the People’s Committees of districts and Thu Duc City, Presidents of the People’s Committees of wards, communes and commune-level towns, relevant organizations and individuals are responsible for the implementation of this Decision./.

CRITERIA

FOR EVALUATION OF SAFETY AND PREVENTION AGAINST COVID-19 AT FOOD AND DRINK ESTABLISHMENTS IN HO CHI MINH CITY
(Promulgated together with Decision No. 3326/QD-BCD dated September 15, 2021 of the Chief of Ho Chi Minh City Steering Committee for Covid-19 Control)

I. EVALUATION CRITERIA

A food and drink establishment (hereinafter referred to as “establishment”) located in Ho Chi Minh City shall be allowed to operate only when it satisfies food safety conditions and relevant COVID-19 prevention and control conditions:

1. Criterion 1

The establishment has a certificate of food safety (except the establishments specified in Article 12 of the Government’s Decree No. 15/2018/ND-CP dated February 02, 2018 on elaboration of some Articles of the Law on Food Safety).

- Certificate of food safety is available:  Passed;

- Certificate of food safety is not available:  Failed.

2. Criterion 2

The establishment satisfies food safety conditions as prescribed (regarding physical materials, equipment, personnel, storage, preservation, transportation and origin of materials, relevant documents, etc.).

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

3. Criterion 3

Employees, establishment visitors (including shippers, customers and other visitors, etc.) must strictly comply with Covid-19 prevention and control guidelines given by health authorities (including vaccination, negative Covid-19 test result, etc.).

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

4. Criterion 4

The establishment has adopted measures for ensuring its employees and establishment visitors’ compliance with Covid-19 prevention and control instructions given by health authorities, including: facemask, disinfection, distance, no gathering, health declaration, taking body temperature, vaccination against Covid-19, etc.

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

5. Criterion 5

The foods delivery and receipt areas must be equipped with delivery tables and separated from other areas; ensure a distance of 2 m between 02 persons. There are adequate hand-washing solutions, soap or sanitizer, and hand dryers or disposable hand towels.

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

6. Criterion 6

There are plans and measures for Covid-19 prevention and control; the area of the eating area must be sufficient to ensure there is at least 4 m2 of space for each person and the distance between 02 persons is at least 2 m or there shall be a partition between 02 persons.

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

II. EVALUATION OF SAFETY CRITERIA

An establishment may only operate if the criteria 1 through 5 are satisfied.  Criterion 6 is applied to establishments that provide on-site catering (including agencies and enterprises providing on-site catering for their employees)./.

 

CRITERIA

FOR EVALUATION OF SAFETY AND PREVENTION AGAINST COVID-19 AT FOOD STALLS IN SUPERMARKETS, FOOD STORES AND CONVENIENCE STORES IN HO CHI MINH CITY
(Promulgated together with Decision No. 3326/QD-BCD dated September 15, 2021 of the Chief of Ho Chi Minh City Steering Committee for Covid-19 Control)

I. EVALUATION CRITERIA

Food stalls in supermarkets, food stores and convenience stores (hereinafter referred to as “establishment”) located in Ho Chi Minh City shall be allowed to operate only when they satisfy food safety conditions and relevant COVID-19 prevention and control conditions.

1. Criterion 1

The establishment has a certificate of food safety (except the establishments specified in Article 12 of the Government’s Decree No. 15/2018/ND-CP dated February 02, 2018 on elaboration of some Articles of the Law on Food Safety).

- Certificate of food safety is available:  Passed;

- Certificate of food safety is not available:  Failed.

2. Criterion 2

The establishment satisfies food safety conditions as prescribed (regarding physical materials, equipment, personnel, storage, preservation, transportation and origin of materials, relevant documents, etc.).

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

3. Criterion 3

The business area of the establishment must be sufficient to ensure there is at least 4 m2 of space for each person and the distance between 02 persons (including its employees) is at least 2 m.

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

4. Criterion 4

The establishment’s goods delivery and receipt area must be equipped with delivery tables, and sufficient to ensure a distance of 2 m between 02 persons and “5K” Message. There are adequate hand-washing solutions, soap or sanitizer, and hand dryers or disposable hand towels.

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

5. Criterion 5

Employees, establishment visitors (including shippers, customers and other visitors, etc.) must strictly comply with Covid-19 prevention and control guidelines given by health authorities (including vaccination, negative Covid-19 test result, notification of any contact with F0 or F1 individuals, etc.).

- The conditions are fully satisfied:  Passed;

- The conditions are not satisfied or not fully satisfied:  Failed.

II. EVALUATION OF SAFETY CRITERIA

Food stalls in supermarkets, food stores and convenience stores in Ho Chi Minh City may only operate if all of 05 criteria are satisfied./.
