DECISION
PROMULGATION OF LIST OF PROGRAMS AND PROJECTS ELIGIBLE FOR GOVERNMENT GUARANTEE
Pursuant to the Law on Government organization dated December 25, 2001;
Pursuant to the Law on Public debt management dated June 17, 2009;
Pursuant to the Law on Public Investment dated June 18, 2004;
Pursuant to the Law on Investment dated November 29, 2014;
Pursuant to the Government's Decree No. 15/2011/NĐ-CP dated February 16, 2011 on provision and management of Government guarantee;
At the request of the Minister of Finance,
The Prime Minister promulgates a List of programs and projects eligible for Government guarantee.
Article 1. A list of programs and projects eligible for Government guarantee according to Clause 2 Article 6 of the Government's Decree No. 15/2011/NĐ-CP is enclosed with this Decision.
Article 2. This Decision comes into force from September 30, 2015 and replaces the Prime Minister’s Decision No. 44/2011/QĐ-TTg dated August 18, 2011.
Article 3. Programs and projects for which Government guarantee is approved before the effective date of this Decision shall be carried on for 6 months from such date.
Article 4. Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the People’s Committees of central-affiliated cities and provinces are responsible for the implementation of this Decision./.

1 | Projects applying high technology; projects in the field of energy, mineral extraction or processing, manufacture of goods or provision of services for export appropriate for the orientation of socio-economic development and: a) are classified as projects of national importance whose investment policies are decided by the National Assembly in accordance with the Law on Public Investment; and b) are located in eligible areas according to the Law on Investment. |
2 | Category A programs and projects in the field of energy, mineral extraction or processing according to the Law on Public Investment: a) Investment in electricity infrastructure; investment in construction of new power plant, power distribution, power transmission; b) Investment in oil refinery. |
3 | Programs and projects in the field in which investment is encouraged by the State: a) Construction of traffic infrastructure (freeways) in which total investment is at least 10,000 billion dongs; b) Development of public transportation: investment in purchase of airplanes according to programs approved by the Prime Minister. |
4 | Special projects decided by the Government. |
