DECISION

DUTY ASSIGNMENTS FOR SENIOR OFFICIALS OF MINISTRY OF HEALTH

MINISTER OF HEALTH

Pursuant to the Law on Government Organization and the Law on amendments and supplements to the Law on Government Organization and the Law on Local Governments;

Pursuant to the Government’s Decree No. 123/2016/ND-CP dated September 1, 2016, prescribing functions, duties and powers and organizational structure of Ministries and Ministry-level bodies; the Government’s Decree No. 101/2020/ND-CP dated August 28, 2020 on amendments and supplements to several Articles of the Government’s Decree No. 123/2016/ND-CP dated September 1, 2016, prescribing functions, duties and powers and organizational structure of Ministries and Ministry-level bodies;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 1, 2016, issuing the Government’s working regulations;

Pursuant to the Government's Decree No. 75/2017/ND-CP dated June 20, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Health;

Upon the request of the Director of the Organization and Staff Department of the Minister of Health,

HEREIN DECIDES

Article 1. Duty assignment principles and work relations between senior officials of the Ministry of Health (MoH):

1. The Minister is the Government’s cabinet member, directs and administers all aspects of the Health Ministry's tasks and activities within the scope of the MoH's functions and tasks in accordance with the Constitution and the Law on Government Organization; directly directs and administers important jobs and strategic issues within the entire range of activities in the health sector.

2. The Minister assigns the Deputy Ministers to direct and handle regular daily tasks falling within the MoH’s range of activities, ensuring that the full implementation of MoH’s functions and tasks according to regulations set out in specialized Laws and Decrees of the Government defining the functions, tasks, powers and organizational structure of the MoH.

3. For issues related to various fields, the Minister can assign a Deputy Minister to bear his/her main responsibility to direct the units under his/her management to deal with them. Before deciding on the solutions to dealing with these issues, the Deputy Minister who is mainly in charge of this should consult with other relevant Deputy Ministers and report to the Minister for guidance.

4. The Deputy Ministers are assigned to directly monitor and direct the activities of the units indirectly and directly under the MoH according to the principle that, the main area of activities of a unit falls within a Deputy Minister’s remit, that Deputy Minister shall be assigned to supervise and control the entirety of that unit. When directing the units to implement other area of activities (except the main area of activities of these units) related to the area of activities of which other Deputy Ministers are in charge, all relevant Deputy Ministers should consult and cooperate with each other to reach agreement on the policies, activities and solutions before arriving at their unanimous decision. In case of disagreement among them, the Deputy Minister assigned to take charge of handling work shall report to the Minister to seek his decision.  

5. Every two weeks (except in unexpected cases), the Minister and the Deputy Ministers hold a briefing in order for the Deputy Ministers and senior officers of the units under the MoH to report on performance of their assigned duties and discuss the main duties of which the agreement on the policy for execution between MoH’s senior officials should be reached. According to job requirements, the Minister and the Deputy Ministers shall convene meetings to comment on the content of the projects to be submitted to the Government and the Prime Minister.

6. Dividing up duties between the Deputy Ministers (according to Article 4 herein) may vary according to needs of each work and the Minister’s assignment.

Article 2. Within the scope of their assigned functions, the Deputy Ministers shall be entitled to use the delegated powers of the Minister and act in the name of the Minister to actively direct and handle the work falling within the assigned area of activities and be held accountable to the Minister and before law for its decisions as follows:

1. Direct the formulation of legal normative documents, strategies, plans, planning schemes, projects, work schedules and other legal normative documents falling within the area of duties assigned by the Minister.

2. Direct, provide guidance on, expedite, examine, inspect and settle complaints and denunciations related to the implementation of guidelines, policies and law of the State, resolutions of the Government, decisions of the Prime Minister, decisions of the Minister, and promptly detect and solve issues and problems, and make recommendations for any necessary revision or modification toward issues arising under their assigned duties.

Article 3. For the units under the direct or indirect control of MoH that Deputy Ministers are assigned to directly supervise and administer, they are entitled to actively direct and handle the following tasks:

1. Direct, provide guidance on, inspect and push units under MoH’s  direct or indirect control towards the formulation of legal normative documents, schemes, programs, projects, mechanisms and policies under their assigned duties, develop strategies, schemes, long-term and annual plans of the units to perform assigned functions and tasks, and undertake the implementation of legal normative documents, plans, projects, planning schemes, plans, mechanisms and policies that have already been approved and available for use.

2. Direct, provide guidance on and inspect these units’ implementation of the provisions of law on the organization and management of cadres, civil servants and public employees; emulation and commendation or rewarding activities; maintenance of compliance with internal rules and regulations, discipline and unity; management and use of public property, funds, thrift and anti-extravagance practice; settlement of complaints and denunciations and handling of violations against law, misconducts and corruption occurring in the units under their assigned duties.

3. Obtain authorization to sign on decisions to recruit employees; appoint nominees to ranks, appoint nominees to professional titles, raise wages paid to civil servants and public employees of the units under their delegated authority; decisions to approve plans, schemes and projects of the units.

Article 4. Specific assignments:

1. Minister Nguyen Thanh Long:

a) Direct, administer and manage the entire area of activities in the health sector.

b) Act as the point of contact with the Government, the National Assembly’s Standing Committee, the Committees of the National Assembly, other ministries, central authorities and local authorities.

c) Take direct control of the following activities: formulating development strategies, planning schemes and plans, resource mobilization and allocation plans in the health sector; formulating legal normative documents on healthcare; staff organization; politics and ideology education; health inspection and prevention and control of corruption and extravagance; participating in Central Steering Committees and inter-sectoral organizations under the mandate of the Government and the Prime Minister.

d) Supervise and take command of the units under the control of MoH:

1. Department of Planning – Finance;

2. Organization and Staff Department;

3. MoH’s Inspectorate.

2. Deputy Minister Nguyen Truong Son:

a) Assist the Minister in taking direct command of activities in the following sector: preventive medicine, epidemic prevention and control, HIV/AIDS prevention and control; community nutrition; occupational hygiene, prevention and control of occupational diseases; school sanitation; environmental health and sanitation; environmental protection in medical activities; medical examination and treatment; rehabilitation; blood transfusion safety; maternal and child health; specialized and hi-tech medical development; private sector involvement, joint venture and affiliation in health activities; national defense and security work on the part of the Ministry of Health; natural disaster prevention and control, search and rescue; combined military and civil medicine; protection and health care for central officials; healthcare assignments for major meetings of the Party and the State and the task of cooperating with the Central Committee of the Vietnam Red Cross. Participate in central Steering Committees and inter-sectoral organizations according to their assigned duties.

b) Supervise and take command of the units under the control of MoH:

1. Maternal and Child Health Department; 

2. Medical Examination and Treatment Administration;

3. General Department of Preventive Medicine;

4. Health Environment Management Agency;

5. Vietnam Administration for HIV/AIDS Control;

c) Supervise and take command of the units under the direct control of MoH:

1. Bach Mai Hospital;

2. Cho Ray Hospital;

3. Hue National General Hospital;

4. Viet-Duc Friendship Hospital;

5. National Hospital of Obstetrics and Gynecology;

6. Thai Nguyen National General Hospital;

7. Can Tho National General Hospital;

8. Quang Nam National General Hospital;

9. Vietnam – Cuba Dong Hoi Friendship Hospital;

10. E Hospital;

11. National Hospital of Traditional Medicine;

12. National Hospital of Acupuncture;

13. National Lung Hospital;

14. Friendship Hospital;

15. C Hospital of Da Nang;

16. Thong Nhat Hospital;

17. 74 National Hospital;

18. 71 National Hospital;

19. National Hospital for Nursing Care and Rehabilitation;

42. National Institute of Nutrition.

43. Vietnam National Institute of Maritime Medicine;

- Perform other duties assigned by the Minister.

3. Deputy Minister Do Xuan Tuyen:

a) Assist the Minister in taking direct command of activities in the following sectors: pharmacy; vaccines; cosmetics; traditional medicine; food safety; medical equipment; bidding and procurement of drugs, supplies and medical equipment; national reserve for drugs, chemicals and medical equipment; equitization and development of enterprises; activities related to the work of the pharmacopoeias and national pharmacopoeia; population - family planning; grassroots-level health development; health information, communication and education; emulation and rewarding; activities of socio-political organizations of the Ministry of Health (the workplace Trade Union, the Ho Chi Minh Communist Youth Union, the Veterans' Association); activities of professional associations in the medicine – pharmacy field; cooperation with the Vietnam Health Trade Union; participation in directing the work of health inspection and settlement of complaints and denunciations. Participate in central Steering Committees and inter-sectoral organizations according to their assigned duties.

b) Supervise and take control of the units under the control of MoH:

1. Drug Administration of Vietnam;

2. Traditional Medicine Administration of Vietnam;

3. Vietnam Food Administration;

4. Department of Medical Equipment and Construction Projects;

5. Propaganda, Emulation and Rewarding Agency;

6. Ministry Office;

7. General Office for Population and Family Planning and the units under its indirect or direct control.

c) Supervise and take control of the units under the direct control of MoH:

1. National Institute of Drug Quality Control;

2. Institute of Drug Quality Control of Ho Chi Minh city;

3. National Institute of Medicinal Materials;

4. National Institute for Food Control;

5. National Institute for Control of Vaccine and Biologicals;

6. Institute for Medical Equipment and Construction Projects;

7. Institute for Vaccines and Biologicals;

8. Center for Research and Production of Vaccines and Biologicals;

9. National Center for Centralized Procurement of Drugs;

10. National Center for Health Communication and Education;

11. Health and Life Journal;

12. Medicine and Pharmacy Journal;

13. Vietnam Pharmaceutical Corporation;

14. Single-member Limited Liability Company for Vaccine and Biological Production No.1;

15. Da Lat Pasteur Vaccines Single-member Limited Liability Company;

16. Medical Publishing House Single-member Limited Company;

d) Perform other duties assigned by the Minister.

4. Deputy Minister Tran Van Thuan

a) Assist the Minister in taking direct command of activities in the following sectors: Scientific research, technological development activities in the health sector; acquisition and transfer of vaccine production technology; training and mentoring for health human resources; health insurance; medical assessment; forensic examination, forensic psychiatric assessment; prevention and control of non-communicable diseases; medical legal work; international cooperation in health; administrative reform in health; application of information technology in health activities and healthcare statistics; youth-related work in the health sector. Participate in central Steering Committees and inter-sectoral organizations according to their assigned duties.

b) Supervise and take control of the units under the control of MoH:

1. Agency of Science, Technology and Training;

2. Information Technology Department;

3. Health Insurance Department;

4. International Cooperation Department;

5. Department of Legal Affairs;

c) Supervise and take control of the units under the direct control of MoH:

1. Health Policy and Strategy Institute;

2. Ho Chi Minh City University of Medicine and Pharmacy;

3. Hanoi University of Medicine and Pharmacy;

4. Thai Binh University of Medicine and Pharmacy;

5. Hai Phong University of Medicine and Pharmacy;

6. University of Public Health;

7. Can Tho University of Medicine and Pharmacy;

8. Nam Dinh University of Nursing;

9. Vietnam Traditional Medicine and Pharmacy Academy;

10. Hai Duong University of Medical Technology;

11. Da Nang University of Medicine and Pharmacy Technology;

12. Hanoi University of Pharmacy;

13. Hai Duong Central College of Pharmacy;

14. College of Medical Equipment Engineering;

15. Hospitals of Universities of Medicine and Pharmacy (07 hospitals).

16. K Hospital;

17. National Hospital of Endocrinology;

20. Central Institute of Forensic Psychiatry;

21. Bien Hoa National Institute of Forensic Psychiatry;

22. National Institute of Forensic Medicine;

24. Center for Forensic Psychiatry in the Central Coast;

25. Center for Forensic Psychiatry in Ho Chi Minh city;

26. Center for Forensic Psychiatry in the Central Highlands;

27. Center for Forensic Psychiatry in the Southwest;

d) Perform other duties assigned by the Minister.

Article 5. This Decision shall enter into force as from the signature date.

The Decision No. 1727/QD-BYT dated March 27, 2021 of the Minister of Health on duty assignments for the Minister and Deputy Ministers of Health and other previous regulations in contrast with this Decision shall be abolished.

Article 6. Senior Officials of MoH; Senior Officials of Departments, Administrations and General Departments, Office of MoH; Heads of non-business units under MoH’s direct control, Directors of Departments of Health of provinces and centrally-affiliated cities, shall be responsible for implementing this Decision./.
