DECISION

THE PRIME MINISTER ON THE MANAGEMENT OF THE NATIONAL TARGET PROGRAMS

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992,
Pursuant to the Resolution No.85/CP-m of July 11, 1997 and Resolution No.112/1997/NQ-CP of November 21, 1997 of the Government,
At the proposal of the Minister of Planning and Investment,

DECIDES:

Article 1

1. The program for hunger eradication and poverty alleviation (including the sedentarization and support for people of ethnic minorities meeting with special difficulties) which is managed by the Ministry of Labor, War Invalids and Social Affairs, and:

- The Ministry of Agriculture and Rural Development shall act as a member of the program management board, in charge of sedentarization;

- The Commission for Ethnicities and Mountainous Areas shall act as a member of the program management board, in charge of providing support for people of ethnic minorities meeting with special difficulties.

2. The program for population and family planning which is managed by the National Committee for Population and Family Planning.

3. The program for elimination of certain serious social diseases and epidemics, which is managed by

4. The program for HIV/AIDS prevention and combat which is managed by the National Committee for HIV/AIDS prevention and combat.

5. The program for clean water and environmental hygiene in rural areas which is managed by the Ministry of Agriculture and Rural Development.

6. The program for building contingents of talented athletes of the country and key sports centers, which is managed by the Commission for Physical Training and Sports.

7. The employment program which is managed by the Ministry of Labor, War Invalids and Social Affairs.

Article 2

1. The elaboration, evaluation and approval of the national target programs as well as the mechanism for planning and allocation of funds for the national target programs shall comply with Decision No.531-TTg of August 8, 1996 of the Prime Minister and Inter-ministerial Circular No.06-TT/LB/KH-TC of April 29, 1997 of the Ministry of Planning and Investment and the Ministry of Finance guiding the implementation of this Decision.

2. The division of responsibilities among the central and local levels for the management of the national target programs.

- The objectives and tasks of the national target programs; in which the to-be-assigned annual plan targets shall be set by the Ministry of Planning and Investment after consulting the agencies managing the national target programs.

- Formulating and incorporating the common projects of the national target projects.

- The total fund for the national target programs, including the ital construction fund and the non-business fund (including managerial expenses)...

- Uniformly running the activities related to the national target programs.

b/ The presidents of the People's Committees of the provinces and cities directly under the Central Government shall have to uniformly manage resources, exercise the executive right in organizing the performance of tasks of the national target programs in their respective localities, including the following tasks:

- Under the guidances of the agencies managing the national target programs, the Ministry of Planning and Investment and the Ministry of Finance, the provincial/municipal Services of Planning and Investment shall act as coordinators and coordinate with other provincial/municipal functional services in working out plans for the fulfillment of objectives and tasks and proposing resources to be supplied for the national target programs being implemented in their respective localities, then submit them to the program managing agencies, the Ministry of Planning and Investment and the Ministry of Finance for their incorporation into the general plan of the national target programs.

- To assume the prime responsibility and coordinate with the agencies managing the national target programs in organizing the approval of projects of the national target programs to be implemented in their localities.

- To assign the plan targets related to the tasks and funds of the national target programs under their local management to the project managers for performance (the agencies managing national target programs shall not assign plan targets to the branch local agencies, but only provide guidance for the fulfillment of targets, tasks and the use of resources for the programs assigned by the Government).

- In the course of implementation of national target programs, on the basis of the total funding and the funding already allocated to each program, they shall be entitled to propose the program-managing agencies to readjust funding for activities within each program on the principle of keeping intact the total funding and targets of the programs. Past 20 days (from the date of making proposal), the failure to reply by the program-managing agencies shall be considered their consent (except for proposal to increase managerial expenses).

- To incorporate related activities and coordinate resources of the national target programs with the targets and tasks of the programs under their local management right from the planning process so as to avoid overlapping, reduce the number of coordinators for implementating units and concentrate resources on priority objects and key areas.

- In addition to the source of fund allocated by the Central Government, they shall be entitled to mobilize the local resources in accordance with law to support the implementation of programs and to conduct the liquidity and final account settlement in accordance with current financial regulations.

- To organize the inspection and supervision of activities related to the national target programs in their localities. To be entitled to temporarily suspend such activities if any error or inefficiency is found, and simultaneously report to the program-managing agencies, the Ministry of Planning and Investment and the Ministry of Finance for solution.

- To report to the agencies managing national target programs, the Ministry of Planning and Investment and the Ministry of Finance on the situation and results of the implementation of national target programs under their respective local management according to the content, form and time limit uniformly prescribed in Inter-ministerial Circular No.06-TT/LB/KH-TC of April 29, 1997 of the Ministry of Planning and Investment and the Ministry of Finance.

- Depending on the actual scale and number of projects of each locality, possibly to issue decision to set up a district/urban district steering committee for national target program(s) to assist the president of the district/urban district People's Committee in working out plans, managing and organizing the implementation of national target program(s) in such district/urban district.

Article 3- This Decision takes effect 15 days after its signing.

The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the People's Committees of the provinces and cities directly under the Central Government shall have to implement this Decision.
