DECISION

ON APPORVAL OF THE NATIONAL PROGRAM FOR OCCUPATIONAL SAFETY AND HEALTH FROM 2016 TO 2020

PRIME MINISTER

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to the Labor Code dated June 18, 2012;

At the request of the Minister of Labor - Invalids and Social affairs,

HEREBY DECIDES:

Article 1. National program for occupational safety and health from 2016 to 2020 (referred to as the Program) is approved. The primary content of the Program includes:

I. OBJECTIVES

1. General objectives

Improve working conditions, reduce pollution in the working environment; prevent occupational accidents and occupational diseases, tend to workers’ health; heighten awareness and adherence to the law on work protection and safeguarding of workers’ life, government’s properties and organizations’ assets towards the sustainable growth of the country.

2. Specific objectives towards 2020

a) Reduce the frequency of fatal occupational accidents by 5% averagely on annual basis;

b) Examine over 50% of workers susceptible to common occupational diseases at work and detect such occupational diseases; monitor the working environment in over 70% of major enterprises and 30% of small and medium enterprises at high risk of occupational diseases; <0}

c) Increase the number of small and medium enterprises applying successful certain fundamentals of the system for management of occupational safety and health and initiating an occupational safety culture by 2000 on annual basis;

d) Provide further training in occupational safety and health to over 90% of managerial individuals who administer and steer activities regarding occupational safety and health in districts and in management boards, economic zones, industrial parks, export processing zones and hi-tech parks;

dd) Provide training in occupational safety and health to over 80% of workers performing tasks bound by strict requirements for occupational safety and health, to 80% of individuals in charge occupational safety and health and health and to 90% of health and safety guides in enterprises;

e) Provide refresher training in first aid and emergency care to over 80% of individuals in charge of workplace first aid and emergency care;

g) Provide proper information on occupational safety and health to over 80% of craft villages and 70% of cooperatives at high risk of occupational accidents and diseases;

h) Provide treatment and vocational rehabilitation to 100% of workers, whose occupational accidents or diseases have been verified, as per the law;

i) Report, investigate and settle 100% of fatal occupational accidents as per the law.

II. TIME AND SCALE

1. Time: From 2016 to 2020.

2. Scale: On nation-wide scale.

III. PRIMARY CONTENT

1. Activities that augment the capacity and efficacy of state management of occupational safety and health:

a) Review and revise legislative documents, technical standards and regulations on occupational safety and health;

b) Continue studies on adopting the standards of International Labor Organization (ILO) on occupational safety and health.

c) Enhance the capacity and efficacy of the activities of product quality inspection and system for inspection and supervision of occupational safety and health.

d) Investigate, summarize, compile and evaluate occupational accidents, occupational diseases and technical issues in serious violation of occupational safety and health; complete the national database on occupational safety and health;

dd) Deploy systems for management of occupational safety and health in enterprises, workshops and craft villages at high risk of occupational accidents and diseases.

2. Activities that augment the capacity of occupational health care at the workplace:

a) Adopt measures to prevent common occupational diseases in organizations, enterprises and workshops at high risk of occupational diseases;

b) Provide training to improve the abilities of diagnosis, assessment, treatment and rehabilitation for victims of occupational accidents and diseases; monitor the working environment and evaluate hazardous factors;

c) Provide training and guidance to health care workers in enterprises and workshops; provide training to givers of first aid and emergency care at the workplace;

d) Other activities that prevent, reduce and remedy occupational diseases, particular TNT poisoning in the sector of national defense.

3. Propaganda, training and counseling on occupational safety and health:

a) Enhance the capacity of training and counseling centers for occupational safety and health;

b) Complement programs and written materials for training and communication; provide further professional training and support the expansion of the network of trainers and communicators for occupational safety and health;

c) Provide training and conduct propagandas on occupational safety and health; provide counsels and technical supports to improve the working conditions for employers and employees targeted by the Program;

d) Increase the efficiency of public movements in occupational safety and health during industrialization and modernization.

IV. SOLUTIONS

1. Policies and regulations

a) Support employers and employees to carry out occupational safety and health measures in active manner, improve the working conditions and deploy an advanced system for management of occupational safety and health, and establish a culture of occupational safety;

b) Encourage domestic and foreign entities and countries to provide resources and experience, and participate in the augmentation of working conditions and provision of health care to employees;

c) Provide information and training in occupational safety and health to non-contract workers;

d) Research and propose flexible policies on social insurance against occupational accidents and diseases;

dd) Expedite the involvement of private entities in occupational safety and health services, particularly the verification of occupational safety techniques, provision of training in occupational safety and health and monitoring of the working environment;

e) Strengthen the cooperation between government authorities tasked and enterprises and entities engaging in the Program;

g) Incorporate activities of the National program for occupational safety and health into other target programs and national target programs;

h) Synchronize systems for supervising and assessing the performance of the Program.

2. Propaganda

a) Intensify propagandas for employers, employees and relevant entities to take part in and uphold the activities of the Program;

b) Innovate contents and diversify methods of propaganda to heighten the awareness and sense of responsibility of employers, employees and the public in occupational safety and health.

3. International cooperation

a) Strengthen international cooperation to mobilize regional and international resources for activities regarding occupational safety and health;

b) Extend the exchange of information and experience in occupational safety and health with the world, particularly with ASEAN countries;

c) Adopt standards, which Vietnam has endorsed and engaged in, of the International Labor Organization with regard to occupational safety and health.

4. Science and technology

Expedite the activities of research and application of science and technology in occupational safety and health to prevent hazardous elements in sectors and fields at high risk of occupational accidents and diseases (e.g. mineral extraction and processing, metallurgy, chemicals, construction, etc.)

V. EXPENDITURE FOR THE PROGRAM

1. The state budget (i.e. finances for investment, development and administration) shall be allocated in the annual budget estimates of ministries, central and local authorities and the Target Program for Vocational Education - Employment and Occupational Safety in 2016 to 2020 according to the current echelon of state budget.

2. Financial contributions from enterprises and entities involved.

3. Sponsorship by domestic and foreign organizations.

4. Other legitimate financial sources.

VI. IMPLEMENTATION

1. Ministry of Labor - Invalids and Social affairs shall be responsible for:

a) Leading and cooperating with relevant bodies to implement the Program;

b) Guiding, inspecting and summarizing the process of implementation and reporting to the Prime Minister;

c) Coordinating, expediting, inspecting and guiding ministries’, bodies’ and local authorities' implementation of the Program;

d) Leading the establishment of the “Target Program for Vocational Education - Employment and Occupational Safety in 2016 to 2020” and reporting to the Prime Minister for approval.

2. Ministry of Health shall be responsible for planning, guiding and conducting activities that prevent occupational diseases and provide workplace health care to workers.

3. Ministry of Finance shall be responsible for:

a) Allocating the finances for implementing the Program according to annual budget estimates of central and local authorities as per the law on state budget; inspect the management and spending of finances for the Program;

b) Cooperating the Ministry of Labor - Invalids and Social affairs to guide, inspect and supervise the implementation of the Program.

4. Ministry of Planning and Investment shall be responsible for:

a) Summarizing and arranging the investment and development funds for implementing the Program as per the law on public investment;

b) Cooperating with relevant ministries and bodies to mobilize official development assistances (ODA) for the implementation of the Program.

5. Ministry of National Defense shall be responsible for conducting activities that improve working conditions and reduce occupational accidents and diseases in the sector of national defense.

6. Ministries and ministerial-level agencies, according to their missions and authority, shall be responsible for:

a) Planning and formulating budget estimates in active manner and carrying out the Program according to their functions and missions;

b) Cooperating with relevant ministries and bodies and local authorities to perform the activities of the Program;

c) Inspecting and evaluating the implementation of the Program and reporting to the Ministry of Labor - Invalids and Social affairs on annual and ad-hoc basis.

7. Request Vietnam General Confederation of Labor to take part and cooperate with relevant ministries and bodies in implementing activities that augment the efficiency of public movements regarding work protection, application of science and technology in occupational safety and health in order to improve working conditions in sectors and fields at high risk of occupational accidents and diseases.

8. Request Vietnam Chamber of Commerce and Industry and Vietnam Cooperative Alliance to take part and cooperate with relevant ministries and bodies in propaganda, training and counseling to height the awareness of enterprises, cooperatives and other subsidiaries.

9. Request Vietnam Farmer’s Union to take part and cooperate with the Ministry of Labor - Invalids and Social affairs, Ministry of Agriculture and Rural Development and relevant ministries and bodies in propaganda and training in occupational safety and health for farmers through action-based education; conduct activities that augment the efficiency of farmers' movements for production and trading in line with occupational safety and health; enhance the knowledge of the Union's personnel in occupational safety and health.

10. Request Vietnam Occupational Safety and Health Association and Vietnam Association of Small and Medium Enterprises to take part in and jointly implement the Program.

11. Provincial People’s Committees shall be responsible for:

a) Formulating and implementing their local programs for occupational safety and health in 2016 to 2020 in accordance with the objectives and content of the Program and local conditions;

b) Cooperating with relevant ministries and bodies and local authorities to perform the activities of the Program;

c) Reporting the implementation of the Program to the Ministry of Labor - Invalids and Social affairs on annual and ad-hoc basis.

Article 2. This Decision comes into force from the date that it is signed.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees shall be responsible for implementing this Decision./.
