DECISION

APPROVING ADJUSTMENTS AND SUPPLEMENTS TO THE MASTER PLAN ON EXPLORATION, EXPLOITATION AND USE OF MINERALS FOR CEMENT PRODUCTION IN VIETNAM THROUGH 2020

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the March 20, 1996 Law on Minerals, and June 14, 2005 Law No. 46/2005/ QH11 Amending and Supplementing a Number of Articles of the Law on Minerals;
Pursuant to the Government's Decree No. 160/2005/ND-CP of December 27, 2005, detailing and guiding the implementation of the Law on Minerals and the Law Amending and Supplementing a Number of Articles of the Law on Minerals;
Pursuant to the Government's Decree No. 07/ 2009/ND-CP of January 22, 2009, amending and supplementing a number of articles of the Government's Decree No. 160/2005/ND-CP of December 27, 2005, detailing and guiding the implementation of the Law on Minerals and the Law Amending and Supplementing a Number of Articles of the Law on Minerals;
Pursuant to the Prime Minister's Decision No. 105/2008/QD-TTg of July 21, 2008, approving the master plan on exploration, exploitation and use of minerals for cement production in Vietnam through 2020;
At the proposal of the Minister of Construction,

DECIDES:

Article 1. To approve adjustments and supplements to the master plan on exploration, exploitation and use of minerals for cement production in Vietnam through 2020 with the following principal contents:

1. Adjustments and supplements to the master plan on exploration, exploitation and use of minerals for cement production in Vietnam through 2020, provided in Appendix I to this Decision.

2. The master plan on exploration and exploitation of reserve mineral mines to meet production expansion needs of cement plants and for future cement investment projects, provided in Appendix II to this Decision.

3. The master plan on exploration and exploitation of mineral reserves for use as raw materials for shaft-kiln cement plants until they terminate operation, provided in Appendix III to this Decision.

4. Adjustments to the master plan on mines of minerals reserved for cement industry, provided in Appendix IV to this Decision.

For mines of minerals for use for cement production specified in the appendices to the Prime Minister's Decision No. 105/2008/QD-TTg of July 21, 2008, which are not adjusted under this Decision. Decision No. 105/2008/QD-TTg is still effective.

Article 2. Organization of implementation

Ministries, sectors and localities shall continue performing the responsibilities specified in the Prime Minister's Decision No. 105/2008/ QD-TTg of July 21, 2008, approving the master plan on exploration, exploitation and use of minerals for cement production in Vietnam through 2020. while performing the following additional responsibilities:

1. The Ministry of Construction:

a/ To assume the prime responsibility for. and coordinate with the Ministry of Natural Resources and Environment and provincial-level People's Committees in, inspecting the implementation of the master plan on exploration, exploitation, processing and use of minerals as raw materials for cement production:

b/ To propose the Ministry of Natural Resources and Environment to stop granting licenses for exploration and exploitation of minerals for use as raw materials for cement production to entities that fail to strictly comply with the master plan;

c/ To report to the Prime Minister for consideration and decision on adjustments or additions to the exploration and exploitation master plan of material mines already planned as reserve ones while considering addition to the master plan of new cement projects or production expansion of operating cement plants;

d/ To report to the Prime Minister for consideration and decision on exclusion from the exploration and exploitation master plan and the reserve mine master plan of mines of minerals which fail to meet the quality standards for use as raw materials for cement production.

2. The Ministry of Natural Resources and Environment:

To enhance inspection and supervision of the observance of exploration and exploitation licenses by license holders in order to raise the use efficiency of mineral resources used as raw materials for cement production; and request license holders to seriously conduct environmental restoration and protection.

3. Provincial-level People's Committees:

a/ To manage and supervise the implementation of the master plan on exploration and exploitation of minerals for use as cement raw materials, preventing overlap with other master plans implemented in their localities:

b/ To notify the master plan-managing agency of area or boundary adjustments to the approved master plan on exploration, exploitation and use of minerals as cement raw materials;

c/ Not to grant licenses for using exploited minerals us common construction materials for mines included in the master plan and mines of minerals up to quality standards for use as raw materials for cement production;

d/ To periodically review and report to the Ministry of Construction on licenses for exploiting minerals for use as construction materials they have granted. To take measures to manage and protect planned mines and to enhance inspection and supervision of the implementation of granted licenses and the exploitation of minerals for use as common construction materials in order to detect and promptly handle violations, preventing illegal mining in their localities.

4. Organizations and individuals that explore, exploit and use minerals as raw materials for cement production:

a/ To comply with law.

b/ To periodically report to their managing agencies on the exploration, exploitation and use of minerals as raw materials for cement production and on natural restoration and protection.

Article 3. This Decision takes effect on the date of its signing.

Ministers, heads of ministerial-level agencies and government-attached agencies, and chairpersons of provincial-level People's Committees shall implement this Decision.-
