DECISION

ON BANNING FROM EXPORT, IMPORT, PURCHASE AND SALE OF THE SPECIMENS OF SOME OF WILD FAUNA SPECIES IN APPENDICES TO THE CONVENTION ON INTERNATIONAL TRADE IN ENDANGERED SPECIES OF WILD FAUNA AND FLORA

Pursuant to the Law on Government organization, of December 25, 2001;

Pursuant to the Law on forest protection and development, of December 03, 2004;

Pursuant to the convention on international trade in endangered species of wild fauna and flora;

Pursuant to the Government’s Decree No. 82/2006/ND-CP of August 10, 2006, stipulating on management of export, import, re-export, introduction from the sea, transit, breeding, rearing and artificial propagation of precious, rare and endangered species of wild fauna and flora;  

At the proposal of the Minister of Agriculture and Rural Development;

The Prime Minister promulgates Decision on banning from export, import, purchase and sale of the specimens of some of wild fauna species in appendices to the convention on international trade in endangered species of wild fauna and flora,

Article 1. To ban from export, import, purchase and sale of the specimens of wild fauna species in appendices to the convention on international trade in endangered species of wild fauna and flora (CITES) at the below, excluding cases specified in Article 2 of this Decision:

1. The specimens of white rhinoceros (Ceratotherium simum) and the products made from white rhinoceros.

2. The specimens of balck rhinoceros (Diceros bicornis) and the products made from black rhinoceros.

3. The specimens of African elephant (Loxodonta africana) and the products made from African elephant.

Article 2. The specimens specified in Article 1 of this Decision are permitted to export in the following cases:

1. The specimens in service of diplomatic activities, scientific research, facilities of biodiversity preservation, displays of zoos; exhibitions for non-commercial purposes, circus performances for non-commercial purposes; law execution; exchange of specimens between CITES Management Authorities of member countries.

2. The specimens for non-commercial purposes eligible to import under cooperation agreement between CITES Management Authority of Vietnam and CITES Management Authority of export country.

3. The specimens have been granted for Import CITES permit before this Decision takes effect.

Article 3. Handling of violations

Organizations, individuals violating provisions in this Decision, depend on nature and extent, shall be handle criminally or administratively according to current regulations of law on management, protection, trade, transport, export, import of wild fauna and flora. 

Article 4. Implementation provision

1. This Decision takes effect on March 15, 2013.

2. Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Presidents of People’s Committees of central-affiliated cities and provinces shall implement this Decision.
