DECISION
FUNCTIONS, TASKS, ENTITLEMENTS AND ORGANIZATIONAL STRUCTURE OF STATE RECORD MANAGEMENT AND ARCHIVES DEPARTMENT OF VIETNAM
THE MINISTER OF INTERNAL AFFAIRS
Pursuant to the Government's Decree No. 36/2012/NĐ-CP dated April 18, 2012 defining the functions, tasks, entitlements and organizational structure of Ministries and ministerial agencies;
Pursuant to the Government's Decree No. 58/2014/NĐ-CP dated June 16, 2014 defining the functions, tasks, entitlements and organizational structure of the Ministry of Home Affairs;
Pursuant to Official Dispatch No. 5523/VPCP-NC dated July 08, 2013 of Office of the Government notifying the Prime Minister’s permission for State Record Management and Archives Department of Vietnam to keep using the seal bearing the national emblem;
At the request of Director of State Record Management and Archives Department of Vietnam and Director of Organization and Personnel Department,
DECIDES:
Article 1. Position and functions
1. State Record Management and Archives Department of Vietnam is an agency affiliated to the Ministry of Home Affairs. Its functions include providing advice and assist the Ministry of Home Affairs in management of state records and archives nationwide; management of national archives and provision of record and archive services as prescribed by law.
2. State Record Management and Archives Department of Vietnam has a legal status, a seal bearing the national emblem, a separate account as prescribed by law, and headquarters in Hanoi.
Article 2. Duties and entitlements
State Record Management and Archives Department of Vietnam shall perform the following duties and entitlements:
1. Submit legislative documents, strategies, national target program; national projects; long-term planning and plans; standards, processes, regulations, economic – technical norms in terms of record and archive management to the Ministry of Home Affairs and competent authorities for their promulgation.
2. Assist the Minister of Internal Affairs in issuing instructional documents on record and archive management, inspecting observance of regulations of law on record and archive management.
3. Disseminate law, organize implementation of legislative documents, policies, strategies, planning, plans, programs, projects on record and archive management after they are promulgated or approved by competent authorities.
4. Build up archives; revise, determine values of documents, protect, keep statistics on, preserve, and obtain insurance for archived documents; organize decoding, publishing, introduction, exhibition serving the utilization of archived documents; compile a list of restricted documents at National Archives as authorized by the Minister of Internal Affairs.
5. Assist the Minister of Internal Affairs in archiving digital information in state agencies.
6. Assist the Minister of Internal Affairs in unifying statistical management of record and archive management nationwide.
7. Organize works related to scientific research, application and transfer of technologies for record and archive management; modernization of facilities and record and archive management techniques.
8. Develop and submit record and archive management training programs to competent authority for adoption. Provide training in record and archive management and inspect the provision of training in record and archive management.
9. Assist the Minister of Internal Affairs in providing guidance, inspecting the issuance and management of archiving practice certificates; keep statistics and summarize the issuance of archiving practice certificates nationwide. Manage and issue blank archiving practice certificates.
10. Develop and organize the implementation of administrative reform programs according to the content of the state administrative reform program approved by a competent authority.
11. Organize the personnel and payroll; decide the designation, redesignation, reassignment, resignation, dismissal, secondment, commendation, disciplinary actions, retirement, training, allowances,
12. Take responsibility for financial management, management of property and investment in infrastructural development as authorized by the Minister of Internal Affairs and regulations of law.
13. Seek international cooperation in record and archive management as authorized by the Minister of Internal Affairs and regulations of law.
14. Provide public services related to record and archive management as prescribed by law.
15. Perform other duties given by the Minister of Internal Affairs.
Article 3. Organizational structure
1. Departments:
a) Central Record and Archive Management Department.
b) Local Record and Archive Management Department.
c) Planning – Finance Department.
d) International Cooperation Department.
dd) Personnel Department.
e) Office.
2. Affiliated organizations:
a) National Archive I (Trung tâm Lưu trữ quốc gia I)
b) National Archive II (Trung tâm Lưu trữ quốc gia II)
c) National Archive III (Trung tâm Lưu trữ quốc gia III)
d) National Archive IV (Trung tâm Lưu trữ quốc gia IV)
dd) Record and Archive Management Technolocy Center (Trung tâm Khoa học và Công nghệ Văn thư - Lưu trữ)
e) Center for Preservation and Restoration of Archives (Trung tâm Tu bổ - Phục chế tài liệu lưu trữ).
g) National Archive Insurance Center (Trung tâm Bảo hiểm tài liệu lưu trữ quốc gia).
h) Vietnam Record and Archive Management Magazine (Tạp chí Văn thư - Lưu trữ Việt Nam).
i) Information Technology Center.
k) Central College of Archives and Records Management (with a Campus in Da Lat city, Lam Dong province).
3. The establishment, merger, dissolution of organizations affiliated to State Record Management and Archives Department of Vietnam are decided by the Minister of Internal Affairs.
Article 4. Executive officers
1. State Record Management and Archives Department of Vietnam has a Director and up to 03 Deputy Directors.
2. The Director is designated and dismissed by the Minister of Internal Affairs, responsible to the Minister of Internal Affairs for the entire operation of State Record Management and Archives Department of Vietnam.
The Director of State Record Management and Archives Department of Vietnam shall specify functions, tasks, and entitlements of its departments; designate and dismiss the chiefs and deputies of such departments as authorized by the Minister of Internal Affairs and regulations of law.
3. Deputy Directors are designated and dismissed by the Minister of Internal Affairs at the request of the Director, responsible to the Director for their given tasks.
Article 5. Effect
This Decision comes into force from the day on which it is signed.
Article 6. Responsibility for implementation
The Chief of the Ministry Office, Director of State Record Management and Archives Department of Vietnam, Director of Organization and Personnel Department, heads of units affiliated to the Ministry of Home Affairs, relevant organizations and individuals are responsible for the implementation of this Decision./.
