DECISION
DEFINING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF VIETNAM NATIONAL MEKONG COMMITTEE
THE PRIME MINISTER
Pursuant to the December 25,
2001 Law on Organization of the Government;
Pursuant to the Agreement on the Cooperation for the Sustainable Development of
the Mekong ,River Basin, concluded on April 5, 1995, by the governments of
Cambodia, Laos, Thailand and Vietnam;
Pursuant to the Government's Decree No. 25/ 2008/Nt) CP of March 4, 2008,
defining the functions, tasks, powers and organizational structure of the
Ministry of Natural Resources and Environment;
At the proposal of the Minister of Natural Resources and Environment,
DECIDES:
Article 1. Position and functions
1. Vietnam National Mekong Committee is an inter-branch coordination organization which assists the Prime Minister in directing and managing activities of cooperation with the Mekong River Commission to develop, use and protect water and related resources in the entire Mekong River basin in general and the Mekong River delta and the Central Highlands region within the Mekong River basin in particular.
2. Vietnam National Mekong Committee has a national-emblem seal and its own account.
3. Vietnam National Mekong Committee has its head office at 23 Hang Tre, Hanoi and a representative office in Ho Chi Minh City.
Article 2. Tasks and powers
Vietnam National Mekong Committee has the following tasks and powers:
1. To submit to the Prime Minister its operation strategies; the Prime Minister's draft decisions and directives on activities of cooperation with the Mekong River Commission; programs and projects on sustainable development, use, management and protection of water and related resources within the Mekong River basin.
2. To act as the focal point in cooperating with member nations to concretize and organize the implementation of the Agreement on the Cooperation for the Sustainable Development of the Mekong River Basin.
3. To coordinate in supervising and monitoring the use, protection and sustainable development of water and related resources of the Mekong River basin: to protect Vietnam's interests through the master plan and cooperation projects in the entire Mekong basin, especially projects on main river currents: to disseminate information on sustainable development, use, management and protection of water and related resources of the Mekong River basin.
4. To act as the focal point in cooperating with nations in the basin, countries, non-governmental organizations and international organizations and coordinating with concerned ministries, branches and provincial-level People's Committees in proposing international cooperation projects within the Mekong River basin for the protection and sustainable development of the Mekong River delta and the Central Highlands region.
5. To coordinate with concerned agencies of member countries and the Mekong River Commission Secretariat in issuing regulations on management and implementation of international Mekong projects; to attend meetings of the Mekong River Commission and report their conclusions to the Prime Minister.
6. When assigned by the Government, to study and propose solutions to lessening the impacts of socio-economic development activities of upstream nations on Vietnam's regions where the Mekong River runs through: and the cross-border impacts of Vietnam's socioeconomic development activities in the Mekong River basin.
7. To assist localities in the Mekong River basin in the integrated management of water resources through participating in the establishment and consolidation of river basin management organizations in these localities.
8. To coordinate with the Ministry of Planning and Investment, the Ministry of Finance and concerned agencies in allocating domestic capital under Vietnam Mekong projects and projects in the entire basin in which Vietnam participates: to take part in appraising relevant plannings and projects within the Mekong River basin of branches and provinces in the Mekong River delta and the Central Highlands region.
9. To request branches and localities to notify the outcomes of the Greater Mekong Sub-region's meetings concerning the Committee's tasks: to participate in performing the Sub-region's tasks as assigned by the Prime Minister.
10. To perform other assigned tasks.
Article 3. Membership of Vietnam National Mekong Committee
Vietnam National Mekong Committee consists of:
1. The Chairman: the Minister of Natural Resources and Environment.
2. Vice chairmen:
a/ A Deputy Minister of Natural Resources and Environment as the Standing Vice Chairman;
b/ A Deputy Minister of Foreign Affairs; c/ A Deputy Minister of Planning and Investment:
d/ A Deputy Minister of Agriculture and Rural Development.
3. Members: competent representatives of the Ministries of Industry and Trade; Transport; and Science and Technology, People's Committees of the provinces and centrally run cities in the Mekong River basin, and the Chief of the Standing Office of Vietnam National Mekong Committee.
The Chairman and Vice Chairmen of Vietnam National Mekong Committee shall be decided by the Prime Minister.
Members of Vietnam National Mekong Committee shall be decided by its Chairman on the basis of nomination by the ministries and chairpersons of People's Committees of the provinces and cities mentioned above.
The Chairman of Vietnam National Mekong Committee shall promulgate its working regulations.
Article 4. Standing Office of Vietnam National Mekong Committee
1. The Standing Office of Vietnam National Mekong Committee is the Committee's assisting organization and based at the Ministry of Natural Resources and Environment.
2. The Standing Office of Vietnam National Mekong Committee has the legal entity status, seal and account under law; has a separate payroll and funds allocated from the state budget. It shall work under regulations like a departmental-level agency of a ministry and perform the tasks assigned b\ the Minister of Natural Resources and Environment (the Chairman of Vietnam National Mekong Committee) in water resources and related domains.
3. Leadership of the Standing Office of Vietnam National Mekong Committee consists of the Chief and no more than 3 Deputy Chiefs.
4. The Chairman of Vietnam National Mekong Committee shall define the functions, tasks, powers and organizational structure of the Committee's Standing Office and decide to appoint or relieve from duty the Chief and Deputy Chiefs of the Office.
Article 5. Effect and implementation responsibility
1. This Decision takes effect on the date of its signing and replaces the Prime Minister's Decision No. 860/TTg of December 30, 1995, defining the functions, tasks, powers and organizational structure of Vietnam National Mekong Committee. To annul previous regulations which are contrary to this Decision.
2. The Minister-Chairman of Vietnam National Mekong Committee, ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People's Committees shall implement this Decision.-
