DECISION
REGARDING POLICY SUPPORTING FISHERS TO OVERCOME THE AT-SEA RISKS CAUSED BY NATURAL DISASTER
THE PRIME MINISTER
Pursuant to Law on Organization of the Government dated December 25th 2001;
Pursuant to Fisheries Law dated November 26th 2003
Determining request of Minister of Fisheries,
HAS DECIDED:
Article 1. Subjects and cope of application
This Decision shall make regulation relating to the policies to support the individuals and organizations engaged in fisheries exploitation, aquaculture and fisheries logistic services which are conducted at sea or in coastal areas to overcome the risks caused by natural disaster such as whirlwind, tropical low air pressure, tsunami that come at sea, coastal areas or archipelagoes (hereinafter referred to as "at sea"); shall support individuals and organizations not subject to State forces who take part in rescue of human and assets that are facing with risks at sea due to natural disaster.
Article 2. Support to human's losses
In addition to support policies as stated in Decree 67/2007/ND-CP dated April 13th 2007 of the Government regarding the support policies applied to social beneficiaries, the additional support shall be given to those who are suffering from the at sea natural disaster as follows:
1. They shall be financially supported with 100% of the cost for traveling back to their residence if they are in a place that far from their home (including the risks occurred out of Vietnamese sea waters).
2. The expenditure including the bringing human from sea to land, preservation of victim's dead body; information on the search and rescue that is broadcast on mass media during 30 days shall be free.
3. Persons who are encouraged or voluntary to involve in the search and rescue shall, in addition to policies as stated in paragraphs 1 and 2 of this Article, be provided with allowances as regulated in Decision 70/2006/QD-TTg dated March 29th 2006 of the Prime Minister relating to the special allowances applied to civil servants on board of maritime search and rescue ships and shall be awarded as provided for by current legislation.
Article 3. Support to asset's damages
1. The production means (vessels, boats, cages) which are lost or seriously damaged shall be supported; the cost for fishing out the production means (vessels, boats, cages) which are sunk or drifted shall be supported; the fish seed shall be supported in case where the aquaculture site is recovered after a damage.
The People's Committees of cities or provinces under central control shall, based on real situation, subjects and level of damage as well as financial capacity, make regulation relating to the additional support.
2. The payment of tax shall be exempted according to current legislation.
3. The communication means, life vests shall be provided to offshore fishing vessels which are seriously damaged.
4. The 100% of the cost spent for fuel, repair of the vessels which are encouraged to involve in or voluntary to involve in search and rescue work shall be fully supported.
Article 4. Financial source
The financial source shall come from:
1. State budget which is allocated to local budget as regulated by State budget.
2. Local budget which have a part put aside for the policy's compliance activities as regulated in this Decision.
3. Contribution and donation from domestic and external organizations and individuals.
Article 5. Implementation
1. Ministry of Fisheries shall, in coordination with Ministry of Finance, Ministry of Labor, Invalid and Social Affairs and relevant ministries and sectors shall make guidance on implementation of this Decision.
2. Ministry of Planning and Investment, Ministry of Finance shall arrange the annual budget allocated to local authorities for implementation.
3. The People's Committee of cities and provinces under central control shall be responsible for implementation of policies as stated in this Decision; shall actively allocate local budget for timely support when the risks occur; shall provide strict direction, investigation and management to ensure that the implementation is in right purpose, subjects and contents as regulated.
Article 6. Entry into force
This Decision shall be effective 15 days after being posted on Official Gazette.
The ministers, heads of ministerial-level agencies, heads of governmental agencies, chairmen of People's Committees of cities and provinces under central control shall be responsible for implementation of this Decision.
