DECISION

ON THE WORK ASSIGNMENT BETWEEN THE PRIME MINISTER AND DEPUTY PRIME MINISTERS

THE PRIME MINISTER

Pursuant the Law on Organization of the Government of December 25, 2001;
Pursuant to the Government
s Working Regulation issued together with Decree No. 11/1998/ND-CP of January 24, 1998,

DECIDES:

Article 1.- Major principles for work assignment between the Prime Minister and deputy-prime ministers:

1. The deputy-prime ministers shall assist the Prime Minister in directing each field of work of the Government under the Prime Ministers assignment and use the Prime Ministers powers to handle affairs falling within their respective assigned domains.

2. The deputy-prime ministers shall, within their assigned powers and tasks, take initiative in handling affairs, if any matters are related to the domains taken charge of by other deputy-prime ministers, the deputy-prime ministers shall take initiative in coordinating with one another in handling them. In cases where the deputy-prime ministers hold divergent opinions, the deputy-prime minister who assumes the main responsibility for settling such affairs shall report such to the Prime Minister for decision.

3. The deputy-prime ministers shall be answerable to the Prime Minister for the decisions related to the performance of work assigned to them by the Prime Minister.

4. Weekly, the Prime Minister and deputy-prime ministers shall hold a briefing to exchange information on and handle affairs which the Prime Minister deems it necessary to discuss collectively.

5. Depending on the working situation and requirements, the work assignment between the Prime Minister and deputy-prime ministers (prescribed in Article 3 of this Decision) may change as decided by the Prime Minister.

Article 2.- Within the scope of their assigned domains, the deputy-prime ministers shall have the responsibilities and powers:

1. To direct the ministries, the ministerial-level agencies and the agencies attached to the Government to formulate socio-economic development strategies, plannings and plans; mechanisms and policies; bills as well as draft ordinances and legal documents of the Government and the Prime Minister;

2. To inspect and urge the ministries, the ministerial-level agencies, the agencies attached to the Government, and the provincial-level Peoples Councils and Peoples Committees in organizing the realization of the undertakings, policies and laws on the domains under their charge, to detect and propose matters which need to be amended and/or supplemented. If detecting that ministries, ministerial-level agencies, agencies attached to the Government or local Peoples Councils and Peoples Committees issue documents or commit acts in contravention with the States law and/or the regulations of the Government and/or the Prime Minister, they shall suspend the implementation of such documents and direct the amendment and/or supplementation thereof.

3. To settle specific arising issues which fall under the Prime Ministers jurisdiction and inter-branch issues which the ministers cannot reach the agreement on; to report to the Prime Minister on policy issues not yet specified by the Government for the handling thereof; and not to handle issues falling under the competence of ministers.

4. To monitor the work of organization and personnel and direct the handling of internal issues of agencies under their management as assigned by the Prime Minister.

5. Due to the characteristics of the Governments work of administration, the Prime Minister shall appoint a Standing Deputy Prime Minister to act on his behalf and perform his tasks when he is not present at the Governments headquarters.

Article 3.- Assignment of work

1. The Prime Minister shall generally lead and manage all aspects of activities and work of the Government, the cabinet members, the heads of the agencies attached to the Government and the presidents of the local Peoples Councils and Peoples Committees.

a) To personally direct the following domains:

- General economic affairs, including: Strategies and plannings for the development of important branches, regions and fields; long-term and annual socio-economic development plans, key and big investment projects and works; finance, pricing, monetary, and banking matters, securities, statistics, auditing, national reserves, and foreign loan and repayment;

- Administrative reform; the formulation of institutions and concretization of the Partys resolutions as well as laws and ordinances; organization and personnel work; domestic non-governmental organizations; the work of emulation, commendation and disciplines; and the Governments working regulations and mode;

- National defense and security; big, unexpected and sensitive issues in the fields of economy, culture, social affairs and external relations; affairs and solutions of special importance and breakthrough nature on the work of direction and administration in each period of time;

- The relationship of coordination between the Government and the National Assembly, the Supreme Peoples Court, the Supreme Peoples Procuracy, the Central Committee of Vietnam Fatherland Front and mass organizations.

b) To monitor and direct the following agencies: The Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Justice, the Ministry of the Interior, Vietnam State Bank and the Government-attached agencies in the relevant work domains.

2. Deputy Prime Minister Nguyen Tan Dung shall act as Standing Deputy Prime Minister assuming the prime responsibility and regulate the general activities of the Government when the Prime Minister is absent or authorizes him.

a) To personally take charge of the following work domains:

+ Industry;

+ Post, telecommunications and information technology;

+ Agriculture, forestry, aquatic resources, water resources, meteorology and hydrography; agricultural and rural industrialization, development of craft villages and cooperative economy;

+ Product consumption (both domestic market and import/export according to specific community lines);

+ Capital construction, architecture and urban development; communications and transport;

+ Renewal and development of State enterprises; corporations 91;

+ Development of enterprises of various economic sectors;

+ Natural resources and environment;

+ Inspection, complaint consideration, corruption and crime combat;

+ Search and rescue; flood and storm prevention and combat;

+ Wage policy reform;

+ Defense and security work as assigned by the Polibureau and the Prime Minister.

b) To monitor and direct the following agencies: The Ministry of Construction, the Ministry of Industry, the Ministry of Post and Telecommunications, the Ministry of Communications and Transport, the Ministry of Agriculture and Rural Development, the Ministry of Aquatic Resources, the Ministry of Natural Resources and Environment, the Ministry of Defense, the Ministry of Public Security, the State Inspectorate, the Government Office and other Government-attached agencies in the relevant work domains.

3. Deputy Prime Minister Vu Khoan:

a) To personally take charge of the following domains:

+ Diplomacy and external relations;

+ International economic cooperation and integration;

+ External economy, including: foreign direct investment (general policies and mechanism), mobilization of official development assistance (ODA) and non-government aids, relations with the international economic organizations, non-governmental organizations and regional economic organizations, negotiations for joining the WTO.

+ General mechanisms and policies on trade: domestic market and import/export;

+ Smuggling and trade frauds combat, market control and protection of consumers interests;

+ Tourism;

+ Border issues;

+ The East Sea and off-shore islands, including sea and off-shore island economies;

+ Human right issues;

+ Work concerning nationalities and religions;

+ Some other affairs related to these domains.

b) To coordinate work between the Government and the Party Central Committees Secretariat; to monitor and direct the following agencies: the Ministry for Foreign Affairs, the Ministry of Trade, the Committee for Nationalities and the Government-attached agencies in the relevant work domains.

4. Deputy Prime Minister Pham Gia Khiem:

a) To personally take charge of the following domains:

+ Science and technology;

+ Education and training;

+ Culture and arts; information, press, radio and television broadcasting;

+ Healthcare, physical training and sports;

+ Labor and social issues; labor export;

+ Hunger eradication and poverty alleviation;

+ Population, families and children.

b) To monitor and direct the following agencies: The Ministry of Science and Technology, the Ministry of Education and Training, the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Culture and Information, the Ministry of Health, the Committee for Population, Families and Children, the Committee for Physical Training and Sports and the Government-attached agencies in relevant work domains.

Article 4.- This Decision takes effect after its signing.

The cabinet members, the heads of the agencies attached to the Government and the presidents of the Peoples Committees of the provinces and centrally-run cities shall have to implement this Decision.
