DECISION

ON AUTHORIZATION FOR THE HEADS MANAGEMENT UNITS OF INDUSTRIAL ZONES TO PERFORM THEIR STATE MANAGEMENT DUTIES OF ENVIRONMENTAL PROTECTION IN THE INDUSTRIAL ZONES

PRESIDENT OF PEOPLE’S COMMITTEES OF BA RIA- VUNG TAU PROVINCE

Pursuant to the Law on Organizations of People’s Councils and People’s Committees dated 26/11/2003;

Pursuant to the Law on Environmental Protection dated 29/11/2005;

Pursuant to the Decree No.80/2006/ND-CP dated 09/8/2006 of the Government detailing and guiding the implementation of a number of Articles of the Law on Environmental Protection;

Pursuant to the Decree No.81/2007/ND-CP dated 23/5/2007 of the Government regulating the professional organizations, units on environment protection at the authorities and state-owned enterprises;

Pursuant to the Decree No.21/2008/ND-CP dated 28/02/2008 of the Government on amending, supplementing a number of Articles of Decree No.80/2006/ND-CP dated 09/8/2006 of the Government detailing and guiding the implementation of a number of Articles of the Law on Environmental Protection;

Pursuant to the Decree No.29/2008/ND-CP dated 14/3/2008 defining industrial zones, export processing zones and economic zones;

Pursuant to the Circular No.05/2008/TT-BTNMT dated 08/12/2008 of Ministry of Natural Resource and Environment guiding strategic environmental assessment, environmental impact assessment and environmental protection commitment;

At the proposal of the management units of industrial zones at the Document No.181/BQL-QH dated 26/02/2009;
At the proposal in the Statement No.642/TTr-SNV dated April 08, 2009 of Director of Department of Home Affairs,

DECIDES:

Article 1. Now authorize the heads Management Units of Industrial Zones to appraise and approve the statement on environmental impact assessment for the invested projects in the industrial zones under the jurisdiction of People's Committee of Ba Ria - Vung Tau province.

Article 2. Heads Management Unit of the Industrial Zones shall:

a) Appraise and approve the statements on environmental impact assessment for the invested projects in the industrial zones under the jurisdiction of People's Committee of Ba Ria - Vung Tau province.

b) Implement the contents as prescribed in clause 12, Item III of Circular No.05/2008/TT-BTNMT dated 08/12/2008 of the Ministry of Natural Resources and Environment guiding on strategic environmental assessment and environmental impact assessment and commitment of environmental protection;

c) Review and compare the records of design, construction and installation of environmental treatment works with statement of environmental impact assessment approved; in case of detecting the non-conformity with statement of environmental impact assessment, within a period of not exceeding 07 (seven) working days after receipt of records, statement, it must send written notice to the project owner to adjust and supplement;

d) Receive and process the proposals and recommendations of the project owners, organizations and individuals related to the implementation of the contents, environmental protection measures during the construction, building of projects;

đ) Plan and conduct supervision and inspection of the contents implementation of measures to protect the environment, handle according to competence or propose the handling of the violations occurred if it is not under their jurisdiction;

e) Organize the examination and supervision the trial operation of the environmental treatment works of the project owners after receiving their trial operation plans;

f) Review and certify the results of trial operation of environmental treatment works;

g) Maintain and manage all records and documents on the after-appraisal activities sent by the project owners, agencies and concerned individuals;

h) Submit the reports on the results of appraisal, approval of statements of environmental impact assessment to the Departments of Natural Resources and Environment as prescribed;

i) Synthesize and report the performance of duties authorized to the Provincial People’s (PPC) Committees monthly, quarterly and annually.

Article 3. Establish Department of Environmental Management of the Management Unit of Industrial Zones to perform the tasks of state management on environmental protection authorized in Article 1 of this Decision.

Article 4. This Decision takes effect from its signing date. The previous regulations contrary to this Decision are hereby annulled.

Article 5. PPC's Chief Office, Director of the Home Affairs, Directors of Department of Natural Resources and Environment, Heads Management Units of industrial zones, heads of concerned agencies and units shall implement this Decision.
