DECISION

ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL HYDROMETEOROLOGICAL SERVICE AFFILIATED TO THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT

THE PRIME MINISTER

Pursuant to the Law on Government organization dated December 25, 2001;

Pursuant to the Government's Decree No. 178/2007/NĐ-CP dated December 03, 2007 defining the functions, tasks, powers and organizational structure of Ministries and ministerial agencies;

Pursuant to the Government's Decree No. 25/2008/NĐ-CP on March 04, 2008 on defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;

At the request of the Minister of Natural Resources and Environment,

DECIDES

Article 1. Position and functions

1. The National Hydrometeorological Service (hereinafter referred to as the Service) is a state service affiliated to the Ministry of Natural Resources and Environment, assists the Ministry of Natural Resources and Environment in managing and operating the national meteorology and hydrology system (including fundamental investigations, forecasts, materials on meteorology and hydrology, observation of the atmosphere and water serving the prevention of disasters, socio-economic development, assurance of National defense and security nationwide.

2. The Service has a separate legal status, seal, and account according to law. The head office of the Service is situated in Hanoi.

Article 2. Tasks and powers

The Service has the following tasks and powers:

1. Submitting 5-year and annual strategies, programs, plans, and projects of the Service to the Minister of Natural Resources and Environment, and implementing them after they are approved.

2. Participating in the formulation of legislative documents, technical standards, technical regulations, economic - technical limits on meteorology and hydrology.

3. Organizing the development of the network of fundamental investigations into: surface meteorology, aviation meteorology, agricultural meteorology, maritime meteorology, continental hydrology and maritime hydrology (hereinafter referred to as meteorology and hydrology); planning the implementation of the national strategies for natural disaster forecasting and warning that are the duties of the Service.

4. Carrying out observation, collecting documents from the meteorology and hydrology survey system; carrying out surveys of meteorology and hydrology, topography of riverbeds, estuaries, and inshore sea to complement materials on fundamental investigations in the areas that lack observation stations or frequently suffer from storms, flooding, and other dangerous natural disaster; observing the atmosphere and water as assigned by the Minister of Natural Resources and Environment.

5. Providing meteorology and hydrology forecasts; broadcasting news about the developments of the weather, tropical depressions, storms, floods, inundations, and tides according to law; carrying out observations and transmit data about sea level serving tsunami warning, prevention of floods, inundations, salinization, the impacts that cause climate change and changes in landscape and environment.

6. Sending representatives to participate in the Committees on Flood and Storm Control - Search and Rescue of central-affiliated cities and provinces.

7. Assessing the quality of fundamental investigations and hydrometeorology forecasts under the management of the Service; managing and storing meteorology and hydrology data; providing information and materials on meteorology and hydrology in accordance with law.

8. Developing the system of meteorology and hydrology communication and technologies for fundamental investigations, meteorology and hydrology forecasts, and disaster warnings in the national meteorology and hydrology network.

9. Selecting, testing, inspecting, calibrating instruments for meteorological and hydrological measurement; protecting the technical safety corridor for moving meteorology and hydrology works according to law.

10. Participating in the inspection of the use of information about fundamental investigations into meteorology and hydrology for the projects of national importance and the projects within the competence of Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the provincial People’s Committees as assigned by the Minister of Natural Resources and Environment.

11. Participating in activities related to climate change as assigned by the Minister of Natural Resources and Environment.

12. Organizing the implementation of international programs and projects on meteorology and hydrology after they are approved; participating in multilateral, bilateral cooperation and international agreements on meteorology and hydrology as assigned by the Minister of Natural Resources and Environment.

13. Conducting scientific research, application and transfer of technologies for meteorology and hydrology as prescribed by law.

14. Raising the public awareness of disaster prevention and remediation of damage caused by natural disasters as assigned by the Minister of Natural Resources and Environment.

15. Providing or cooperating in providing meteorological, hydrological and environmental services in accordance with law.

16. Carrying out administrative reform according to the administrative reform plan of the Ministry of Natural Resources and Environment.

17. Engaging in anti-corruption, thrift practice; settling complaints, denunciations of citizens about the issues within the competence of the Service.

18. Organizing the organizational mechanism and payroll; follow the policies on salaries, benefits, commendations; providing training for officials and employees of the Service as assigned by the Ministry of Natural Resources and Environment in accordance with law.

19. Managing the finance and assets allocated by the Ministry of Natural Resources and Environment in accordance with law.

20. Performing other duties and exercise other rights delegated by the Minister of Natural Resources and Environment in accordance with law.

14. North East Hydrometeorology Observatory (situated in Hai Phong city)

15. Hydrometeorology Observatory of North Plain (situated in Hanoi)

16. Hydrometeorology Observatory of North Central Coast (situated in Vinh city, Nghe An province)

17. Hydrometeorology Observatory of Middle Central Coast (situated in Da Nang city)

18. Hydrometeorology Observatory of South Central Coast (situated in Nha Trang city city, Khanh Hoa province)

19. Hydrometeorology Observatory of the South (situated in Ho Chi Minh City)

20. Hydrometeorology Observatory of Central Highlands (situated in Pleiku city, Gia Lai)

21. Hydrometeorology Magazine

The Minister of Natural Resources and Environment shall decide the establishment of financially autonomous public service providers affiliated to the Service in accordance with law.

Article 4. Managerial positions

1. The Service has a General Director and no more than 03 Deputy General Directors.

2. The General Director and Deputy General Directors shall be designated and dismissed by the Minister of Natural Resources and Environment in accordance with law.

3. The General Director shall define the functions, tasks, powers and organizational structure of the organizations affiliated to the Service.

4. The General Director is responsible before the law and to the Minister of Natural Resources and Environment fore all activities of the Service; the Deputy General Directors are responsible to the General Director for the tasks assigned.

Article 5. Effect and implementation

1. This Decision takes effect after 15 days from the day on which it is published on the Official Gazette.

2. The Decision No. 15/2003/QĐ-BTNMT dated January 09, 2013 of the Minister of Natural Resources and Environment on the functions, tasks, powers and organizational structure of National Hydrometeorological Service.

3. The Minister of Natural Resources and Environment, other Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the provincial People’s Committees, and the General Director National Hydrometeorological Service are responsible for the implementation of this Decision.
