DECISION

ON DEDUCTING FOR PAYING THE TRADE-UNION FEE FOR THE ENTERPRISES WITH FOREIGN INVESTMENT AND THE MANAGEMENT OFFICES OF FOREIGN SIDES IN THE BUSINESS CO-OPERATION CONTRACTS

THE PRIME MINISTER

Pursuant to the Law on Organization of Government dated December 25, 2001;

Pursuant to the Law on the Trade-Union dated June 30, 1990;

Pursuant to the Law on Investment dated November 29, 2005;

At the proposal of the Minister of Planning and Investment;

DECIDES:

Article 1. To provide for the deduction for paying trade-union fee by 1% of salary, wage fund payable to Vietnamese laborers working in enterprises with foreign investment and management offices of the foreign sides in the Co-operation Business Contracts in Vietnam with trade unions that are operating under the Trade Union Law.

Article 2. Ministry of Finance shall preside over and coordinate with the General Labor Confederation of Vietnam, Ministry of Planning and Investment to guide the deduction for payment and use of trade-union fees as stipulated in Article 1 of this Decision and in accordance with the provisions current law.

Article 3. This Decision takes effect from January 01, 2009. To annul the provisions of clause 3 Article 4 of Decision No.53/QD-TTg March 26, 1999 of the Prime Minister on a number of measures to encourage foreign direct investment.

Article 4. The ministers, heads of ministerial-level agencies, heads of governmental agencies, presidents of People's Committees of provinces and cities under central authority, the president of the Vietnam General Labor Confederation, Chairmen of the Management Boards, General Directors, Directors of enterprises with foreign investment, Chiefs of the management offices of the foreign sides in the business cooperation contracts shall implement this Decision.
