DECISION

ON THE MANAGEMENT AND UTILIZATION OF THE GOVERNMENT GUEST-HOUSES

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government on the 30th of September, 1992;
At the proposal of the Minister for Foreign Affairs, the Minister-Director of the Office of the Government, and the Minister of Finance,

DECIDES:

Article 1.- The Government guest-houses stipulated in this Decision are those assigned to the Ministry for Foreign Affairs' management to be utilized for the purpose of serving external protocol activities of the Party, State, the National Assembly and the Government (hereafter referred to as the Party and State). These are:

1. Guest-House at Number 12 Ngo Quyen, Hanoi,

2. Guest-House at Number 2 Le Thach, Hanoi,

3. Guest-House at Number at 1 Ly Thai To, Ho Chi Minh City.

Article 2.- The Government guest-houses have the following main tasks:

a/ To organize the reception and cater for the accommodation and work of high-level guest delegations of the Party and State, on official visits or working visits to Vietnam.

b/ To cater for the talks, signing, conferences, press conferences, receptions and banquets, and other official diplomatic activities of the Party and State, of the ministries, ministerial-level agencies, agencies attached to the Government presided over by a minister, and equivalent or higher level.

c/ The Guest-Houses at Number 12 Ngo Quyen and at Number 1 Ly Thai To shall be chiefly used to cater for:

- The protocol and diplomatic activities of the General Secretary of the Party, the President of the Republic, the Prime Minister, the Chairman of the National Assembly, the Vice-Chairman (Vice Chair-woman) of the Republic, the Deputy Prime Minister, the Vice Chairmen (Vice Chairwomen) of the National Assembly, and the Minister for Foreign Affairs;

- The talks, signing of documents, and official receptions organized by the ministerial and higher levels;

- Receptions, accommodation of Heads of State, Heads of Government or National Assembly, and equivalent level, and the Heads of important international organizations.

The protocol and diplomatic activities at Guest-Houses at Number 12 Ngo Quyen and Number 1 Ly Thai To shall be arranged by the Ministry for Foreign Affairs, with a view to ensuring the political requirements and protocol regulations.

In case many requirements of service happen at the same time, the Ministry for Foreign Affairs shall have to closely coordinate with the Office of the Government and other concerned agencies to seek measures to overcome difficulties, in order to meet these requirements to the best of its ability.

Article 3.- The Ministry for Foreign Affairs takes responsibility before the Government for the overall direction and management of the guest-houses, as stipulated in Article 1 of this Decision. It shall take the initiative in drawing up the plan and carrying out measures aimed at improving continually the quality and efficacity of service, so that within a short time it can raise the managerial and professional skills of the officials and employees of the Government guest-houses to the international level, and meet ever better the requirements of the diplomatic activities and external relations activities of the Party and State.

Article 4.- The Government guest-houses are allowed to apply the system of financial management as other revenue-earning public service organizations, defined in Circular No.01-TC/HCVX on the 4th of January, 1994, and Circular No.25-TC/TCT on the 28th March, 1994 of the Ministry of Finance. All revenue and expenditure operations of the Government guest-houses must strictly abide by the current regime of financial management of the State, and the following principles:

a/ All the expenditures to cater for the protocol activities of the Party and State leaders (requested by the Minister - Director of the Office of the Government, the Director of the Office of the President of the Republic, the Director of the Office of the National Assembly, and the Minister for Foreign Affairs) shall be supplied by the State budget through the Ministry for Foreign Affairs, according to the regime of financial spending and the approved expenditure plan.

b/ The other protocol activities requested by the Ministries, ministerial-level Agencies and Agencies attached to the Government, comprise two categories;

- With regard to the activities budgeted by the State (by written decision of the Prime Minister which specifies that the Vietnamese side defrays expenses), the Government guest-houses shall charge only for the accommodation and meals, and shall make no surcharges.

- With regard to the activities funded by foreign countries, or by the self - procured fund of the agency or unit, the Government guest-houses shall charge according to the market prices.

c/ Besides the assigned tasks, the Government guest-houses may make maximal use of their facilities, when conditions permit, to cater for a number of given guests (to be specified by the Ministry for Foreign Affairs). They are allowed to retain all the revenues from this service to invest in upgrading their material bases, and make up for part of the expenditures. The upgrading of the material bases and the investment in new constructions must be done according to the current regulations on investment in capital construction.

Article 5.- The State Planning Committee and the Ministry of Finance shall have to ensure the necessary budget to maintain regular operation of the Government guest-houses, and to transform and upgrade them according to international standard.

Article 6.- Periodically, the Minister-Director of the Office of the Government, together with the Minister for Foreign Affairs and the Minister of Finance, shall inspect the management and utilization of the Government guest-houses according to the stipulations of this Decision.

Article 7.- The Ministers, the Heads of the ministerial-level agencies, the Heads of the agencies attached to the Government, and the Presidents of the People's Committees of Hanoi City and Ho Chi Minh City shall have to implement this Decision.

Article 8.- This Decision takes effect from the date of its signing. All earlier regulations contrary to this Decision are now annulled.
