DECISION

ON THE CONDITIONS OF HATCH OF POULTRY EGGS AND AQUATIC BIRDS HUSBANDRY

THE PRIME MINISTER

Pursuant to the Law on Organization of Government dated December 25, 2001;

Pursuant to the 2004 Ordinance on Breeds, the 2004 Ordinance on Veterinary Medicine;

At the proposal of the Minister of Agriculture and Rural Development,

DECIDES:

Article 1. Objectives

1. Control operation of poultry eggs hatch and breeding aquatic birds in order to ensure disease prevention and combat effectively, especially bird flu.

2. Encourage the development of livestock husbandry, poultry eggs hatch by the method of farm, industry for sustainable growth and high economic efficiency.

Article 2. Scope of governing and application subjects

1. This decision specifies conditions for hatching poultry eggs by the craft, industrial method and conditions of breeding aquatic birds (ducks, geese) by the form of farm, industry and duck in the fields (including casual ducks).

2. This decision applies to organizations and individuals who are owners of the establishments hatching poultry eggs, establishments breeding aquatic birds specified in clause 1 of this Article.

Owners of the establishments hatching poultry eggs, establishments breeding aquatic birds must comply with current provisions of law on domestic animals, veterinary medicine, and the regulations in this Decision.

Article 3. Conditions for hatching poultry eggs

The establishments hatching poultry eggs must satisfy fully the following conditions:

1. The establishments hatching eggs that are not subject to business registration as stipulated in the Decree No.88/2006/ND-CP dated August 29, 2006 of the Government on business registration, the establishment owners must declare to the commune-level People's Committees of business operation of poultry eggs hatch.

2. Locations of establishments hatching eggs must comply with local zoning and outside the inner cities, urban areas, and residential areas; outside the campus, hospitals, markets, offices, and other public places.

3. For Hygiene and veterinary medicine:

a) The eggs to be put into hatchery must be produce from the healthy parent poultry, safety from disease, have been vaccinated bird flu in accordance with provisions;

b) There are places to handle dead poultries, broken eggs, egg shells and other wastes;

c) Period disinfection must be done;

d) Tools hatching eggs, means transporting eggs and poultry must be disinfected after each use;

đ) Having record for monitoring the eggs put into hatchery and sold the poultry;

e) Suspension of the egg hatch activities during the announcement of bird flu epidemic in the area.

Article 4. Conditions for breeding aquatic birds

A. For establishments breeding aquatic birds in the form of farm or industry

a) Aquatic birds varieties must be produced from eligible establishments hatching eggs under the provisions of Article 3 of this Decision;

b) Breeding establishment not subject to business registration as stipulated in Decree No. 88/2006/ND-CP dated August 29, 2006 08 of the Government on business registration, the owner of breeding establishments must declare to the commune-level People's Committees of operations breeding aquatic birds;

c) Locations of breeding establishments must comply with local zoning and outside the inner cities, urban areas, and residential areas; outside the campus, hospitals, markets, offices and other public places;

d) To carry out vaccination of bird flu periodically for aquatic birds as prescribed and having records monitoring vaccination;

đ) To perform disinfection of the breeding establishment periodically;

e) When aquatic birds have been  detected signs of the illness, livestock husbandry owners must report immediately to the authorities or commune veterinary public employees; not to sell sick aquatic birds and dead aquatic birds must be destroyed according to regulations;

g) When having epidemic, livestock husbandry owners must implement measures for prevention, combat of epidemic in accordance with the law on veterinary medicine; only newly breed or re-breed after the announcement of epidemic termination was conducted by competent state agencies in the area.

2. For the breeding of ducks in the fields:

a) The owners who breed ducks in the field must report on the breed and the area of farming and herding ducks to the commune-level People's Committees to obtain books for monitoring;

b) Breed of aquatic birds must be produced from eligible eggs hatching establishments under the provisions of Article 3 of this Decision;

c) Herd of ducks must be vaccinated regularly according to regulations;

d) Only permitted to move ducks in the areas where were declared with commune-level People's Committees as prescribed in point a clause 2 of this Article;

đ) When herd of ducks have been detected signs of the illness, livestock husbandry owners must report immediately to the authorities or commune veterinary public employees; not to sell sick aquatic birds and dead aquatic birds must be destroyed according to regulations;

e) When having epidemic, livestock husbandry owners must implement measures for prevention, combat of epidemic in accordance with the law on veterinary medicine; only newly breed or re-breed after the announcement of epidemic termination was conducted by competent state agencies in the area.

Article 5. Organization of implementation

A. People's Committees of provinces and cities under central authority shall:

a) Implement and inspect the implementation of the provisions of this Decision in the area;

b) Develop and approve planning of establishments hatching poultry eggs, breeding aquatic birds in the form of farms, industry;

c) Implement the prevention, combat of avian influenza in accordance with the law on veterinary medicine;

d) Direct the competent agencies to handle violations of the provisions of this Decision in accordance with provisions of Decree No.47/2005/ND-CP of April 8, 2005 by the Government on sanctions of administrative violations in the domain of livestock breeds and Decree No.129/2005/ND-CP dated October 17, 2005 by the Government on sanction of administrative violations in the field of veterinary medicine;

đ) Organize propaganda and mobilization of households, individuals to limit, and then eliminate the small and scattered breed of aquatic birds.

2. Ministry of Agriculture and Rural Development shall:

a) specify the size for the establishments hatching poultry eggs, breeding aquatic birds and guide the technical conditions for poultry eggs hatch and breeding aquatic birds in accordance with provisions of this Decision;

b) Coordinate with the People's Committees of provinces and cities directly under the central government to inspect the implementation of conditions of  poultry eggs hatch, planning of construction of hatcheries, breeding aquatic birds in the forms of farms industry.

Article 6. Effect

1. This Decision takes effect from the signing date.

2. Minister of Agriculture and Rural Development, Chairmen of People's Committees of provinces and cities under central authority shall organize the implementation of this Decision./.
