CIRCULAR
ON SUPPLEMENTING A NUMBER OF ARTICLES OF THE MARCH 08, 2006 DECISION NO. 15/2006/QD–BNN, OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT PRESCRIBING THE ORDER AND PROCEDURES OF ANIMAL, ANIMAL PRODUCT QUARANTINE AND VETERINARY HYGIENE INSPECTION
Pursuant to the Government's Decree No. 01/2008/ND-CP of January 03, 2008 on defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural development;
Pursuant to the Government's Decree No. 75/ND-CP of September 10, 2009 on amending Article 3 of the Government's Decree No. 01/2008/ND-CP of January 03, 2008 on defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural development;
Pursuant to the Ordinance on Veterinary medicine of April 29, 2004;
Pursuant to the Government's Decree No. 33/2005/ND-CP of March 15, 2005 detailing the implementation of a number of articles of the Ordinance on Veterinary medicine;
Pursuant to the Government's Decree No. 119/2008/ND-CP of November 28, 2008 on amending and supplementing a number of articles of the Government's Decree No. 33/2005/ND-CP of March 15, 2005 detailing the implementation of a number of articles of the Ordinance on Veterinary medicine;
The Ministry of Agriculture and Rural development supplements Article 19a of the Decision No. 15/2006/QD–BNN of March 08, 2006 of the Ministry Of Agriculture and Rural Development prescribing the order and procedures of animal, animal product quarantine and veterinary hygiene inspection as follows:
Article 1. Supplementing Article 19a as follows:
“Article 19a. Importing unrefined terrestrial animal products for processing export goods.
1. The unrefined terrestrial animal products are products like meat, ears, tails, limbs and wings of livestock and poultry that are not cleaning.
2. The quarantine of unrefined animal products imported for processing export goods shall be implemented under the provisions on import animal product quarantine (in Section 3 prescribing the order and procedures of import animal, animal product quarantine of the Decision No. 15/2006/QD-BNN of March 08, 2006 of the Ministry of Agriculture and Rural development).
3. Unrefined animal products being imported to Vietnam for processing export goods must be inspected and issued the Export quarantine certificates by competent veterinary agencies of the export countries with content: the name and address of the export company; the name and address of the factory that produces products for export; the name and address of the company that imports products for processing, products having origins from animals belonging to the breeding areas and establishments without animal epidemics relating to that kind of animal as prescribed by The World Organization for Animal Health (OIE), products of animal origin being inspected before and after butchering, products being packaged for ensuring veterinary hygiene, and the use purpose as food for humans.
4. It is allowed to process export goods only in establishments that fulfill the conditions for veterinary hygiene and satisfy the requirements from competent agencies of the import countries.
5. Before being exported, the processed animal products must be put in quarantine under the provisions on export animal product quarantine; if the products fail to satisfy the requirements for quarantine procedures and food safety and hygiene, animal quarantine agencies shall request the goods owner to re-export to the export country.
Article 2. Effects
This Circular takes effect after 45 (forty five) days as from the date of promulgation.
Article 3. Implementation responsibilities
The Chief of the Ministry Offices, the Director of the Veterinary department, Heads of ministerial units and relevant organizations and individuals are responsible to implement this Circular./.
