DECISION

APPROVAL OF MASTER PLAN OF VEHICLE LOAD CHECKING STATION ON THE ROAD TILL 2020, WITH A VISION TO THE YEAR 2030

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government dated 25 December 12, 2001;

Pursuant to the Law on the road Traffic dated November 13, 2008;

At the proposal of the Minister of Transport,

DECIDES:

Article 1. Approving the master plan of vehicle load checking station on the road till 2020, with a vision to the year 2030 with the following principal contents:

I. MANAGEMENT POINT OF VIEW

1. The master plan of vehicle load checking station on the road till 2020, with a vision to the year 2030 must conform with the Transport Development Strategy till 2020, with a vision to 2030 at the same time closely associated with the relevant planning.

2. Protection of road transport infrastructure is the responsibility of all levels and sectors of every person and of society as a whole. The work of propagation and dissemination and education of the law on the road transport should be enhanced and gradually raising the awareness and responsibility of participants in traffic in compliance with the provisions of the law on the road transport and protection of road infrastructure.

3. Setting aside reasonable land for investment and construction of vehicle load checking station on the road to meet the requirements of the management and protection of road infrastructure immediately as well as long-term.

4. Concentrating investment in the construction of vehicle load checking station on the road, applying modern technology, ensuring the load control and limited size of vehicle quickly, accurately and efficiently, minimizing the human direct impact and intervention in the process of load control, limited size of the vehicle at the station.

5. Diversifying investment capital, encouraging all economic sectors to invest in construction of vehicle load checking station on the road.

II. OBJECTIVES OF DEVELOPMENT

1. Gradually forming the system and network of load control, vehicle size limit on the roads in order to improve the effectiveness and efficiency of state management of road transportation and prevent violations of regulations on load and limit size of roads, help protect and sustain the life of the road works; establish order and discipline in the operation of road transport, limit traffic accident on the road.

2. For the period from 2012 to 2015: Completing the construction and putting into operation the fixed vehicle load checking station on the road with the flow of heavy truck greater than 2200 vehicles / day and on some highways when being put into operation; equipped with mobile balance to set up the mobile vehicle load checking stations, performing the vehicle load testing on the roads without fixed vehicle load checking stations or performing irregular checks at the beginning the commodity source with many overloaded vehicles.

3. For the period from 2016 to 2020: Completing the construction and putting into operation the fixed vehicle load checking stations placed on roads with flow of heavy truck of greater than 500 units / day and on some highways when they are put into operation.

4. For the period 2021 to 2030: Completing the construction and putting into operation the fixed vehicle load checking stations placed on roads with flow of heavy truck of greater than 300 units / day and on some highways when they are put into operation.

III. MASTER PLAN

1. Principles to choose location to place vehicle load checking station.

a) For mobile vehicle load checking station: Placed on the road sections and routes, with overloaded and oversized vehicles in traffic without fixed vehicle load checking station or on road sections and routes with vehicles overloaded and oversized vehicles taking roundabout route to avoid the examination and control load testing station of fixed vehicle load checking station.

b) For fixed vehicle load checking station:

- Being placed on major roads and road transport corridors from which derive the large goods sources;

- Maximally controlling means of transportation on the road (including vehicles from neighboring areas, the focal goods sources, border gate, harbor, etc.);

- Minimizing the phenomenon of overloaded and oversized vehicles to take roundabout route to avoid the examination and control load testing station of vehicle load checking station.

- Minimizing impacts affecting the exploitation capacity of the roads;

- Restricting the placement of stations within the inner cities and urban areas of urban cities to prevent traffic congestion.

2. Number and location of vehicle load checking station:

- From 2012 to 2030, building 45 fixed vehicle load checking stations on the existing road system. Among them: 11 Station on Highway 1; 04 stations on the Ho Chi Minh road; 02 stations placed on Highway 3; 02 Station placed on Highway 6; 02 stations placed on Highway 32; 24 remaining stations placed on sections and line of Highway: Highway 2, Highway 4B, Highway 5, Highway 7, Highway 8, Highway 9, Highway 10, Highway 12, Highway 12A, Highway 13, Highway 14B, Highway 15, Highway 18, Highway 19, Highway 20, Highway 21, Highway 22, Highway 24, Highway 26, Highway 38, Highway 51, ​​Highway 54, Highway 70, Highway 91 (Appendix attached to this Decision).

- For the freeway system and newly-built roads, the Ministry of Transport shall determine the specific location for fixed vehicle load checking stations at the stage of making the investment project and making report to the Prime Minister Government for supplementation to the plan.

- Based on the actual traffic situation on the roads with decentralized management, the land management agencies (the Vietnam General Department of Roads, Services of Transport of the centrally-affiliated provinces and cities) shall make decision on specific location as well as the time of establishment of the fixed vehicle load checking stations.

3. Scale and technology of fixed vehicle load checking stations:

a) The size of the station: Controlling overloaded and oversized vehicles moving in both directions on the roads; having adequate facilities and equipment in accordance with the tasks of each station and ensuring working conditions for the forces operating at the station.

b) Technology: Applying modern technologies to ensure load control and size limit of vehicles quickly, accurately and efficiently; minimizing the human direct impact and intervention in the process of load control, vehicle limit size at the station; minimizing effects on objects not subject to checking during the operation of the station.

4. Expenditure and investment capital:

a) Funds for the construction of the vehicle load checking stations on the existing road system (including the cost of site clearance compensation) are expected to be: 6,468.431 billion dong (six thousand four hundred and sixty eight billion, four hundred and thirty-one million dong) which is implemented in three phases:

- For the period from 2012 to 2015: Building 13 fixed vehicle load checking stations equipped with 142 sets of mobile balance with estimated cost is 1,157,174 billion dong;

- For the period from 2016 to 2020: Building 19 fixed vehicle load checking stations with estimated cost is 2,428,637 billion dong;

- For the period from 2021 to 2030: Building 13 fixed vehicle load checking stations with estimated cost is 2,882,62 billion dong;

b) Expenditure for the construction of fixed vehicle load checking stations on the freeway system and newly-built roads, the Ministry of Transportation shall specify in the stage of preparation and approval of investment projects of road construction.

c) Investment capital: Mobilized from the central budget and other lawful sources.

IV. RESPONSIBILITIES OF THE MINISTRIES, SECTORS AND LOCALITIES

1. Ministry of Transport:

a) Assuming the prime responsibility and coordinating with the People's Committees of centrally-affiliated provinces and cities on the chainage basis of road sections and routes specified in the Annex to this Decision, specifically determining the location for the construction of fixed vehicle load checking stations.

b) Assuming the prime responsibility and coordinating with the Ministries, sectors and localities concerned to review and complete provisions of the law on: Technical Regulations on vehicle load checking stations; loading goods on vehicles; responsibility of goods and mean owner and other organizations and individuals related to transportation operations, loading and unloading of goods on vehicles in compliance with the regulations on the allowed load of the vehicles and the bridges and roads;

c) Assuming the prime responsibility and coordinating with the People's Committees of centrally-affiliated provinces and cities (place where located the stations) developing and issuing the "Regulation on the coordination of forces operating at vehicle load checking stations ";

d) Assuming the prime responsibility and coordinating with the Ministries, sectors concerned to propose financial plan, mechanism, policies and forms of investment to encourage economic sectors and mobilize capital sources to invest in building the vehicle load checking stations on the road.for submission to the Prime Minister in the second quarter of 2013.

2. The Ministry of Public Security: Directing traffic police forces of the centrally-affiliated provinces and cities and police of districts, towns and (place where located the stations) strengthening placement of cadres and soldiers engaged in collaboration with the industry of transport at the vehicle load checking stations to carry out tasks of checking vehicle overloaded and oversized traffic moving on the road.

3. Department of Defense: Directing military control forces under the Military Headquarters of centrally-affiliated provinces and cities (place where located the stations) strengthening placement of cadres and soldiers engaged in collaboration with the industry of transport at the vehicle load checking stations to carry out tasks of checking vehicle overloaded and oversized traffic moving on the road.

4. Ministry of Finance, Ministry of Planning and Investment: Coordinating with the Ministry of Transport in building mechanism, policies, forms of investment, capital raising, financial plans to allocate sufficient funds to carry out the investment to build vehicle load checking stations on the road according to the master plan.

5. Ministry of Information and Communications: Coordinating with the Ministry of Transport to develop regular, wide and deep and long-term propagation plans and programs in the entire population about the need to control the vehicle load and limited size vehicles on the road, the harm of the circulation of overloaded, oversized vehicles on the road, the information on the violation of the overloading and oversizing on the road.

6. People's Committees of centrally-affiliated provinces and cities:

- Within the scope of their functions, tasks and powers, have the responsibility to coordinate with the Ministry of Transport to carry out the objectives and tasks of the master plan of vehicle load checking stations on the road till 2020 with a vision to 2030 to ensure consistency and sync with the plan of socio-economic development of localities.

- Allocating land reserve to build vehicle load checking stations as planned, coordinating with the Ministry of Transport to issue and implement the "Regulation on the coordination of forces operating at vehicle load checking stations ".

Article 2. Implementation organization

1. The Ministry of Transport shall assume the prime responsibility and coordinate with the ministries, sectors and People's Committees of centrally-affiliated provinces and cities to organize implementation of the plan specified in Article 1 of this Decision. In the process of implementation, regularly reviewing and assessing for timely adjustments and supplements to conform with the actual requirements.

2. The Ministries, sectors and People's Committees of centrally-affiliated provinces and cities shall perform the tasks associated with the functions and duties assigned.

Article 3. This Decision takes effect from the date of signing.

Article 4. Ministers, heads of ministerial-level agencies, Heads of the Agencies under the Government, Chairmen of the People's Committees of centrally-affiliated provinces and cities shall be liable to execute this Decision. /.
