DECISION
APPROVING THE OVERALL PLAN ON CONSTRUCTION OF A NATIONAL WILDLIFE PARK IN NINH BINH PROVINCE
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the December 3, 2004 Law on Forest Protection and Development;
Pursuant to the November 13, 2008 Law on Biodiversity;
Pursuant to the December 16, 2002 Law on the State Budget;
Pursuant to the Prime Minister s Decision No. 57/QD-TTg of January 9, 2012, approving the forest protection and development plan during 2011-2020;
At the proposal of the Minister of Agriculture and Rural Development,
DECIDES:
Article 1. To approve the overall plan on construction of a national wildlife park in Ninh Binh province (below referred as to the Plan) with the following contents:
1. Name of the Plan: The overall plan on construction of a national wildlife park in Ninh Binh province.
2. Location and size
a/ Ky Phu and Phu Long communes, Nho Quan district, Ninh Binh provine;
b/ Size: The total planned area is 1,155.43 hectares.
3. Objectives
a/ General objectives: To conserve and rescue wild animals together with developing and preserving their genetic resources, prioritizing endangered, precious and rare species; to serve scientific research and environmental education and training in combination with eco- tourism; to generate jobs and raise incomes for local people, contributing to sustainable poverty reduction and enhancing socio-economic development;
b/ Specific objectives:
- To conserve, rescue and develop about 3,000 individuals of 250 animal species;
- To breed animals in a semi-natural environment;
- To develop sites and facilities for scientific research; to organize wildlife conservation and development training courses for domestic and foreign students;
- To develop eco-tourism, combining relaxation, recreation and entertainment with education about the environment and natural resources;
- To attract around 5 million visitor arrivals each year and increase state budget revenues.
4. Component projects
a/ Projects on construction of roads, technical infrastructure facilities and greeneries;
b/ Projects on construction of the wildlife rearing zone;
c/ Projects on construction of the wildlife research and development zone;
d/ Projects on construction of the service zone;
dd/ Projects on construction of the recreation and entertainment zone;
e/ Projects on construction of the resettlement and staff and visitor accommodation zone;
g/ Investment preparation projects, including those on ground clearance, bomb disposal, investment consultancy and some other items.
5. Investment capital demand: The total investment capital is estimated at around VND 7,368 billion, of which:
- VND 5,247 billion (71.2%) shall be raised from non-state sectors for investment in construction of infrastructures in the park’s zones and service and tourism projects and facilities;
- VND 2,121 billion (28.8%) shall be allocated from the state budget for investment in ground clearance, construction of main roads; water and electricity supply, wastewater and waste treatment stations; and infrastructures in the wildlife rearing zone and the wildlife care, research and development zone.
6. Phasing of investment
a/ Phase 1 (2012-2015):
- To conduct topographical surveys; draw a 1:2,000-scale planning map; and formulate the Plan;
- To elaborate and implement plans on ground clearance compensation, build resettlement areas and carry out resettlement work according to the Plan’s implementation schedule;
- To draw 1:500-scale planning maps for zones and component projects and elaborate plans on implementation of component projects;
- To formulate a project on building infrastructure in the Asian dangerous animals’ area,
b/ Phase 2 (2016-2020):
- To continue implementing uncompleted items left from phase 1;
- To implement component projects on the construction of the wildlife rearing zone, wildlife care, research and development zone and resettlement and staff and visitor accommodation zone, prioritizing investment capital for about 50% of items of projects to build the service zone and the thematic recreation and entertainment center;
- To receive and exchange animals; to train in and transfer wildlife care and research techniques.
c/ Phase 3 (2020-2025):
- To continue implementing uncompleted items left from phases 1 and 2 and launch the operation of the park;
- To transform the operation of the wildlife park after the model of joint stock company in which the State holds the dominant shares so as to manage infrastructure and wildlife farming activities as well as tourism and other services;
- To put the park into trial operation and exploit its tourism potential;
- To put the whole park into operation.
7. Implementation solutions
a/ Planning management:
- To select, call for and encourage investors possessing suitable financial capacity, experience and professional qualifications so as that the planning of the park will be approved and implemented according to the set schedule;
- For component projects to be implemented over a long period of time, it is necessary to map out specific schedules and plans for project completion.
b/ Mechanisms and policies:
- Investment projects in the wildlife park shall be eligible for supports applicable to hi-tech agricultural projects prescribed in the Government’s Decree No. 210/2013/ND-CP of October 19, 2013, on incentive policies for enterprises investing in agriculture and rural areas;
- The employment of foreign specialists to manage and operate the park must comply with regulations; the hiring, borrowing and exchange of animals for conservation, rearing and propagation for non-commercial purposes between the park and domestic and foreign organizations and individuals must comply with current regulations; the park may receive confiscated animals according to law.
c/ Investment capital:
- State budget capital, including targeted support for programs (forest protection and development; transport; irrigation and clean water program; government bond; etc.); official development assistance (ODA); lawful support of non-governmental organizations; and local budget capital (ground clearance funds, etc.);
- The Plan shall be integrated with other programs in the locality so as to improve overall socio-economic and environmental protection effectiveness.
- Capital raised from non-state sectors: Resources of participating enterprises shall be used for investment in service projects and items;
- Capital raised from other lawful sources.
d/ Infrastructure construction:
Projects on construction of technical infrastructure systems connected to the park’s technical infrastructure systems, including roads and electricity and water supply facilities; water drainage and solid waste treatment in the wildlife park.
Article 2. Organization of implementation
1. The Ministry of Agriculture and Rural Development shall:
a/ Assume the prime responsibility for, and coordinate with ministries and sectors in, guiding, inspecting, supervising the implementation of the Plan in order to ensure fulfillment of approved objectives and items;
b/ Coordinate with the Ministry of Planning and Investment, the Ministry of Finance and the People’s Committee of Ninh Binh province in integrating programs and projects in order to ensure funding sources for implementation of the Plan’s component projects.
2. The Ministry of Planning and Investment shall:
a/ Assume the prime responsibility for, and coordinate with ministries, sectors and the
People’s Committee of Ninh Binh province in, promoting investment and calling for assistance from domestic and international donors for Ninh Binh province to implement the Plan;
b/Assume the prime responsibility for, and coordinate with related ministries and sectors in, balancing and allocating state budget capital from the sources of medium-term and annual targeted support for Ninh Binh province to implement the Plan;
c/ Inspect and supervise the management and use of state budget capital and implementation of the Plan according to regulations.
3. The Ministry of Finance shall:
a/ Allocate non-business funds from the central budget for Ninh Binh province to implement the Plan;
b/ Coordinate with the Ministry of Planning and Investment and related ministries and sectors in balancing and allocating medium-term and annual targeted support from the central budget for Ninh Binh province to implement the Plan;
c/ Guide, inspect and supervise the management and use of support funds allocated from the state budget according to regulations.
4. Related ministries and sectors shall, based on their assigned functions and tasks, coordinate with the People’s Committee of Ninh Binh province in effectively performing the state management in the course of organizing the implementation of the Plan.
5. The People’s Committee of Ninh Binh province shall:
- Decide on the investment in the Plan’s component projects.
- Direct and organize the implementation of the Plan, ensuring its objectives, contents and implementation schedule.
- Organize the formulation, appraisal and approval of master plans and detailed plans on construction of zones of the wildlife park; conduct environmental impact assessment for component projects of the Plan; and carry out ground clearance work according to the Plan’s implementation schedule.
- Consolidate the organizational apparatus of the Wildlife Park Management Board in order to perform tasks set in the Plan according to its competence and current regulations.
- Coordinate with the Ministry of Planning and Investment and related ministries and sectors in calling for investment capital for the Plan.
- Report problems arising in the course of implementation of the Plan to related ministries and sectors for settlement; report matters falling beyond its competence to the Prime Minister for consideration and decision; review and evaluate the plan implementation; and annually report the implementation results to the Prime Minister.
Article 3. This Decision takes effect on the date of its signing.
Article 4. The Ministers of Planning and Investment; Finance; Agriculture and Rural Development; Construction; and Natural Resources and Environment, heads of ministerial-level agencies, heads of government-attached agencies, the Chairperson of the People’s Committee of Ninh Binh province, and related agencies and units shall implement this Decision.-
