DECISION

TAKING MEASURES TO TREAT ASH, SLAG AND GYPSUM FROM THERMAL POWER, CHEMICAL OR FERTILIZER PLANTS FOR THE PRODUCTION OF BUILDING MATERIALS

THE PRIME MINISTER

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to the Government’s Decree No. 124/2007/NĐ-CP dated July 31, 2007 on managing building materials;

At the request of the Minister of Construction,

HEREBY DECIDES

Article 1. To regulate several measures to be taken to treat ash, slag and gypsum from thermal power, chemical or fertilizer plants for the production of building materials with the main contents as follows:

1. Objectives

- Treat ash, slag and gypsum from thermal power, chemical or fertilizer plants to meet technical regulations and standards to become materials used for building material production, minimize environment pollution, save space for landfill sites, make contribution towards reducing exploitation of natural resources for building materials, ensure the sustainable development; 

- Outline the roadmap to complete installation of line equipment for treatment of ash, slag and gypsum that can meet technical regulations and standards to become materials for building material production at thermal power, chemical or fertilizer plants;   

- Increase an amount of domestic gypsum used as materials for building material production in order to gradually reduce and restrict imported gypsum.  Create the market in ash, slag and gypsum to be treated for building material production.

2. Implementation roadmap

- With regard to thermal power, chemical or fertilizer plants that currently operate or obtain the investment decision, the plan to invest in (or cooperate on investment in) installing line equipment for treatment of ash, slag and gypsum that can meet technical regulations and standards for building material production and bring these into operation by 2020 must be prepared; 

- With regard to thermal power, chemical or fertilizer plants which are newly developed and expanded or renovated, the approved project is required to show the design of uniform line equipment for treatment of ash, slag and gypsum that can meet technical regulations and standards for building material production;

- By 2020, space used for landfill sites shall be only allocated to thermal power, chemical or fertilizer plant projects with the maximum capacity that can meet treatment requirements in conformity with the project size and output;

3. Implementation measures

- Provide additional provisions on the fundamental design of thermal power, chemical or fertilizer plant projects, under which ash, slag and gypsum treatment stage must be provided with the complete design and the plan to collect ash, slag and gypsum must be formulated as well; complement requirements for project assessment by the additional criteria for treating ash, slag and gypsum at thermal power, chemical or fertilizer plants; review and supplement regulations on the acreage and useful life of ash, slag and gypsum landfill sites;      

- Identify the unusable space of landfill sites after installation of line equipment used for treatment of ash and slag in order to transform the use purpose of such space;

- Consider supplementing the list of main mechanical products with mechanical engineering products which are domestically manufactured to install line equipment for treatment of ash, slag and gypsum in accordance with the Prime Minister’s Decision No. 10/2009/QĐ-TTg dated January 16, 2009 and the Prime Minister’s Decision No. 1791/QĐ-TTg dated November 29, 2012 on adopting pilot policies on domestic design and production of equipment for thermal power plants in the period from 2012 to 2025;

- Prioritize and support ash, slag and gypsum treatment and utilization of post-treatment finished products as building materials in the same manner as other solid waste treatment activities (recycling or reusing processes) in accordance with applicable laws on solid waste management;    

- Hold owners of thermal power, chemical or fertilizer plant projects liable for expenses incurred from treatment of ash, slag and gypsum in case they do not invest in installation of line equipment for treatment of ash, slag and gypsum used for building material production;     

- Enhance research and renovation of technical sciences and technologies to be applied to treat ash, slag and gypsum at thermal power, chemical and fertilizer plants;

- Encourage other industrial workshops that emit ash, slag and gypsum to carry out treatment of ash, slag and gypsum in accordance with regulations laid down in this Decision.

Article 2. Implementation

1. The Ministry of Construction:

- Disseminate and implement this Decision and send annual reports to the Prime Minister on using ash, slag and gypsum for building material production;

- Preside over and cooperate with the Ministry of Science and Technology and relevant agencies in issuance of technical regulations and standards concerning use of ash, slag and gypsum collected from thermal power, chemical and fertilizer plants for the purpose of building material production; 

- Conduct scientific researches on production of various types of materials from ash, slag and gypsum collected from thermal power, chemical and fertilizer plants; identify potential sources of ash, slag and gypsum to be treated in different periods in order to draw up the plan for reasonable and effective use.

2. The Ministry of Industry and Trade;

- Preside over and cooperate with the Ministry of Construction and relevant agencies in implementation, supervision and inspection of the implementation of this Decision; submit periodic and spontaneous report to the Prime Minister;

- Research, amend and provide additional provisions on the fundamental design of thermal power, chemical or fertilizer plant projects, under which ash, slag and gypsum treatment stage must be provided with the complete design and the plan to collect ash, slag and gypsum must be formulated as well; complement requirements for project assessment by the additional criteria for treating ash, slag and gypsum at thermal power, chemical or fertilizer plants; review and supplement regulations on the acreage and useful life of ash, slag and gypsum landfill sites in 2015;  

- Direct owners of thermal power, chemical and fertilizer plant projects to implement this Decision;

- Consider submitting the list of domestically-made mechanical products used for installing line equipment for treatment of ash, slag and gypsum to the Prime Minister for his consideration to decide to supplement the list of main mechanical products with domestically-made mechanical products used for treatment of ash, slag and gypsum in accordance with the Prime Minister’s Decision No. 10/2009/QĐ-TTg dated January 16, 2009 and the Prime Minister’s Decision No. 1791/QĐ-TTg dated November 29, 2012 on adopting pilot policies on domestic design and production of equipment for thermal power plants in the period from 2012 to 2025;

3. The Ministry of Natural Resources and Environment:

- Preside over and cooperate with the Ministry of Industry and Trade and the Ministry of Construction in conducting the careful study or submitting the request to competent authorities for approval of the roadmap to gradually reducing and limiting importation of gypsum and stopping importation of various types of ash and slag used for building material production; 

- Preside over and cooperate with the Ministry of Industry and Trade in reviewing and adjusting supplement to regulations on management of solid wastes produced by thermal power, chemical and fertilizer plants.

4. The Ministry of Science and Technology:

- Assess technical regulations and standards concerning the use of ash, slag and gypsum used for building material production, and introduce the national standards in accordance with legal regulations;

- Offer their support for tasks of conducting nationally-ranked scientific researches on measures to treat and use ash, slag and gypsum from thermal power, chemical and fertilizer plants for the production of building materials.

5. The Ministry of Planning and Investment:

- Preside over and cooperate with relevant Ministries and agencies in conducting careful study on incentive policies on using domestically-made products for line equipment for treatment of ash, slag and gypsum.

6. The Ministry of Finance:

Provide their guidance on implementing incentive or subsidization policies on treatment of ash, slag and gypsum from thermal power plants and chemical fertilizer plants for the production of building materials.

7. Ministries: Transportation, Agriculture and Rural Development:

Cooperate with the Ministry of Construction in drawing up the plan to use ash, slag and gypsum for traffic construction works, dykes, embankments, hydropower, irrigation works and others.

8. The People’s Committee of centrally-affiliated cities and provinces:

- Cooperate with relevant Ministries and agencies in implementation of this Decision at these localities;

- Provide their guidance on change in use purpose of the landfill site that exceeds the regulatory standards;

- Intensify dissemination activities and encourage building material workshops located in these areas to use ash, slag and gypsum for their building material production;

- Submit annual reports to Ministries such as Construction, Industry and Trade, Natural Resources and Environment on implementation of this Decision in these localities.

Article 3. This Decision shall take effect from the signing date.

Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Presidents of People’s Committees of central-affiliated cities and provinces, President of the Member Assembly, General Directors of Economic Groups or State-owned Incorporations shall be responsible for implementing this Decision./.
