DECISION

ANNOUNCING BEN DAM FISH PORT FOR DOMESTIC AND FOREIGN SHIPS TO ENTER AND EXIT FOR CARGO HANDLING

THE MINISTER OF COMMUNICATIONS AND TRANSPORT

Pursuant to Article 57 of Vietnam Maritime Code of June 30, 1990;
Pursuant to the Government's Decree No. 34/CP of April 4, 2003 prescribing the tasks, powers, State management responsibilities and organizational apparatus of the Ministry of Communications and Transport;
Pursuant to the Government's Decree No. 13/CP of February 25, 1994 promulgating the Regulation on the management of maritime activities at seaport and maritime zones in Vietnam and Decree No. 24/2001/ND-CP of May 30, 2001 amending and supplementing a number of articles of the Regulation on management of maritime activities at seaports and maritime zones in Vietnam, issued together with the Government's Decree No. 13/CP of February 25, 1994;
Proceeding from to the Prime Minister's opinions in the Government Office's Official Dispatch No. 2600/VPCP of May 27, 2003;
Considering Report No. 108/TT.BQL of May 27, 2003 of Ben Dam Port Management Board applying for the announcement of Ben Dam fish port for foreign ships to enter and exit for cargo handling, and relevant dossiers;
At the proposals of the director of the Legal Department and the director of Vietnam Maritime Bureau,

DECIDES:

Article 1.- To permit Ben Dam fish port under Ben Dam Port Management Board, Con Dao district, Ba Ria-Vung Tau province, to receive domestic and foreign ships of a tonnage of up to 2,000 DWT entering and exiting for cargo handling.

The position for pilot embarkation and disembarkation and quarantine of Ben Dam fish port shall be specified as follows:

Latitude: 08^o40'30'' N; Longitude: 106^o32'42''E.

Article 2.- Vung Tau Port Authority shall have to exercise the specialized State management over maritime activities in the area of Ben Dam fish port and, basing itself on the practical situation of port berth, navigable channels and depth limit of the water areas in front of the port berth, as well as the weather conditions to permit ships and boats having suitable technical parameters to enter and exit this port berth for cargo handling so as to ensure safety, and be entitled to collect charges according law provisions.

Article 3.- Ben Dam Port Management Board, Con Dao district, Ba Ria-Vung Tau province shall have to manage and organize the exploitation of port berths in strict accordance with the approved designs, in a safe manner, for the right economic purposes, and be entitled to collect charges according to law provisions.

Article 4.- The State management agencies of concerned specialized branches shall perform their tasks and exercise their powers in the area of Ben Dam fish port according to law provisions.

Article 5.- This Decision takes effect 15 days after its publication in the Official Gazette.

Article 6.- The director of the Ministry's Office, the directors of the Departments under the Ministry, the director of Vietnam Maritime Bureau, the director of the Communications and Transport Service of Ba Ria-Vung Tau province, the director of Vung Tau Port Authority, the director of Ben Dam Port Management Board, the heads of concerned agencies and organizations as well as concerned individuals shall have to implement this Decision.
