DECISION
APPROVING THE PLANNING FOR SPECIAL-USE FOREST SYSTEM ACROSS THE COUNTRY TO THE YEAR 2020, AND A VISION TO 2030
THE PRIME MINISTER
Pursuant to the Law on organization of Government dated December 25, 2001;
Pursuant to the Law on Forest Protection and Development dated December 03, 2004;
Pursuant to the Government’s Decree No. 117/2010 / ND-CP dated December 24, 2010 organizing and managing special-use forest system;
Pursuant to Decision No. 218 / QD-TTg dated February 07, 2014 of the Prime Minister approving the strategy for managing special-use forest system, marine reserves, Vietnam inland waters conservation areas by 2020, with a vision to 2030;
At the request of the Minister of Agriculture and Rural Development,
DECIDES:
Article 1. Approving the planning for special-use forest system across the country to the year 2020, and a vision to 2030 as follows:
1. Planning objectives
a) General objectives:
Preserve and maintain sustainable development for significant natural ecosystem, valuable natural landscape, historical – cultural remains, scenic beauties, and endangered, rare and precious wildlife in the special-use forest system.
b) Particular objectives:
- By 2020, area of special-use forest shall be increased to 2.4 million ha from current 2.2 million ha to conform to the strategy of managing special-use forest system, marine protected areas, Vietnam inland waters conservation areas by 2020, with a vision to 2030 as set out in the Prime Minister’s Decision No. 218/QD-TTg dated February 07, 2014;
- Check, adjust and supplement the planning for special-use forest to meet the criteria as specified in Article 5 of the governmental Decree No. 117/2010 / ND-CP dated December 24, 2010 on organization and management of special-use forest system (hereafter referred to as Decree No.117/2010/ND-CP);
- Complete marking the boundary of functional and buffer zones of special-use forests; define land area planned for the purposes other than the purposes of the planning for special-use forest system in order to harmonize protection of forests, environment, nature reserve and endangered, rare and precious animals.
2. Contents of planning
a) Review and adapt the planning for 164 special-use forests to the planning for three forest types as defined in the Prime Minister’s Directive No. 38/2005/CT-TTg dated December 05, 2005 and consistent with the classification of forests to meet the prescribed criteria and ensure that the special-use forest system across the country by 2020 reaches 2.4 million ha, including 34 national parks, 58 nature reserves, 14 habitat /species conservation areas, 61 protected landscape areas and other forests used for scientific research and experiment by nine entities (See attached Appendix I)
b) Regional planning:
- Northwestern region: Protecting the ecosystems of low and medium mountain forests, rare, precious and endangered animals and plants such as tigers (Panthera tigris corbetti), elephants (Elephas maximus), fujian cypress (Fokienia hodginsii), Sam lanh (Abies delavayi var. nuliangensis), Thong Pa Co (Pinus kwangtungensis) and other rare species in special-use forests with a total area of approximately 222,000 ha, including:
+ Transition of 10 nature reserves, one protected landscape area; adjustment to decrease 1,114 ha of Ba Vi National Park and hand it over to People’s Committee of Hoa Binh Province for management and use; the area planned for the forests used for scientific research and experiment by the Northwest Center for forestry science is 332.7 ha.
+ Establishment of Muong La nature reserve with an area of approximately 17,000 ha for conservation of forest ecosystem, biodiversity and protection of valley of Son La hydroelectric plant;
+ Removal of a 150-ha forest used for scientific research and experiment by Center for Application Forest technology & science in Hoa Binh Province.
- Northeastern region: Protect the eco-area transitioned from continental shelf across lowland area, to low, medium and high mountains; Conserve forest ecosystem associated with place-names such as Ha Long Bay, Tam Dao Mount, Ba Be Lake, Hoang Lien Son Range – Sapa,... and a lot of other rare and precious species such as Hoang Dan (Cupressus torulosa), Lat Hoa (Chukrasia tabularis), Dinh (Markhamia stipulata), Nghien (Burretiodendron hsienmu), Trai (Garcinia fagraeoides), snub-nosed langurs (Rhenopithecus avunculus), Cat Ba langurs (Trachypithecus poliocephalus poliocephalus), musk deer (Moschus berezovxki), Tam Dao salamander (Paramesotriton deloustali) with a total area of approximately 400,000 ha, including
+ Transition of 37 existing special-use forests, including: five national parks, 13 nature reserves, three habitat /species conservation areas, 14 protected landscape areas and two forests used for scientific research and experiment.
+ Establishment of nature reserves (Bat Xat in Lao Cai Province, Nui Coc Lake in Thai Nguyen Province and Chi San in Ha Giang Province); two habitat / species conservation areas (Mau Son, Bac Son in Lang Son Province); five protected landscape areas (Ma Pi Leng in Ha Giang Province, Mo Spring in Bac Giang Province, Ha Long Forest, Yen Lap historical and cultural forest, Dong Trieu historical and cultural area in Quang Ninh Province) and one forest used for scientific research and experiment by North Central Center for forestry science;
+ Conversion of Pia Oac – Phia Den nature reserve into Pia Oac – Phia Den national park in Cao Bang Province; Merge Du Gia nature reserve with Khau Ca species sanctuary to form Du Gia national park, Dong Van stone plateau for conservation of limestone forest ecosystem, rare and precious species, especially snub-nosed langurs and natural heritage of Dong Van stone plateau.
+ Removal of one forest used for scientific research and experiment in Ha Long City;
- Red River Delta: Protect ecosystem of limestone forests associated with rare species such as Delacour’s langurs (Trachypithecus francoisi delacouri) in Ninh Binh Province; Conserve forest ecosystem associated with submerged land ecosystems such as Xuan Thuy national park in Nam Dinh Province, Tien Hai nature reserve in Thai Binh Province; Conserve forests associated with cultural and historical remains, environmental landscapes in Hanoi City, Ninh Binh, Hai Duong and Nam Dinh provinces with a total area of approximately 65,000 ha, including:
+ Transition of 14 existing special-use forests, including four national parks, two nature reserves, six protected landscape areas and two forests used for scientific research and experiment;
+ Establishment of Kinh Mon protected landscape forest in Hai Duong Province with an area of approximately 323 ha;
- North Central Coast: Protect ecosystem of limestone forests, rare and endangered species such as tigers (Panthera Tigris corbetti), elephants (Elephas maximus), Asian biocorn (Pseudoryx nghentinhensis), giant muntjac (Muntiacus vuquangensis), Truong Son Muntjac (Muntiacus truongsonensis), primates: Ha Tinh langurs (Trachypithecus laotum hatinhensis), red-shanked douc (Pygathrix nemaeus) in special-use forests with a total area of approximately 614,000 ha, including:
+ Transition of 17 existing special-use forests, including five national parks, nine nature reserves, two protected landscape areas and one forest used for scientific research and experiment;
+ Planning and establishment of Nam Dong gymnosperm reserve and Tam Quy bassia reserve in Thanh Hoa Province; eight protected landscape areas, including: Ba Trieu temple, Lam Kinh, Ham Rong, Truong Le Mount in Thanh Hoa Province, Sang Le (Lagerstroemia tomentosa) in Tuong Duong Nam Dan and Yen Thanh communes in Nghe An Province and Than Dinh Mount in Quang Binh Province;
+ Conversion of Asian biocorn reserve in Thua Thien Hue Province into nature reserve in Thua Thien Hue Province;
- South Central Coast: Protect forest ecosystem, coral reefs, sea grass beds, rare and endangered species such as tigers (Panthera tigris corbetti), elephants (Elephas maximus), Asian bicorn (Pseudoryx nghentinhensis), giant muntjac (Muntiacus vuquangensis), Ngoc Linh ginseng (Panax vietnamensis) in Quang Nam Province; forest protection associated with conservation of historical monuments, landscape and environment, with a total area of approximately 233,000 ha, including:
+ Conversion of 14 existing special-use forests including eight nature reserves and six protected landscape areas;
+ Establishment of two habitat /species sanctuaries for Asian biocorn and elephants in Quang Nam Province and three protected landscape areas including My Son historical and cultural area (Holy land), Nui Thanh Victory area and Nam Tra My cultural and historical area in Quang Nam Province;
- Central Highlands: Protect forest ecosystem of medium mountains (Ngoc Linh, Chu Yang Sin), semi-deciduous forest, deciduous dipterocarp forest of Dipterocarpaceae (dipterocarp forest); flat-leaf pine (Ducampopinus krempfii), 5-leaf pine (Pinus dalatensis), Po Mu (Fokienia hodginsii), Bach Xanh (Calocedrus macrolepis), Sam Bong (Amentotaxus poilanei), elephant (Elephas maximus), Banteng (Bos javanicus), gayals (Bos gaurus), Eld's deer (Cervus eldi) with a total area of approximately 510,000 ha, including:
+ Transition of 19 existing special-use forests, including five national parks, five nature reserves, two habitat /species sanctuaries, two protected landscape areas and five forests used for scientific research and experiment.
+ Conversion of Ta Dung nature reserve in Dak Nong Province into Ta Dung national park;
+ Merging species reserves in Trấp K'sơ and Ea Ral into Chinese swarm cypress reserve and transfer to a management entity the planning for five forests for scientific research and experiment in Lam Dong, Dak Nong and Gia Lai provinces.
- Southeast Region: Protect typical ecosystems of island forests, coastal forests, rare and endangered species such as tigers (Panthera tigris corbetti), elephant (Elephas maximus), gayals (Bos gaurus), banteng (Bos javanicus), Barian kingwood (Dalbergia olivery), Red wood (Sindora siamensis), Siamese Rosewood (Dalbergia tonkinesis), Burma Padauk (Pterocarpus macrocarpus) in special-use forests with a total area of approximately 271,000 ha, including:
+ Transition of 16 existing special-use forests, including six national parks, four nature reserves, five protected landscape areas and merging four forests for scientific research and experiment.
- Southwest Region: Protect ecosystem of mangrove forests; coral reefs, sea grass beds; ecosystem of cajuput forests in Tram Chim, U Minh, Tra Su, Ca Mau with a total area of approximately 95,000 ha, including:
+ Transition of 18 existing special-use forests, including five national parks, two nature reserves, three habitat /species sanctuaries, seven landscape protected areas, one forest for scientific research and experiment by Southern Academy of Forestry Science;
+ Establishment of That Son national park in An Giang Province with an area of approximately 14,000 ha and one forest for scientific research and experiments by Southern Academy of Forestry Science;
+ Conversion of Lung Ngoc Hoang habitat/species sanctuaries into nature reserve;
+ Conversion of Thach Phu nature reserve in Ben Tre Province and Hon Chong nature reserve into protected landscape area;
+ Conversion of Canh Dien nature reserve in Bac Lieu Province into the habitat/species sanctuary;

3. Planning implementation
a) Review, detailed planning, grade transition and establishment
- Preparation of dossier for the submission to the competent authorities for approval: Conversion of three nature reserves into national park; establishment of one national park, four nature reserves, six habitat /species sanctuaries and 16 protected landscape areas;
- Review and planning for measures for protection of forest, nature and biodiversity, for restoration of ecosystem, embellishment of natural landscape, conservation of cultural and historical values and environment in special-use forests established according to the objectives of conservation and sustainable development by 2020.
b) Fulfillment of policy mechanism and law enforcement
- Carry out studying, constructing, making supplements and amendments and timely issuance of legal documents concerning management of special-use forest system; Evaluate and identify overlapping problems; prepare roadmap for amendment and proposal of legal documents to ensure consistence and efficiency;
- Construct and promulgate criteria, classification and functional zoning suitable for each special-use forest type;
- Evaluate and complete general regulations on policies on sharing benefits from the services in special-use forests. By 2010, special-use forests will have been placed under new management to let organizations and individuals receiving benefits from the special-use forests be responsible for the conservation and sustainable development for the forests;
- Promulgate regulations on the inspection and monitoring of forest resources and biodiversity in special-use forests for conservation and effective prevention of illegal deforestation, encroachment, conversion of use purposes with respect to special-use forests;
c) Financial assurance for planning
- The State shall ensure budget for the review, detailed planning, conversion and establishment of special-use forests by 2020 in the 2011-2020 plan for forest protection and development enclosed together with the Prime Minister’s Decision No. 57/QD-TTg dated 09 January, 2011;
- Expenses for investment and development of special-use forests and buffer zones shall be responsible for by state budget under the Prime Minister’s Decision No. 24/2012/QD-TTg dated June 01, 2012 on policies for investment and development of special-use forests in the 2011-2020 period;
- The state budget used for investment in special-use forests shall comprise central and local budgets to be allocated according to the provisions of the Law on state budget;
- Encourage involvement of communities and enterprises in the investment in scientific research and development of eco-tourism for special-use forests. Priority shall be given to the formulation of mechanisms to create stable financial sources and allow the mobilization of different financial sources, especially from forest services, contribution of enterprises and concerned parties toward socialization of revenues for effective conservation of special-use forests.
- The State shall invest in infrastructure, training for human resources, supports for international cooperation activities and scientific research, trying to lessen dependence on the state budget and heighten autonomy in management of special-use forests.
d) Strengthen management human resources
For special-use forests with a management system being established by competent authorities, the supply of resources, equipment and infrastructure must be prioritized to ensure effective operation and significant contribution to the success of the management strategy for special-use forest system, marine protected areas, inland waters conservation areas under the Prime Minister’s Decision No. 218/QD-TTg dated February 07, 2004 . Training in professional skills in law enforcement should be provided to the management boards of special-use forests; enhancing awareness about responsibility and coordination among local authorities and residential communities in buffer zone of special-use forests;
4. Planning implementation
a) Central ministries and sectors
- The Ministry of Agriculture and Rural Development shall cooperate with the Ministry of Planning and Investment, the Ministry of Finance, the People's Committees of provinces and cities in executing this Decision; instructing local authorities to review, make detailed planning, convert and establish special-use forests under the approved planning; preparing the plans for inspecting and monitoring the implementation of special-use forest planning at localities; making a report to the Prime Minister on the implementation of special-use forest system planning in the country.
- The Ministry of Planning and Investment shall be responsible for balancing the investment capital for the implementation of the planning under the annual plan; allocating adequate investment capital for the implementation of the planning; mobilizing international assistance for the conservation of nature, and biodiversity in special-use forests.
- The Ministry of Finance shall be responsible for balancing and allocating adequate non-business expenditures for the implementation of the planning under the annual plan; providing guidance on mechanisms of allocation, management,, payment and final settlement of funding for the implementation of the planning as prescribed by the Law on state budget;
- The Ministry of Natural Resources and Environment shall be responsible for working closely with the Ministry of Agriculture and Rural Development and the related ministries and sectors in the implementation of duties within their scope, responsibility and power; incorporating the planning for special-use forest system into the overall biodiversity planning across the country by 2020, and a vision to 2030;
- The central Ministries and sectors within their functions and duties shall be responsible for coordinating with the Ministry of Agriculture and Rural Development to effectively implement such planning.
b) People’s Committees of central-affiliated provinces and cities
- Implement the planning for special-use forest system in the administrative divisions under their management;
- Carry out the review, detailed planning, conversion and establishment of special-use forests; complete marking the boundary of functional and buffer zones of special-use forests after being approved by competent authorities;
- Mobilize and allocate capital sources in the locality to implement the planning effectively; monitor the conservation and sustainable development of forest resources and biodiversity in special-use forests;
- Make periodical reports on the implementation of special-use forest system to the Ministry of Agriculture and Rural Development for finalization and making report to the Prime Minister as regulated.
Article 2. This Decision takes effect since the date of signing.
Article 3. The Minister of Agriculture and Rural Development, the Minister of Planning and Investment, the Minister of Finance, the Minister of Natural Resources and Environment, heads of relevant governmental agencies, Presidents of People's Committees of central-affiliated provinces and cities, and heads of relevant agencies shall be responsible for executing this Decision. /.
