DECISION

PROMULGATING THE WORKING REGULATION OF THE NATIONAL COMMITTEE FOR INTERNATIONAL ECONOMIC COOPERATION

THE CHAIRMAN OF THE NATIONAL COMMITTEE FOR INTERNATIONAL ECONOMIC COOPERATION

Pursuant to the Law on Organization of the Government of December 25, 2001;
Pursuant to the Prime Minister's Decision No. 70/2002/QD-TTg of June 6, 2002 on consolidation of the National Committee for International Economic Cooperation;
Pursuant to the Prime Minister's Decision No. 1037/QD-TTg of November 11, 2002 appointing members to the National Committee for International Economic Cooperation;
At the proposal of the General Secretary of the National Committee for International Economic Cooperation,

DECIDES:

Article 1.- To issue together with this Decision the Working Regulation of the National Committee for International Economic Cooperation.

Article 2.- This Decision takes effect 15 days after its publication on the Official Gazette and replaces Decision No. 118/1998/QD-TTg of July 8, 1998 for the performance of the functions, tasks and powers prescribed in the Prime Minister's Decision No. 70/2002/QD-TTg of June 6, 2002.

Article 3.- The Chairman of the National Committee for International Economic Cooperation, the ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, and the presidents of the People's Committees of the provinces and centrally-run cities shall have to implement this Decision.

THE WORKING REGULATION

OF THE NATIONAL COMMITTEE FOR INTERNATIONAL ECONOMIC COOPERATION
(Issued together with Decision No. 20/QD-UBQG of February 19, 2003 of the Chairman of the National Committee for International Economic Cooperation)

Chapter I

ASSIGNMENT OF RESPONSIBILITIES

Article 1.- The Chairman of National Committee for International Economic Cooperation (hereinafter called the Committee for short)

The Chairman of the Committee shall have the tasks:

1. To direct the implementation of the Government's programs, plans and strategies on international economic integration, which falls under the Committee's functions and tasks;

2. To decide to convene, preside over and conclude meetings of the Committee and the Committee's standing body; convene the heads of other concerned agencies and individuals to attend the Committee's meetings when necessary;

3. To assign tasks to the Vice Chairman, the General Secretary, the standing member and each member of the Committee; to organize the coordination among the Committee's members as well as between the Committee and ministries, branches as well as localities for the implementation of the Committee's general tasks; to urge and inspect the implementation of the tasks already assigned to the Committee's members.

Article 2.- The Committee's Vice Chairman

The Committee's Vice Chairman shall have the tasks:

1. To assist the Committee's Chairman in directing the organization of implementation of the Committee's tasks; to settle matters falling under the Committee Chairman's jurisdiction when he is absent for working missions or under his authorization;

2. To direct the work of the Government's Delegation for International Economic-Trade Negotiations;

3. On behalf of the Committee's Chairman, to convene and preside over meetings to discuss plans for international economic-trade negotiations, reach agreement on negotiation contents with the concerned ministries and branches before submitting them to the Prime Minister for approval;

4. To direct the study and evaluation of the regional and international economic situation, sum up economic-trade cooperation programs and activities of regional or international economic-trade organizations, of which Vietnam is a member; to work out Vietnam's cooperation policies, strategies and programs in such organizations;

5. To perform other tasks assigned by the Committee's Chairman.

Article 3.- The Committee's General Secretary and also head of the Government's negotiation delegation

The Committee's General Secretary shall have the tasks:

1. To work out programs and prepare contents of the Committee's meetings;

2. To prepare the Committee's reports and submit them to the Government and/or the Prime Minister; and to assist the Committee's Chairman and Vice Chairman in settling the Committee's professional matters;

3. To organize the monitoring and evaluation of the implementation of the international economic integration work by the ministries, branches, localities and enterprises;

4. To coordinate activities of the ministries, departments, branches and localities in the training, propagation and dissemination of the information and knowledge about international economic integration as well as Vietnam's commitments in the regional and international economic-trade organizations;

5. To direct the implementation of technical assistance and human resource training projects financed by the governments of other countries and international organizations, which are related to international economic integration and fall under the Committee's tasks;

6. To direct the operation of the Committee's Office;

7. To exercise the functions and powers of the head of the Government's delegation for international economic-trade negotiations as prescribed in the Prime Minister's Decision No. 116/1998/QD-TTg; to assist the Committee's Chairman and Vice Chairman in directing the elaboration of schemes and plans and to negotiate international economic-trade agreements;

8. To perform other tasks assigned by the Committee's Chairman and Vice Chairman.

Article 4.- The Committee's standing member

The Committee's standing member, who is a deputy-director of the Government's Office, shall have the tasks:

1. To report on the Committee's proposals to the Prime Minister, announce the Prime Minister's directing opinions on the Committee's proposals and other matters related to the Committee's operation;

2. To organize meetings aiming to unify divergent opinions among the ministries, branches, localities and enterprises in the implementation of the Government's programs of action on international economic integration, when so assigned by the Committee's Chairman;

3. To direct the Committee Office's operation when the Committee's General Secretary is absent;

4. To perform other tasks assigned by the Committee's Chairman.

Article 5.- The Committee's standing body

The Committee's standing body is composed of the Chairman, Vice Chairman, General Secretary and standing member, having the task to settle urgent issues or matters which do not require the settlement at the Committee's plenary meeting.

Article 6.- The Committee's members

The Committee's members shall have the tasks:

1. To represent their ministries or branches to participate in the Committee's activities and perform the tasks assigned by the Committee's Chairman according to the professional domains managed by their respective ministries or branches, and be answerable to the ministers, the heads of their agencies and the Committee's Chairman for the performance of such tasks;

2. To fully attend the Committee's meetings, to join the Committee's collective in considering and deciding on the matters related to the Committee's operation. To implement the Committee Chairman's conclusion opinions related to the domains managed by their respective ministries or branches;

3. The Committee's members shall work on a part-time basis, having the responsibility to perform the tasks assigned by the Committee's Chairman and reporting to him periodically or at his request on the work of international economic integration, which falls under the management of their respective ministries or branches.

Article 7.- The Committee's Office

The Committee's Office shall have the tasks:

1. To assist in preparing contents and organizing meetings of the Committee and the Committee's standing body;

2. To coordinate with the international economic integration main bodies of the ministries, branches and localities in organizing and carrying out the Committee's activities;

3. To regularly and promptly inform the Committee's members of the international economic integration-related activities being or to be carried out by the ministries, branches and Committee's members;

4. To notify matters related to the Committee's operation and work coordination to the concerned agencies for implementation;

5. To perform the Committee's administrative-clerical work and manage its seal.

Chapter II

WORKING AND WORK-COORDINATION REGIMES

Article 8.- The Committee's working regime

1. Every three-month plenary meeting, irregular meeting and/or meeting of the Committee's standing body constitute the main form of the Committee's operation. These meetings are organized at the Government's Office.

2. Meetings between the international economic integration main bodies of the ministries, branches and localities are organized to discuss the coordination in performance of the Committee's tasks. The Committee's Office shall have to prepare contents and material bases, and organize such meetings.

3. The Committee Chairman's conclusions at the Committee's meetings, which are related to the Government's undertakings, policies, strategies, plans and programs on international economic integration, general undertakings and negotiation schemes as well as other executive works, shall be summed up and submitted to the Committee's Chairman by the Committee's Office. After obtaining the Committee Chairman's opinions, the Committee's standing member shall notify them to the concerned agencies for implementation thereof.

Article 9.- Work coordination regime

The ministries and branches shall carry out international economic integration activities in the assigned domains and have the responsibility to coordinate with one another in the performance of work.

Article 10.- Reporting and information provision regime

1. The ministries, branches, localities and enterprises shall, according to their assigned functions and tasks, report, annually or as requested, on the implementation situation and results of the Government's programs of action on international economic integration to the Committee.

2. The ministries and branches shall have to report in time to the Committee on the contents, programs and schemes for participation in, as well as results of, conferences within the framework of the Association of Southeast Asian Nations (ASEAN), the Asian-European Meeting and the Asian-Pacific Economic Cooperation Forum (APEC) which they have attended; on negotiations for joining and operating in the World Trade Organization (WTO) as well as other international and regional economic-trade organizations; and on problems arising in cooperation with international and regional economic-trade organizations under their charge.

Article 11.- Clerical and administrative work

The Committee's seal shall be used for the Committee's official dispatches related to administrative work. The Committee's Chairman, Vice Chairman and standing member shall use the Government's seal for official dispatches related to the administration of a number of the Committee's activities prescribed in Clause 1, Article 4 of this Regulation.

Article 12.- Operation funds and material bases

1. The Committee's operation funds include operation funds of the Committee's Office and the Government's Negotiation Delegation.

2. The Committee's operation funds shall be allocated from the State budget into a separate account and included into the Trade Ministry's funds. The Committee's Office shall have to use the Committee's funds according to the current financial and accounting regime.

3. The Ministry of Trade shall provide fund, location, working facilities and other material conditions for the Committee's Office in service of its operation, the Government's Delegation for International Economic-Trade Negotiations and its technical assistance group.
