DECISION
PROMULGATING THE TABLE OF PROPHYLACTIC MEDICINE CHARGES AND FEES
THE MINISTER OF FINANCE
Pursuant to the Government’s Decree No.15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and the ministerial-level agencies;
Pursuant to the Government’s Decree No.178/CP of October 28, 1994 on the tasks, powers and organizational structures of the Ministry of Finance;
Pursuant to the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget;
Pursuant to the Health Minister’s decision defining the functions, tasks and organizational structure of the Prophylactic Medicine Center, prophylactic medicine teams, the National Center for State expertise of bio-products, research institutes and other prophylactic medicine establishments of the system of prophylactic medicine bodies;
After obtaining opinions of the Health Ministry (Official Dispatch No.9489/YT-TCKT of December 21, 1999) and at the proposal of the General Director of Taxation,
DECIDES:
Article 1.- To promulgate together with this Decision the Table of prophylactic medicine charges and fees for uniform application nationwide.
1. The prophylactic medicine charge and fee levels prescribed in this Article shall apply at prophylactic medicine establishments being State management bodies or non-business units of the prophylactic medicine system; but shall not apply at prophylactic medicine establishments dealing in prophylactic medicine services under the licenses granted by competent State bodies;
2. For prophylactic medicine activities for which the charge and fee levels have not yet been prescribed in the Table promulgated together with this Decision, the collection levels shall comply with Circular No.14/TTLB of September 30, 1995 issued jointly by the Ministry of Finance, the Health Ministry, the Government Pricing Committee and the Ministry of Labor, War Invalids and Social Affairs, guiding the partial collection of hospital fees. For cases already prescribed in Table of collection rates promulgated together with this Decision, the collection levels prescribed in this Decision shall apply;
3. The prophylactic medicine charge and fee rates stipulated in Vietnam dong shall be collected in Vietnam VND; the prophylactic medicine charge and fee rates stipulated in US dollar shall be collected either in US dollar or in Vietnam dong based on the conversion of USD into Vietnam dong at the exchange rates on the inter-bank foreign currency market, announced by the Vietnam State Bank at the time of charge and fee collection.
Article 2.- Subject to the payment of charges and fees at the rates prescribed in Article 1 of this Decision are Vietnamese and foreign organizations and individuals, that are provided with the following by prophylactic medicine bodies of Vietnam (except for cases of non-payment stipulated in Article 3):
1. Prophylactic medicine tests.
2. Border medical quarantine.
3. Examination of the quality of assorted vaccines, immune bio-products, germs- or insect-killing preparations for domestic and medical use.
4. Vaccination and treatment of medical insects.
5. Evaluation of dossiers, granting of registration number for trading in and circulation of vaccines, immune bio-products, germs- or insect-killing chemicals for domestic and medical use.
Article 3.- Non-collection of prophylactic medicine charges and fees from the following subjects:
1. The Heroic Vietnamese Mothers.
2. Orphans aged under 16, disabled people, supportless elderlies.
3. People in mountainous or island communes.
4. Persons enjoying regular social allowances under the regulation of the Ministry of Labor, War Invalids and Social Affairs.
5. Persons who are extremely poor under the State�s regulations.
Article 4.- Establishments which belong to the prophylactic medicine system and perform the State management over the prophylactic medicine and conduct non-business prophylactic medicine activities shall have the following responsibilities and powers:
1. To deduct 90% (ninety percent) of the total charge amount and 40% (forty percent) of the total fee amount actually collected (including prophylactic medicine charge and fee amounts collected according to the above-said Circular No.14/TTLB of May 30, 1995) before their remittance into the State budget in order to cover expenses for performing the prophylactic medicine and organizing the charge and fee collection.
2. To declare the collection and payment of prophylactic medicine charges and fees with the tax offices of localities where the collection is carried out, and to manage and use the deducted charge and fee money in strict accordance with the provisions in Circular No.54/1999/TT-BTC of May 10, 1999 of the Ministry of Finance, guiding the implementation of the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget.
Prophylactic medicine establishments dealing in prophylactic medicine services under the licenses granted by competent State bodies without collecting and remitting prophylactic medicine charges and fees according to the above stipulations shall have to pay taxes and other revenues (if any) according to law.
Article 5.- This Decision takes effect 15 days after its signing; all stipulations on prophylactic medicine charges and fees which are contrary to this Decision are annulled.
Article 6.- The prophylactic medicine establishments, prophylactic medicine charge and fee payers and concerned bodies shall have to implement this Decision.
