DECISION

APPROVING THE PROGRAM OF PLANT SEEDS, LIVESTOCK BREEDS AND FOREST TREE SEEDS IN THE 2000-2005 PERIOD

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992;
At the proposal of the Minister of Agriculture and Rural Development,

DECIDES:

Article 1.- To ratify the program of plant seeds, livestock breeds and forest tree seeds in the 2000-2005 period, aiming at:

1. Ensuring enough seeds and breeds of good quality to supply for the need of production development, first of all in the important production branches related to the income of the masses of farmers and of large export value such as paddy and rice, coffee, rubber, tea, cashew, pepper, vegetables, fruit trees and oil-bearing plants, sugarcane, fodder plants, pigs, beef cattle and dairy cattle, poultry, important forest trees catering for the production of paper and timber...

2. Applying new and traditional scientific achievements and technologies by using the advantages of cross-breeding while preserving bio-diversity, step by step applying bio-technology in cross-breeding;

3. Setting up a production and service system in plant seeds, livestock breeds and forest tree seeds suited to the market mechanism;

4. Encouraging every organization and individual in the country and abroad to take part in the research on, cross-breeding and production of good strains to supply to production needs.

Article 2.- The Ministry of Agriculture and Rural Development shall direct and guide the research institutions, universities, colleges and vocational secondary schools within the agriculture and rural development branch and mobilize the institutes and schools outside the branch to take part in the research on, creation, selection and production of seeds and breeds; encourage and create conditions for organizations and individuals of all economic sectors to take part in the selection, crossbreeding, multiplication, production and supply of seeds and breeds, to seek international cooperation in the domain of seeds and breeds.

The People’s Committees of the provinces and centrally-run cities shall adopt plans to build, strengthen and upgrade the existing establishments producing plant seeds, livestock breeds and forest tree seeds, encourage all organizations and individuals to take part in the selection, crossbreeding, multiplication, production and supply of seeds and breeds for production needs.

Article 3.- Investment and credit

1. The State budget (including non-business capital) shall be invested:

a/ In scientific research on seeds and breeds: The Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment and the Ministry of Science, Technology and Environment shall adopt plans to invest in a number of scientific institutes, the University of Agriculture, and the University of Forestry in order to intensify fundamental research and application aimed at quickly raising the level and efficiency of the research on seeds and breeds. It is necessary to invest in the Agricultural Genetics Institute in order to build it into the Bio-technology Institute of Agriculture;

b/ To preserve the gene sources (including both cultivation and protection). To assign to the scientific research institutes the task of carrying out the cultivation and planting of the gene sources. At the same time, the Ministry of Agriculture and Rural Development shall assume the prime responsibility and coordinate with the People’s Committees of a number of provinces in planning and arranging an area of natural forests (botanical garden) to preserve, protect, cultivate and preserve the gene sources of the varieties of plants and animals;

c/ To produce original strains, super pure strains, pure strains, patristic strains and grandparent strains;

d/ To import gene sources and necessary new strains in order to quickly acquire the scientific and technical advances of the world;

e/ The local budgets shall provide partial support for the production of seeds and breeds requiring high technique, and for the poor farmers to help them secure good strains for production and animal semen to cross-breed good strains of dairy and beef cattle.

2. Priority in credit funds shall be given to the production of commercial seeds and breeds of the institutes, schools, organizations and individuals of all economic sectors that need to borrow capital for the production of seeds and breeds.

The Ministry of Science, Technology and Environment shall give priority of loan to the projects of experimentation in carrying out this seed and breed program.

Article 4.- Investment in developing plant seeds, livestock breeds and forest tree seeds must be based on concrete projects and submitted to the competent authority for approval according to the current stipulations on management of investment and construction.

Basing themselves on the projects approved by the competent authority, the Ministry of Finance and the Ministry of Planning and Investment shall balance their annual capital plans in order to assure enough capital for each project according to the approved investment plan and schedule.

Article 5.- The Ministry of Science, Technology and Environment shall early submit to the Government the policy on copyright in seeds and breeds along the following line: The scientific products must become a commodity; the State shall buy the copyright on the products of fundamental research, the strains of those objects which produce strains for the benefit of the whole society; with regard to the copyright of other strains, there must be appropriate solutions to meet the interests of the scientist who creates the strains and their producers and traders.

Article 6.- The Ministry of Finance shall study and draw up an integrated report to submit to the Government which shall report it to the National Assembly for amendment and supplement to the agricultural land use tax along the line: For the research and production establishments on plant seeds, livestock breeds and forest tree seeds, the tax rate shall be 0%.

Article 7.- The Ministry of Agriculture and Rural Development shall adopt planning and plans to train technicians, especially prime scientific workers in seeding and breeding work (including training abroad). In the programs of agriculture and forestry promotion, the training and popularization of knowledge in seeding and breeding work for farmers must be increased so that they can participate in this program.

In coordination with the People’s Committees of the provinces and centrally-run cities, the Ministry of Agriculture and Rural Development shall carry out well the provisions on State management of plant seeds and livestock breeds stipulated in the Government’s Decree No.07/CP of February 5, 1996 on the management of plant seeds and Decree No. 14/CP of March 19, 1996 on the management of livestock breeds, first of all the issue of certificates of quality of breeds, business licenses, inspection and supervision of production and business in plant seeds and livestock breeds. There must be stipulations to ensure the responsibility of the producers and traders for the quality of seeds and breeds toward the users.

Article 8.- This Decision takes effect 15 days after its signing.

Article 9.- The ministers, the heads of ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of the provinces and centrally-run cities shall have to implement this Decision.
