DECISION
ON APPROVING THE BAND PLANNING FOR THE DIGITAL CELLULAR MOBILE COMMUNICATION SYSTEM OF VIETNAM IN THE FREQUENT BANDS 821 – 960 MHz AND 1710 – 2200 MHz

Pursuant to the Ordinance on Post and Telecommunications dated May 25, 2002;
Pursuant to the Decree No.24/2004/ND-CP dated January 14, 2004 of the Government detailing a number of Articles of the Ordinance on Post and Telecommunications regarding radio frequencies;
Pursuant to the Decree No.187/2007/ND-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
Pursuant to the Decision No.336/2005/QD-TTg dated December 16, 2005 of the Prime Minister on approving the Planning on national radio frequency spectrum;
At the proposal of Director of Department of Radio Frequencies,
DECIDES:
Article 1. Approving the band planning for the digital cellular mobile communication system of Vietnam in the frequent bands 821 – 960 MHz and 1710 – 2200 MHz with the following major contents:
1. Scope of governing
1.1. This planning is applied to digital cellular mobile communication using GSM and CDMA technology in the frequent bands 821 – 960MHz and 1710 – 2200MHz.
1.2 Other communication systems operating in these frequent bands (including IMT – 2000) shall be applied upon private band to each system.
2. Contents
The band planning for the digital cellular mobile communication system of Vietnam in the frequent bands 821 – 960 MHz and 1710 – 2200 MHz as follows:
2.1. Band frequent 821 – 960 MHz until 2010

2.1.1. 824-829MHz and 869-874MHz: For the provincial CDMA system in Hochiminh city, Danang, Nghean and Haiduong. National CDMA operators are entitled to use these bands in the remaining areas.
2.1.2. 829-837MHz and 874-882MHz: For the national CDMA system.
2.1.3. 851-866MHz: For the trunk radio systems (Trunking).
2.1.4. 890-915MHz and 935-960MHz: For three national GSM systems (according to lots 1, 2, 3).
882-890MHz and 927-935MHz: For the national E-GSM system.
2.1.5. 821-824MHz, 837-851MHz, 866-869MHz and 915-927MHz: For Fixed Mobile professional skill.

2.2.1. 824-835MHz and 869-880MHz: For the national CDMA system.
2.2.2. 851-866MHz: For the trunk radio systems (Trunking).

2.3.1. 1710 – 1785MHz and 1805 – 1880MHz: For four national GSM systems (according to lots 1, 2, 3, 4).
2.3.2. 1895 – 1900MHz: For the wireless local loop (WLL) systems used together with multi-access phone systems (PHS, DECT and other equivalents). Depending on the level of development of digital cellular mobile communication, the band segment shall be reviewed from time to time.
2.3.3. 1785 – 1805MHz, 1880-1895MHz: For Mobile professional skill.
2.3.4. 1900-1980 MHz, 2010-2025MHz, 2110-2170MHz: For IMT-2000 systems.
2.3.5. 1980-2010MHz, 2170-2200MHz: For Mobile professional skill through satellite.
2.3.6. 2025-2110MHz: For Fixed and Mobile professional skill.

2.4. The operators shall not be limited to provide wireless local loop (WLL) in the band licensed to deploy digital cellular mobile communication using technology of GSM and CDMA with conditions:
2.4.1. The operators must have simultaneously the license to establish networks and provide local fixed telecommunications services and the license to establish networks and provide mobile telecommunications services.
2.4.2. Wireless local loop services (WLL) and digital cellular mobile service must use in common the technical infrastructure with the same CDMA technology or GSM technology.
2.5 Band allocated for each operator of cellular mobile communication network includes protection band. Operators take the responsibility to coordinate with each other and apply technical measures to prevent interference.
3. Implementation organization
3.1. The plan to convert the existing networks in the bands 821 - 960MHz and 1710 - 2200MHz must comply with regulations on conversion from current state to planning in the Decree 24/2004/ND-CP dated January 14, 2004 of the Government.
3.2. The Department of Radio Frequencies is responsible for guiding the specific implementation according to this planning. Telecommunications carriers based on this planning to make the plan requesting for granting bands and convert the existing networks in the above bands.
Article 2. This Decision takes effect 15 days after its publication in the Official Gazette and replaces the Decision 17/2006/QD-BBCVT dated June 08, 2006 of the Minister of Post and Telecommunications on approving, adjusting the band planning for the digital cellular mobile communication system of Vietnam until 2010 in the frequent bands 821 – 960MHz and 1710 – 2200MHz.
Article 3. Chief Office, Director of Department of Radio Frequencies, Heads of agencies, units under the Ministry of Information and Communications, organizations and telecommunications carriers are responsible for the implementation of this Decision./.
