DECISION
TARIFF QUOTA IMPORTS OF 2 PRODUCTS ORIGINATING FROM LAOS UNDER A DUTY RATE OF 0%
MINISTER OF TRADE
Pursuant to the Agreement
between the Ministry of Trade of the Socialist Republic of Vietnam and the
Ministry of Trade of the Laos People’s Democratic Republic on products subject
to import tariff preferences between the 2 countries signed on July 28, 2005;
Pursuant to Decree 29/2004/ND-CP dated January 16, 2005 by the Government on
functions, tasks, powers, and organization of the Ministry of Trade;
Implementing the Prime Minister’s guidelines as specified in document
4672/VPCP-QHQT dated August 19, 2005 on adoption of the Agreement with the
Ministry of Trade of Laos of Vietnamese and Lao products subject to import
tariff preferences,
HEREBY DECIDES :
Article 1: To appoint enterprises as specified in Appendix I attached to import under quota tariff rice and tobacco stem and leaf originating from Laos with an import duty rate of 0% in accordance with deals signed with Laos enterprises as specified in Appendix II attached.
Article 2: The products imported by enterprises as specified in Appendix I attached are imposed an import duty rate of 0% under the condition that they pass border gates as named in the Agreement between the Socialist Republic of Vietnam and the Laos People’s Democratic Republic as specified in Appendix III attached. Procedures on import of products subject to the tariff preferences are carried out at the border gate where the products are imported, following the principle of deduction (total volume of tariff quota deducts volume of import products with Certificate of Origin Form S granted by the Lao competent agency).
Exceeding volume of import products is imposed a duty rate as much as half of those as specified in sub-Clause I, Clause 1 of Decision 60/2005/QD-BTC dated August 31, 2005 by the Ministry of Finance or MFN rate on the products suffer to other tariff rates.
Article 3. This Decision will come into effect in 15 days after it is publicized on the Gazette and be effective until December 31, 2005.
Article 4. Enterprises as named in the Appendix attached are responsible for implementation of this Decision and report results to the Ministry of Trade at the latest on December 31, 2005.
