DECISION

ON APPROVAL FOR PROJECT FOR DEVELOPMENT OF PUBLIC BUS SERVICES IN THE PERIOD OF 2012 THROUGH 2020

THE PRIME MINISTER

Pursuant to the Law on Government organization dated December 25, 2001;

Pursuant to the Law on Road traffic dated November 13, 2008;

Pursuant to Resolution No. 88/NQ-CP dated August 24, 2011 of the Government on enhancement of key measures for traffic safety;

At the request of the Minister of Transport,

DECIDES:

Article 1. Approving the Project for development of public transport bus services (hereinafter referred to as public bus services) in the period of 2012 through 2020 as follows:

I. POINT OF VIEW

1. In the period of 2012 through 2020, the public bus services shall play a key role for as a strategic task of urban areas in tackling traffic congestion, preventing traffic accidents and reducing environmental pollution.

2. Developing the public bus services according to the planning and actual conditions of the transport network. Developing the public bus services according to the planning for residents, industrial parks of each province or city to satisfy the citizen's demand for travelling as well as to enable disabled people to use public vehicles.

3. Giving priority to application of modern, safe and eco-friendly technology in vehicles, control and operation of the public transport bus services.

4. Monitoring closely and scientifically and settling promptly all general difficulties or particular issues arising during the operation of the system of public transport bus services.

5. Focusing on investment in development of quantity and quality of buses; and improving service quality and increasing the operation frequency.

II. OBJECTIVES

1. Developing the network of public bus services in a synchronization and compatibility way between the various types of urban transport (urban railway, metro, waterways) and from urban centers to urban districts of provinces, cities, or from special-class urban areas to satellite urban areas or industrial parks.

2. Providing convenient bus services in conformity with the travel needs of the majority of people (inclusive of number of journeys in a day, opening time and closing time, suitable bus stops, convenient bus tickets) to encourage the people to use the bus services in order to limit the personal vehicles and contribute to solve the traffic congestion due to the urban area development.

3. Build up an appropriate network of bus routes to facilitate the travel of the people and develop the bus routes towards districts, district-level towns and industrial parks of the provinces.

4. Improve the quality of the public bus services and use vehicles in conformity with the traffic infrastructure and the needs of travel of the people.

5. Recommend the provinces to invest in buses using eco-friendly fuel.

6. Apply new technology in management and administration of the bus operation as well as monitoring of the bus services.

III. CONTENTS

1. Planning for development of the network of bus routes of provinces

a) The provinces must make planning for development of the network of bus routes in the period of 2012 through 2020 to meet the travel needs of the people in short term and long term in order to tackle the traffic congestion in the provinces.

b) Hanoi City and Ho Chi Minh City are required to focus on the existing planning for the network of the bus routes and invest in rapid bus routes transporting mass volume and the system of urban railways and metros in the near future;

c) Make a planning for provision of bus services connecting between the center of cities or district-level towns and the center of districts to facilitate the travel of the people in the midland and mountainous provinces.

2. Investment in vehicles used in the public bus services

a) Each vehicle used in the public bus services must satisfy the standards as prescribed;

b) Recommend the investment in low-floor buses, buses suitable for the disabled people and buses using eco-friendly fuel;

c) The investment in buses conforms to the traffic infrastructure.

3. With respect to the existing infrastructure, the buses shall be given priority for separate lanes. With respect to new infrastructure, it is required to design and construct priority lanes for buses and ensure the effective connection between the system of bus stops and overpass for pedestrians in urban areas. The investment in infrastructure for the public bus services shall be given incentives.

4. Management of quality of the public bus services

a) The provinces having great quantity of bus routes that are provided by many organization shall establish a center in charge of management of the public bus services to monitor and control the quality of the bus services;

b) Apply new technology to control and administer the operation of the public transport bus services;

c) Provide guidelines for bidding applied for the public bus services to enhance the transparency, effectiveness and quality of the services;

d) Apply economic and technical norms for the public transport bus services.

5. Raising the public awareness of using bus services, provide training courses for officials and staff working in the field of public transport bus services.

a) Raising the public awareness of benefits of the bus services, information about the bus service quality and policies applied for the bus passengers such as: free tickets, preferential monthly fares;

b) Providing training courses for the staff of the public transport bus services; especially the drivers and conductors to ensure the best service quality;

c) Strengthen the professional ethics of the drivers and conductors related to their responsibility and attitude in serving passengers and their sense of law observance of traffic safety.

6. Policies on development of public bus services in the period of 2012 through 2020

a) With respect to administrative divisions having not provided bus routes, its province shall impose regulations on incentives for new bus routes for the initial stages;

b) The province shall consider granting subsidies to necessary bus routes that reduce the traffic congestion but their revenues do not cover their expenses in the class-II urban areas or higher to stabilize the network of bus routes;

c) The vehicles purchased to use in the public bus services shall be given incentives; especially the projects investing in buses using eco-friendly fuel, including LPG or CNG. Those projects shall be given incentives for investment credit loans from the State;

d) The station of maintenance and repair and bus depots constructed by business entities providing the public bus services shall be exempt from land rents as prescribed in the Decision no. 62/2009/QD-TTg dated April 20, 2009 of the Prime Minister;

dd) The advertisement and revenues from the advertisement shall be used to support the operation of bus services.

7. Budget for implementation of the Project

a) The budget for formulation of the economical and technical norms for public bus services and formulation of the Regulations bidding in the public bus services shall be allocated from the government budget as prescribed;

b) The budget for implementation of the Project shall be allocated from the government budget and capital mobilized from other resources (equity of enterprises, loans from credit institutions or international donors).

IV. IMPLEMENTATION

1. The Ministry of Transport

a) Take charge and cooperate with the Ministry of Science and Technology in formulation and issuance of economical and technical norms applied for the public transport bus services. Finished in 2012;

b) Take charge and cooperate with the Ministry of Planning and Investment and the Ministry of Finance in providing guidelines for bidding applied for the public transport bus services. Finished in 2012;

c) Cooperate with the People’s Committees of provinces or central-affiliated cities (hereinafter referred to as provinces) in implementation of planning for development of the network of the public bus services and relevant issues;

d) Synthesize and inspect the planning for development of the public bus services of the provinces. Send annual reports on results of implementation and measures for development of the public bus services in the period of 2012 through 2020 to the Prime Minister;

dd) Cooperate with the Ministry of Planning and Investment and the Ministry of Finance in balancing of the annual budget for implementation of the tasks of the Project.

2. The Ministry of Finance

a) Take charge and cooperate with relevant Ministries and agencies in providing enterprises with incentives for banking borrowed capital interests to invest in public transport bus services. Finished in 2012;

b) Provide guidelines for implementation of policies on development of public bus services and take charge and cooperate with the Ministry of Transport in formulation of particular policies on development of public bus services using eco-friendly fuel such as LPG, CNG. Submitting to the Prime Minister in 2012;

c) Cooperate with the Ministry of Planning and Investment in balancing of the annual budget for implementation of the tasks of the Project;

d) Cooperate with the Ministry of Transport in providing guidelines for bidding applied for the public transport bus services.

3. The Ministry of Natural Resources and Environment

a) Cooperate with the Ministry of Transport in providing guidelines for implementation of legislation on land related to management and use of land for the public transport bus services;

b) Cooperate with the People’s Committees of provinces in allocation of land resource to the public transport bus services.

4. The Ministry of Education and Training

Direct educational institutions to provide school buses for students. Propagate and encourage students to use the public bus services to go to school and other journeys.

5. The Ministry of Information and Communications

a) Cooperate with National Traffic Safety Committee and the Ministry of Transport in raising the public awareness of using bus services to limit personal vehicles in traffic and reduce traffic accidents;

b) Cooperate with the Ministry of Transport and the Ministry of Finance in purchasing tickets and providing bus routes via the Internet or the phone.

6. The Ministry of Planning and Investment

a) Cooperate with the Ministry of Finance in providing subsidies from the government budget for bus services of provinces;

b) Cooperate with the Ministry of Transport in providing guidelines for bidding applied for the public transport bus services;

c) Cooperate with the Ministry of Finance and the Ministry of Transport in balancing of the annual budget for implementation of the tasks of the Project.

7. The People’s Committees of provinces

a) Make a planning for development of public passenger transport by buses in the period of 2012 through 2020, finished before the third quarter in 2012;

b) Implement the policy on subsidies for the bus routes prescribed in Points a and b Clause 6 Section III Article 1 of this Decision;

c) Formulate and issue detailed economical and technical norms for the local public bus services according to the economical and technical norms issued by the Ministry of Transport that are conformable to the conditions of roads and weather of the province;

d) Conduct the bidding for bus routes as prescribed;

dd) Direct the provision of advertisements on the vehicles used in the public transport bus services;

e) Ensure the rate of buses being used suitable for the disabled people as prescribed.

Article 2. Effect

This Decision comes into force from the day on which it is signed.

Article 3. Implementation

Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Presidents of People’s Committees of provinces shall implement this Decision./.
