DECISION

ON CRITERIA TO IDENTIFY SPECIAL DIFFICULT VILLAGES AND COMMUNES IN ETHNIC MINORITY AND MOUNTAINOUS AREAS FOR THE 2012 - 2015 PERIOD

Pursuant to the Law on Organization of the Government, of December 25, 2001;

At the proposal of the Minister, Chairperson of the Committee for Ethnic affairs;

The Prime Minister promulgates the Decision on criteria to identify special difficult villages and communes in ethnic minority and mountainous areas for the 2012 -2015 period,

Article 1. Subjects of application

1. Villages and communes in ethnic minority and mountainous areas.

2. Communes of provinces and cities in delta areas where ethnic minority people reside.

Article 2. Criteria to identify special difficult villages

A special difficult village must fully meet the following 3 criteria:

1. Satisfying both following conditions:

a/ The rate of Poor households and near-poor households accounted from 55% or more than, of which rate of poor households accounted from 25% or more than.

b/ Satisfying at least two of three elements below:

- Over 80% of its laborers have not yet trained on vocational;

- Over 50% of its households fail to have a hygienic toilet.

- Over 30% of its households lack hygienic daily-life water.

2. Satisfying at least two of three conditions below:

a/ Over 20% of its households lack land for production.

b/ Over 50% of its cultivable areas need but have not yet irrigated.

c/ Satisfying one of the two conditions below:

- Having no agricultural, forestry and fishery extension officers in villages and hamlets.

- Under 10% of households are engaged in non-agricultural jobs.

3. Fully satisfying both following conditions:

a/ Having no roads from villages to commune centers which being solidified according to the new countryside criteria.

b/ Satisfying any of three conditions below:

- Not be sufficient preschool classrooms as prescribed.

- Over 30% of households have no daily-life electricity.

- Having no a qualified community welfare building.

Article 3. Communes in ethnic minority and mountainous areas shall be identified in three regions: region-Ill communes are those meeting the most-difficult socio-economic conditions; region-II communes are those still meeting difficult socio-economic conditions but being temporary stable; region-I communes are the remaining communes.

1. Criteria of region-Ill communes:

A region-Ill commune must meet at least four of the following five criteria:

a/ Special-difficult villages accounted from 35% or more than (compulsory criterion).

b/ The rate of poor households and near-poor households accounted from 45% or more than, of which rate of poor households accounted from 20% or more than.

c/ Satisfying at least three of five conditions below:

- Commune and inter-commune axial roads have not yet asphalted or concreted.

- At least one village still has no access to the national power grid.

- Not being sufficient primary school classrooms or classes in villages as prescribed by the Ministry of Education and Training.

- Commune health stations fail to meet standards as prescribed by the Health Ministry.

- Commune cultural houses fail to meet standards as prescribed  by the Ministry of Culture, Sports and Tourism.

d/ Satisfying at least two of three conditions below:

- There are still at least 30% of households have no hygienic daily-life water.

- Over 60% of laborers have not yet trained on vocational.

- Over 50% of commune full-time officials or civil servants fail to meet standards as prescribed.

e/ Satisfying at least two of three following conditions:

- There are still at least 20% of households being lack land for production as prescribed.

- There are no commune agricultural, forestry and fishery extension officers meeting standards.

- Under 10% of households are engaged in non-agricultural jobs.

2. Criteria of region-II communes:

A region-II commune must meet at least four of five criteria below:

a/ Under 35% of villages are special difficult (compulsory criteria)

b/ Rate of poor households and near-poor households accounted between 20% and 45%, of which rate of poor households accounted between 10% and 20%.

c/ Satisfying at least two of four conditions below:

- Commune and inter-commune roads to villages are not yet asphalted or concreted.

- There are still villages have no the national power grid.

- Not being sufficient primary school classrooms or classes in villages as prescribed by the Ministry of Education and Training.

- Commune health stations fail to meet standards as prescribed by the Health Ministry.

d/ Satisfying at least two of three conditions below:

- Under 30% of households have no hygienic daily-life water.

- From 30% to fewer than 60% of laborers have not yet trained on vocational.

- From 30% to fewer than 50% of commune full-time officials or civil servants fail to meet standards as prescribed.

e/ Meeting either of the conditions below:

- There are still from 10% to fewer than 20% of households being lack land for production.

- There is no commune agricultural, forestry and fishery extension officer meeting standards.

3. Criteria of region-I communes:

Region-I communes are communes in ethnic minority and mountainous areas other than region-Ill and -II communes.

Article 4. Organization of implementation

1. The Committee for Ethnic Minorities shall:

a/ Set up an advisory council to assist its Minister, Chairperson of the Committee for Ethnic Affairs  in considering and deciding to recognize special difficult villages and region-I, -II and -III communes in ethnic minority and mountainous areas. The council members include representatives of the Ministries of: Planning and Investment; Finance; Labor, War Invalid and Social Affairs; Home Affairs; Education and Training; Health; Agriculture and Rural Development; Natural Resources and Environment; Transport; and Culture, Sports and Tourism, and representatives of some relevant agencies and organizations.

b/ Decide to recognize special difficult villages and region-I, -II and -III communes in ethnic minority and mountainous areas in the 2012 - 2015 period; guide the identification of ethnic minority and mountainous areas in accordance to regulations.

2. The Ministries of: Planning and Investment; Finance; Labor, War Invalid and Social Affairs; Home Affairs; Education and Training; Health; Agriculture and Rural Development; Natural Resources and Environment; Transport; and Culture, Sport and Tourism shall coordinate with the Committee for Ethnic Affairs in guiding localities in implementation.

3. People's Committees of provinces and centrally-run cities shall:

Based on the criteria specified in this Decision, direct district- and commune-level People's Committees to make actual investigation and identify the special-difficult villages and region-I, -II and -III communes in ethnic minority and mountainous areas in the 2012-2015 period, summarize and report thereon to the Committee for Ethnic Affairs for consideration and deciding on recognition.

Article 5. This Decision takes effect on September 6, 2012.

To annul the Decision No.393/2005/QD-UBDT of August 29, 2012 of the Minister, Chairperson of the Committee for Ethnic Affairs, on promulgating criteria for identifying ethnic minority and mountainous areas based on their development levels.

Article 6. Ministers, heads of ministerial-level agencies and government-attached agencies, and chairpersons of provincial-level People's Committees shall implement this Decision.-
