DECISION
ON THE CHARGE OF FEES RELATING LENDING ACTIVITY OF CREDIT INSTITUTIONS TO CUSTOMERS
THE GOVERNOR OF THE STATE BANK
Pursuant to the Law on the State Bank of Vietnam and the Law on the
Credit Institutions dated 12 December , 1997;
Pursuant to the Decree of the Government No.15/CP dated 2 March, 1993 on the
tasks, powers and responsibilities of Ministries or ministerial level bodies;
Upon the proposal of the Director of the Monetary Policy Department,
DECIDES
Article 1.
1. Credit Institutions shall be entitled to agree with customers on different fees relating to a loan.
2. The sum of the fees which are mentioned in paragraph 1 of this Article, as a percentage of the loan and the lending rate stated in the credit contract shall not exceed the corresponding maximum lending rate provided for by the Governor of the State Bank at the time the credit contract is entered into
Article 2. The provision in paragraph 2 of Article 1 of this Decision shall not apply to the event where Credit Institutions agree with customers to collect the charge on the credit file from customers who are not among prioritized customers, at the rate which is sufficient to cover the printing cost.
Article 3. This Decision shall be effective 15 days after the date of signing. Legal documents previously issued by the State Bank of Vietnam which are in contrary to this Decision shall cease the effectiveness.
Article 4. The Director of Administration Department, the Director of Monetary Policy Department, Heads of Departments in the State Bank, Head-office, General Manager of State Bank branches in provinces, cities; Chairman and Directors General (Directors) of Credit Institutions shall be responsible for the implementation of this Decision.
