DECISION
ON THE TRANSFER OF THE STATE AGRICULTURAL AND FORESTRY FARMS TO THE MANAGEMENT OF THE LOCALITIES
THE PRIME MINISTER
Pursuant to the Law on
Organization of the Government on the 30th of September 1992;
Pursuant to Decree No.12-CP on the 2nd of March 1993 of the Government issuing
the Regulation on the reorganization and renewal of the managing mechanism at
the State agricultural enterprises;
At the proposal of the Ministry of Agriculture and Food Industry, and the
Ministry of Forestry,
DECIDES:
Article 1.- The Ministry of Agriculture and Food Industry, and the Ministry of Forestry shall effect the transfer of the State agricultural and forestry farms and the related service agencies to the People's Committees of the provinces and cities directly under the Central Government for management under territorial responsibility. Only the following agricultural and forestry farms shall be retained with a view to the development of the agricultural and forestry services:
- With regard to the Ministry of Agriculture and Food Industry, only a number of agricultural farms shall be retained to cater for large-scale processing for export, for scientific research, production and for preserving the original strains.
- With regard to the Ministry of Forestry, only a number of forestry farms with natural or planted forests shall be retained to serve scientific research, production and preserve the original strains; or forestry farms with planted forests and bare lands shall be retained to be developed into material areas in service of forest products processing industry; or forestry farms producing materials for paper and pit-props (for delivery to the paper and coal industries):
The Ministry of Agriculture and Food Industry and the Ministry of Forestry have to submit the list of the agricultural and forestry farms proposed for retention to the Prime Minister for approval.
The People's Committees of the provinces and cities directly under the Central Government have the responsibility to receive, organize and rearrange production at the agricultural and forestry farms transferred to them with a view to effective use of the land, natural resources, capital and properties in conformity with the production plans of the services and of the localities.
Article 2.- The transfer shall be effected on the principle of status quo, including: the leading apparatus, the workforce, land, properties, capital...
The Ministry of Finance shall guide the revaluation of the whole property and capital; record the reduction of capital and property of the Ministry of Agriculture and Food Industry and the Ministry of Forestry, and record the increased capital of the localities.
Article 3.- The transfer shall have to be completed at the end of the 4th quarter of 1995.
Article 4.- The Minister of Agriculture and Food Industry, the Minister of Forestry, the Minister of Finance, the Minister of Labor, War Invalids and Social Affairs, the Chairman of the State Planning Committee, the Presidents of the People's Committees of the provinces and cities directly under the Central Government and the Heads of the related services shall have to implement this Decision.]
