DECISION

PROMULGATING THE “LIST OF ADDITIVES ALLOWED IN FOODS”

THE MINISTER OF HEALTH

Pursuant to the Law on People’s Health Protection on June 30, 1989 and the Hygiene Charter promulgated together with the Decision No. 23-HĐBT on January 24, 1991 of the Minister Council (now the Government);

Pursuant to the Government's Decree No. 68/CP on October 11, 1993 defining the functions, tasks, powers and the organizational structure of the Ministry of Health;

Pursuant to the Government's Decree No. 86/CP on December 08, 1995 on the assignment of State management of goods quality

At the proposal of the Department of food safety, hygiene and quality control and the Director of the Science and Education Department – the Ministry of Health.

DECIDES

Article 1. Promulgating the “List of additives allowed in food” together with this Decision.

Article 2. This Decision takes effect after 15 days as from the signing date, and supersedes Section 1 of the part Food additives in the “List of hygiene standards of food” promulgated together with the Decision No. 867/1998/QD-BYT on April 04, 1998 of The Minister of Health.

Article 3. The Director of the Department of food safety, hygiene and quality control is responsible for organizing, directing, guiding and inspecting the implementation of this Decision.

Article 4. The Chief officers, the Chief Inspectors, Directors of the Department of Legal Affairs, the Department of Science and Training, the Director of the Department of food safety, hygiene and quality control – the Ministry of Health, the Services of Health of central-affiliated cities and provinces, Heads of units affiliated to the Ministry of Health are responsible for implementing this Decision.

REGULATION

LIST OF ADDITIVES ALLOWED IN FOODS
(Promulgated together with the Decision No. 3742 /2001/QD-BYT on August 31, 2011 of The Minister of Health)

Part 1:

GENERAL PROVISIONS

1. Scope of regulation:

This Regulation provides for the list of additives allowed to be used in food within the Vietnam’s territory, including imported food and imported additives.

2. Subjects of application

This Regulation is applicable to organizations and individuals producing, processing, preserving, packing, transporting food and food additives within the Vietnam’s territory.

3. The terms in this Regulation are construed as follows:

a) Food additives are substances that are not considered food or part of food. Food additives have little or no nutritional value, are intentionally added in order to satisfy the technological requirements during the food production, processing, packing, preservation, and transportation. Food additives do not include pollutants or food supplement added to increase the nutritional value of food.

b) The International Numbering System (INS) Codex Committee on Food Additives is for numbering the additives when adding them to the list of food additives.

c) The Acceptable Daily Intake (ADI) is a certain amount of food additives in being taken in the body every day by consuming food or drinking water without harming the health. ADI is expressed in mg/kg of body weight/day.

ADI may be expressed in:

- A constant  

- Not specified

- Not identified

c) The Maximum Tolerable Daily Intake (MTDI) is a maximum amount of substances in being taken in the body every day by consuming food or drinking water. MTDI is expressed in mg/person/day.

dd) Maximum level (ML) is the maximum limit of each additive used during the production, processing, preservation, packing, and transportation of food.

e) Good Manufacturing Practices (GMP) is the fulfillment of the requirements for the use of additives during the production, processing, preservation, packing, and transportation of food, including:

- Minimizing the amount of food additives necessary;

- The amount of additives used during the production, processing, preservation, packing, and transportation of food may be part of food but must not affect the physical or chemical properties, or other value, of food.

- The amount of food additives being used must be consistent with the statement of the producers and certified by competent agencies.

f) The substances in the List of additives allowed to be used in food promulgated together with this Decision hereinafter are referred to as “food additives in the list”.

4. The List of additives allowed to be used in food includes:

a) Maximum levels of additives in food;

b) Maximum levels of flavorings in food;

5. The use of food additives in the List in the production, processing, preservation, packing, and transportation of food must comply with the “Regulation on food quality, safety and hygiene” promulgated together with the Decision No. 4196/1999/QD-BYT  on December 29, 1999 promulgated by the Minister of Health.

6. Only the food additives in the List are allowed to be imported, produced, and traded in Vietnam’s market, and must be certified that they are conformable with the quality, hygiene and safety standards of by competent agencies.

7. The use of food additives in the list must satisfy the following requirements:

a) The food additives must be used for the right food with permissible amounts;

b) The use of food additives must satisfy the technical requirements for hygiene and safety of each additive as prescribed by current law provisions,

c) The use of food additives must not change the natural properties of food.

8. The circulating  food additives in the List must be labeled as prescribed by current law provisions. The different additives must have separate instructions.

9. Annually, the Ministry of Health shall consider the use of food additives on the basis of assuring the consumers’ health.

10. The organizations and individuals that violate this Regulation shall be liable to administrative penalties or criminal prosecution, depending on the extent of violations, and must pay compensation for any damage caused.
