DECISION
AUTHORIZING TO PERFORM TASKS OF COMPETENT ORGANIZATION IN RECRUITING AND MANAGING VIETNAMESE EMPLOYEES IN ACCORDANCE WITH THE GOVERNMENT’S DECREE No. 75/2014 / ND-CP DATED JULY 28 , 2014
THE MINISTER OF FOREIGN AFFAIRS
Pursuant to the Government's Decree No. 58/2013 / ND-CP dated March 10, 2013 defining the functions, tasks, entitlements and organizational structure of the Ministry of Foreign Affairs;
Pursuant to the Government's Decree No. 75/2014 / ND-CP dated July 28, 2014 detailing the implementation of a number of articles of the Labor Code on recruitment and management of Vietnamese employees working for foreign organizations and individuals in Vietnam;
Pursuant to the People’s Committee of Ho Chi Minh City's Official Dispatch No. 5334 / VX-People's Committee dated October 16, 2014 on the continued authorization to perform the tasks on recruitment, management of Vietnamese employees working for foreign organizations and individuals in administrative divisions in Ho Chi Minh City under the government’s Decree No. 75/2014 / ND-CP dated July 28, 2014 ;
At the request of Service Company to Foreign missions at Official Dispatch No. 663 / CV-FOSCO September 4, 2014 on the request to continue to be authorized to perform the tasks of the Organization of labor supply for diplomatic missions, foreign organizations and individuals according to the Government’s Decree No. 75/2014 / ND-CP dated July 28, 2014;
At the request of the General Director of the Diplomatic Service Bureau,
DECISION
Article 1. Service Company to Foreign Missions (business name: Fosco) is authorized to perform the tasks of the organization competent in recruiting, managing Vietnamese employees working for foreign organizations and individuals in Ho Chi Minh City and the provinces and cities in the South (list attached) under the provisions at Points a, b, c and d, Clause 2, Article 2 of the Government’s Decree No. 75/2014 / ND-CP dated July 28, 2014.
Article 2. Responsibilities of Service Company to Foreign Missions :
- Receive applications for Vietnamese employees and written request for permission in recruiting Vietnamese employees of foreign organizations and individuals ;
- Recruit, introduce and manage Vietnamese employees working for foreign organizations and individuals ;
- Participate in training, fostering level for Vietnamese employees to meet the requirements of foreign organizations and individuals ;
- Report on recruitment, management of Vietnamese employees working for foreign organizations and individuals within the assigned scope of the Diplomatic Service Bureau.
Article 3. This Decision takes effect from the date of signing and replaces the Minister of Foreign Affairs’ Decision No. 10 / QD-BNG dated January 06, 1999 on authorizing to perform the tasks of the Organization of labor supply under the Government’s Decree No. 85/1998 / ND-CP dated October 20, 1998.
Director of the Diplomatic Service Bureau, Director of Department of Personnel and Organisation and General Director of Service Company To Foreign Missions shall be responsible for the implementation of this Decision. /.
