DECISION
PROMULGATING REGULATIONS ON PLANT DENSITY, UNIT PRICE AND PRINCIPLES OF COMPENSATION AND SUPPORT FOR PLANTS AND FOOD CROPS WHEN THE STATE RECOVERS LAND APPLIED IN GEOGRAPHICAL AREAS OF QUANG NGAI PROVINCE
PEOPLE’S COMMITTEE OF QUANG NGAI PROVINCE
Pursuant to Law on organization of People’s Council and People’s Committee dated November 26, 2003;
Pursuant to Government’s Decree No. 197/2004/ND-CP dated December 03, 2004, on compensation, support and resettlement when the state recovers land;
Pursuant to Circular No. 116/2004/TT-BTC dated December 07, 2004, of the Ministry of Finance, guiding implementation of the Government’s Decree No. 197/2004/ND-CP dated December 03, 2004, on compensation, support and resettlement when the state recovers land;
At the proposal of Director of the provincial Department of Agriculture and Rural Development at the official dispatch No. 1814/SNN&PTNT dated October 20, 2008, No. 1814/SNN&PTNT dated October 20, 2008, of the provincial Finance Department at the official dispatch No. 2883 /STC-BTD dated December 17, 2008, the provincial Department of Justice’s appraisal at report No. 221/BC-STP dated November 27, 2008,
DECIDES:
Article 1. To promulgate together with this Decision Regulations on plant density, unit price and principles of compensation and support for plants and food crops when the state recovers land applied in geographical areas of Quang Ngai province.
Article 2. This Decision takes effect on January 01, 2009 and replaces Decision No. 24/2005/QD-UBND dated February 23, 2005, Decision No. 414/QD-UB dated February 28, 2007, and Decision No. 705/QD-UBND dated April 06, 2007, of the provincial People’s Committee. All previous regulations of the provincial People’s Committee on compensation and support for plants and food crops when the state recovers land which are contrary to this Decision are hereby annulled.
Article 3. The Chief of office of the provincial People’s Committee; Director of Departments, sectors; chairpersons of People’s Committee of district and cities under province; heads of relevant agencies and units; agencies assigned tasks of compensation, support and resettlement, and relevant individuals shall implement this Decision.

For trees not yet named in this table of compensation unit price, determination of compensation unit price will use trees of the same or similar species which are determined by People’s Committees of districts and cities under province where land is recovered at time of making plan on compensation for application in each project.
III. Compensation principles:
1. Principles of compensation, compensation mechanism and compensation money for natural forest are specified in current regulations on compensation, support and resettlement when the state recovers land applied in geographical areas of Quang Ngai province.
2. Compensation value is equal to 100% of price level in accordance above regulations for each tree species in each period. Particularly for perennial tree gardens which become due of liquidation, only pay cost concerned the tree cutting for owner of perennial tree gardens, the Council of compensation, support and resettlement of district or city under province, or organization assigned task of compensation, support and resettlement shall propose and submit to People’s Committee of competent level for compensation level of each specific case.
3. For annual trees (seasonal food crops): Pay compensation according to figures made actual inventory at time of inventory (under area or quantity of trees) Quantity of trees which exceed the prescribed density will not be paid compensation, support. For seasonal food crops planted alternately in area of industrial trees, perennial fruit trees, they are calculated for separate compensation of area.
4. For perennial trees: They are calculated for compensation under the density specified in this Decision. Quantity of trees exceeding the density is only considered to support for seedlings under the density and unit price specified in this Decision.
5. Periods of tree: Newly planted, not yet had fruit, fruiting (for industrial trees and fruit trees) or depend on size of tree (trees for wood) shall be determined practically at time of land recovery.
6. For ornamental trees (just calculated for trees not planted in pot which have been inventoried and stated in minutes of inventory), they are not compensated, only supported 8,000 VND/tree (for trees with height < 30cm), 15,000 VND/tree (for trees with height of between > 30cm and 50cm). 20,000 VND/tree (for trees with height > 50cm).
7. Principles to determine base diameter and trunk height:
a. Position to determine base diameter of tree: Distance from land to the measuring position is >1.3m (particularly tea, base diameter is determined for a distance of 0.5m from land). For trees at a root has many branches, base diameter is diameter of branch with largest diameter.
b. Position to measure trunk height of tree is calculated from natural land to growth point.
8. Cinnamon
a. In case dispersal planting: Compensation level is calculated under the actual quantity of trees.
b. For case of planting in a large scale:
- Making standard boxes to do as basis for determining actual quantity of trees; standard box is prescribed 100 m2/box (standard box may be square, rectangular or circle). Standard boxes must be made according to random plan, arranged evenly on area of land plot, but it is required to ensure quantity of standard boxes according to each area of land plot as follows:
+ For area of 1,000 m2 or less than, total area of standard boxes is equal to 50% area of land planting Cinnamon, minimally.
+ For area of more than 1,000 m2 and less than 2,500m2, total area of standard boxes is equal to 25% area of land planting Cinnamon, minimally.
+ For area of more than 2,500 m2 and less than 10,000m2, total area of standard boxes is equal to 10% area of land planting Cinnamon, minimally.
+ For area of more than 10,000 m2 and less than 30,000m2, total area of standard boxes is equal to 5% area of land planting Cinnamon, minimally.
+ For area of more than 30,000m2, total area of standard boxes is equal to 4% area of land planting Cinnamon, minimally
- From result of standard boxes, converting total trees according to each level of base diameter for applying compensation unit price in accordance with above regulations.
9. Owners of trees and food crops shall self revoke their products on land are recovered and returning land to State in accordance with prescribed schedule. In case where the State wishes to maintain forests and gardens, the persons possessing such forests and gardens will be supported in accordance with current regulations of the provincial People’s Committee.
