DECISION
ROADMAP FOR APPLICATION OF RATIOS FOR BLENDING BIOFUELS WITH TRADITIONAL FUELS
Pursuant to the Law on Government organization dated December 25, 2001;
Pursuant to the Prime Minister’s Decision No. 177/2007/QD-TTg dated November 20, 2007 on approval for the Scheme for development of biofuels by 2015 and the orientation towards 2025;
At the request of the Minister of Industry and Trade;
The Prime Minister promulgates a Decision on the roadmap for application of ratios for blending biofuels with traditional fuels
Article 1. Scope of regulation
This Decision deals with the roadmap for application of ratios for blending biofuels and /traditional fuels used for gasoline engines and diesel engines of road motor vehicles.
Article 2. Subjects of application
This Decision is applied to the organizations and individuals that manufacture, prepare, distribute, sell fuel for gasoline engines and diesel engines of road motor vehicles, except for special fuels serving national defense and security prescribed by the Ministry of National Defense and the Ministry of Public Security.
Article 3. Blending ratios
Biofuels and traditional fuels are blended according to the following ratios:
1. A blend of lead-free gasoline and 4% - 5% denatured ethanol by volume is called E5 blend.
2. A blend of lead-free gasoline and 9% - 10% denatured ethanol by volume is called E10 blend.
3. A blend of diesel and biodiesel with 4% - 5% fatty acid methyl ester (FAME) by volume is called B5 blend.
4. A blend of diesel and biodiesel with 9% - 10% fatty acid methyl ester (FAME) by volume is called B10 blend.
Article 4. Roadmap for applying these blending ratios
The ratios for blending biofuels with traditional fuels shall be applied according to the following roadmap:
1. E5 blends
a) From December 01, 2014, all motor vehicle fuel manufactured, prepared, and sold in Hanoi, Ho Chi Minh City, Hai Phong, Da Nang, Can Tho, Quang Ngai, Ba Ria - Vung Tau must be E5 blends.
b) From December 01, 2015, all motor vehicle fuel manufactured, prepared, and sold nationwide must be E5 blends.
2. E10 blends
a) From December 01, 2016, all motor vehicle fuel manufactured, prepared, and sold in Hanoi, Ho Chi Minh City, Hai Phong, Da Nang, Can Tho, Quang Ngai, Ba Ria - Vung Tau must be E10 blend.
b) From December 01, 2017, all motor vehicle fuel manufactured, prepared, and sold nationwide must be E10 blends.
3. Recommendation
Before this roadmap is applied, organizations and individuals are encouraged to manufacture, prepare, and sell E5, E10, B5, and B10 blends.
Article 5. Implementation
1. The Ministry of Industry and Trade shall:
a) Take charge and cooperate with Ministries, ministerial agencies, Governmental agencies, People’s Committees of central-affiliated cities and provinces (hereinafter referred to as the People’s Committees of provinces)in applying this road map; send annual reports to the Prime Minister.
b) Take charge and cooperate with other Ministries and the People’s Committees of provinces in planning, inspecting and supervising the development of sustainable raw material supply zones, manufacturing facilities, and biofuel distribution systems.
c) Formulate and promulgate National Technical Regulations on storage, transport, and distribution of biofuels; cooperate with the Ministry of Science and Technology, relevant Ministries, and local authorities in inspecting and supervising the adherence of biofuel manufacturers and distributors to the blending ratios and assurance of quality of biofuels according to National Technical Regulations and applied standards.
d) Take charge and cooperate with relevant Ministries in enhancing dissemination and encouragement of the use of biofuels.
dd) Take charge and cooperate with the Ministry of Transport and local authorities in executing projects for encouragement of the use of biofuel in public transportation.
e) Take charge and cooperate with relevant Ministries in enhancing international cooperation to make use of technical resources and technologies serving the implementation of this roadmap.
2. The Ministry of Agriculture and Rural Development shall:
a) Take charge and cooperate with relevant Ministries and local authorities in developing sustainable raw material supply zones serving the biofuel industry.
b) Take charge and cooperate with relevant Ministries in establishing and introducing policies on incentives and support for manufacture of biomass serving the manufacture of biofuel.
c) Take charge and cooperate with relevant Ministries in enhancing the programs for researching, importing, and developing sources of plant varieties, farming techniques with high output of biomass suitable for manufacture of biofuel.
3. The Ministry of Science and Technology shall:
a) Take charge and cooperate with relevant Ministries in reviewing, formulating, and promulgating National Technical Regulations and Standards for biofuel serving the implementation of this roadmap.
b) Direct the inspection and testing of measuring equipment for manufacture and distribution of biofuel to ensure correct blending ratios and good quality of biofuel according to applied National Technical Regulations and Standards.
4. The Ministry of Planning and Investment shall:
a) Take charge and cooperate with relevant Ministries in establishing and introducing policies on incentives and support for biofuel manufacture, blending, and distribution projects to facilitate the implementation of this roadmap.
b) Consider suggesting incentive policies to encourage investment in development of raw material supply zones to serve biofuel development.
5. The Ministry of Finance shall:
a) Take charge and cooperate with relevant Ministries in establishing and introducing policies on incentives in terms of taxes on import of equipment and parts that cannot be manufactured in Vietnam to serve projects for development of biofuel manufacture, blending, and distribution networks.
b) Take charge and cooperate with relevant Ministries in establishing and introducing policies on incentives in terms of taxes on biofuels during each stage of the roadmap.
c) Take charge and cooperate with relevant Ministries in considering and imposing taxes on raw materials serving manufacture of biofuel.
6. Provincial People’s Committees shall:
Take charge and cooperate with the Ministry of Industry and Trade and relevant Ministries in planning, inspecting and supervising the development of sustainable raw material supply zones, manufacturing facilities, and biofuel distribution systems.
7. Responsibilities of manufacturers and sellers of biofuel:
a) The projects for manufacture of ethanol and biodiesel may only be licensed when they have plans for development of their own raw material supply zones.
b) Manufacturers and sellers of biofuel must comply with the development planning, the regulations on blending ratios, and products quality according to applied National Technical Regulations and Standards for biofuel.
Article 6. Effect
1. This Decision takes effect on January 15, 2013.
2. Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the People’s Committees of provinces, relevant organizations and individuals are responsible for the implementation of this Decision./.
