DECISION
ON PROMULGATION OF REGULATION ON INSPECTION AND RECOGNITION OF SUSTAINABLE-ORIENTED AQUACULTURE
MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree 01/2008/ND-CP dated January 3rd 2008 of the Government regulating mandate, authorities and organizational structure of Ministry of Agriculture and Rural Development;
Pursuant to Decree 27/2005/ND-CP dated March 8th 2005 of the Government regulating and guiding the implementation of Fisheries Law ;
Pursuant to Decree 163/2004/ND-CP dated September 7th 2004 of Government; regulating the implementation of Ordinance on Food security and safety;
Upon request of Director of Fisheries, Agriculture and Forestry product quality control department,
HAS DECIDED:
Article 1. To promulgate “Regulation on inspection and recognition of sustainable-oriented aquaculture” in line with this Regulation.
Article 2. This Decision shall come into force after 15 days since the posting on Official Gazette.
Article 3. Head of Ministry’s Administrative office, director of fisheries, agriculture and forestry product quality control department, director of Science and Technology department, heads of related units under MARD, directors of DARD in provinces and cities under central control shall be responsible for implementation of this Decision.

REGULATION
ON INSPECTION AND RECOGNITION OF SUSTAINABLE-ORIENTED AQUACULTURE
Chapter I.
GENERAL PROVISIONS
Article 1. Scope and subject of application
This Regulation shall regulate the process, procedures, responsibility of agencies, organizations and individuals in the registration, inspection and recognition of sustainable-oriented aquaculture establishments.
This Regulation shall apply to agencies, organizations and individuals subject to registration, inspection and recognition of sustainable-oriented aquaculture establishments in Vietnam.
Article 2. Explanation of terms
For the purpose of this Regulation,
1. Aquaculture establishment is the fish farming place owned by an individual or an organization.
2. Agency in charge of recognizing the sustainable-oriented aquaculture establishments (“recognition agency” for short) shall include the units under Department of fisheries, agriculture and forestry product quality control and units under MARD in charge of control of fisheries, agriculture and forestry product quality situated in provinces and cities of central control which are qualified as regulated and authorized to inspect and recognize the sustainable-oriented aquaculture by the competent State agencies.
3. Agency in charge of inspecting sustainable-oriented aquaculture establishments (“inspection agency” for short) shall be organization qualified as regulated and authorized to inspect the sustainable-oriented aquaculture establishments by competent State agency.
4. Certificate of approval for sustainable-oriented aquaculture establishments shall be certificate of Agency dealing with approval certification granted to the aquaculture establishments which meet the regulations relating to sustainable-oriented aquaculture establishments.
5. Better Management practices (BMP) shall be practice norms applied to the aquaculture conducted in farming units which are limited and scattered ones in order to ensure the food safety and reduce the disease epidemic and environmental pollution.
6. Good Aquaculture Practices (GaqP) shall be the practices applied to the aquaculture to ensure the provision of safe food and reduce the disease epidemic and environmental pollution.
7. Code of Conduct for Responsible Aquaculture, CoC) shall be the practice in aquaculture to ensure the safety food reduce disease epidemic and environmental pollution not affecting the ecosystem and ensure the social responsibility.
Article 3. Decentralization of power relating to recognition of sustainable-oriented aquaculture
1. The decentralization of power relating to recognition of sustainable-oriented aquaculture shall be carried out based on the assessment of the capacity of registration agency which is authorized to be the recognition agency as stated in Article 15 of this Regulation.
2. Recognition agency shall be under the department of fisheries, agriculture and forestry product quality control shall make recognition for the aquaculture establishments in the provinces where the recognition agency has not been appointed and shall support the local authorities to establish the agency under DARD which is qualified to be a recognition agency.
Article 4. Legal basis for inspection and recognition
National regulations and standards relating to sustainable-oriented aquaculture establishments shall be issued by MARD.
Article 5. Fee and charges
Fees and charges for the recognition of farming establishments shall be implemented as regulated by current legislation.
Chapter II
INSPECTION, RECOGNITION OF SUSTAINABLE-ORIENTED AQUACULTURE ESTABLISHMENTS
Article 6. Inspection and recognition forms
1. Inspection form
a. The first inspection shall be conducted in the aquaculture establishment which register for inspection and recognition for the first time or the aquaculture establishments whose certificate of approval of sustainable-oriented aquaculture establishments was withdrawn and they wish to renew its certificate.
b. The re-inspection shall be done at the aquaculture establishments which was inspected for the first time but was not qualified.
c. Monitoring inspection shall be done in the aquaculture establishments which have the sustainable-oriented aquaculture certificate of approval in the next crops in order to monitor the maintenance of farming conditions and take basis for the recognition agency to make the recognition.
d. Extraordinary inspection shall be carried out once the sustainable-oriented aquaculture establishments are subject to the violation of Regulation or upon request by State management agencies at all levels.
2. Recognition form
The recognition shall be made at three levels: better management practices (BMP), Good aquaculture practices (GaqP) or Code of Conduct for Aquaculture (CoC).
Article 7. Procedures of inspection and recognition
1. Aquaculture establishment shall send two dossiers applying the national technical standards/regulation relating to sustainable-oriented aquaculture to the recognition agency during the mid-crop.
Dossiers shall include:
a. Application form of inspection, recognition (form in Annex 1).
b. Description on the site, environmental conditions, facilities, tools and manpower of the establishment.
2. Within three working days upon the reception of registration dossier, recognition shall take it into consideration and produce the written guidance to the owner of the establishment in case the dossier is not legitimate as regulated.
3. Within 15 days upon the reception of legitimate dossiers, recognition agency shall establish an inspection group or make authorization letter to the inspection agency for establishment of inspection group to visit the registered establishment.
4. Inspection procedure, content and methodology
a. Head of inspection group shall inform a representative of aquaculture establishment of the inspection, decision, content of inspection, introduction of inspection group members and inspection schedule.
b. Inspection content and methodology: Inspect practically the aquaculture practices, interview the fish farmers on site, check the documentations and expected productivity, take sample and set the inspection indicators of the farmed fish (if necessary).
c. After the inspection work, inspection group shall agree upon the assessment results of the items and finalize inspection minutes.
d. Report the inspection results to the representative of aquaculture establishments. This representative shall comment and sign on the inspection minutes. In case where the representative of aquaculture establishment does not sign on the minutes, the minutes is still valid with full signatures of inspection group’s members.
E. Inspection minutes shall be made in three copies with equal validity, one copy shall be sent to the inspected aquaculture establishment, one copy shall be filed in the inspection agency, one copy shall be sent to the recognition agency. In case where recognition agency established the inspection group, the minutes shall be made into two copies, one sent to the inspected aquaculture establishment, one copy shall be filed in recognition agency.
5. In case where the inspection agency perform the inspection work at the registered aquaculture establishment, within two working days, the inspection agency shall be responsible for sending whole inspection dossiers to the recognition agency for consideration of the inspection results and granting the certificate of approval according to the procedures stated in clause 6 of this Article.
6. within two working days since the termination of the inspection process or upon reception of dossiers from the inspection agency, recognition agency shall consider the inspection results.
a. If the inspection results are met the BMP, GaqP or CoC requirements, the certificate of approval of sustainable-oriented aquaculture establishments shall be granted. Certificate of approval is laid down in annex 2, code system of certification is laid down in annex 5. The certificate of approval shall be valid within only one farming crop.
b. If the inspection result is not qualified, recognition agency shall inform the mistakes to the aquaculture establishment for overcoming. Once the mistake is overcome, aquaculture establishment shall establish dossier and send it to the recognition agency for re-inspection as stated in Article 8.
7. Recognition agency shall inform names and address of sustainable-oriented aquaculture establishments to the department of fisheries, agriculture and forestry product quality control.
Article 8. Re-inspection
1. The re-inspection dossier shall include:
a. Application form for re-inspection and re-recognition (form laid down in annex 1).
b. Description of changes (if any) on infrastructure (construction site, design, construction), equipment, tools and manpower of the aquaculture establishment.
c. Report on the overcoming of mistake.
2. Procedures and content of inspection, recognition shall be implemented as laid down in clause 4, 5, 6, 7 of Article 7 of this Regulation.
Article 9. Monitoring inspection
1. Agency in charge of first inspection or re-inspection shall assign its staff to monitor the implementation of national regulation/technical regulations relating to the sustainable-oriented aquaculture conditions of the establishments to be recognized in the following farming crops.
2. The procedures and contents of inspection methodology.
a. Inspection agency shall inform the representative of aquaculture establishment of the decision and content of inspection.
b. Inspection content and methodology: Inspect practically the aquaculture practices, consider the documentations, interview the fish farmers on site.
c. After the inspection work, inspector shall make report into 3 copies with equal validity. One copy shall be sent to inspected aquaculture establishment, one copy shall be filed in the inspection agency, one copy shall be sent to the recognition agency. In case where the inspectors are under the recognition agency, the inspection minutes shall be made into two copies, one copy shall be sent to inspected aquaculture establishment, one copy shall be filed in the recognition agency.
3. Based on the results shown in the inspection minutes, recognition agency shall decide the extension or non-extension of the certificate of approval which was granted as stated in Article 7 of this Regulation. The extended period for the sustainable-oriented aquaculture establishment shall be valid for one production crop.
4. The renewal of certificate of approval shall be done if the aquaculture establishment has met the sustainable-oriented aquaculture requirements but in the level different from previous recognition level.
5. Recognition agency shall inform the name, address of the aquaculture establishment whose the certificate of approval was renewed or withdrawn to the department of fisheries, agriculture and forestry product quality control.
Article 10. Extraordinary inspection
1. Recognition agency shall establish an extraordinary inspection while detecting the sustainable-oriented aquaculture establishment engaged in violation of Regulation or upon request of state management agencies at all levels.
2. Inspection procedures, contents and methodology shall be carried out according to clause 4 of Article 7 of this Regulation.
3. Based on results of inspection minutes, recognition agency shall revoke the certificate of approval as laid down in Article 11 of this Regulation.
4. Recognition agency shall inform name and address of sustainable-oriented aquaculture embellishment recognized but violated to the department of fisheries, agriculture and forestry product quality control.
Article 11. Withdrawal of certificate of approval
1. Recognition agency shall withdraw the certificate of approval of sustainable-oriented aquaculture establishment in the following circumstances:
a. Results of extraordinary inspection do not reflect the satisfaction to the requirements of regulations and standards on sustainable-oriented aquaculture or the fish farmed are not met the requirement relating to food safety.
b. Aquaculture establishment refuses to receive the inspection group.
c. Aquaculture establishment violates the use of recognition code.
d. Aquaculture establishment violates the regulation relating to inspection and recognition of fish farmed origin.
2. Recognition agency shall issue the decision on the withdrawal of certificate of approval of sustainable-oriented aquaculture. This decision shall be made into two copies, one sent to the aquaculture establishment whose the certificate is withdrawn and one copy shall be filed.
3. Content of decision of the withdrawal of certificate of approval shall include:
a. Name, address and code of aquaculture establishment whose certificate is withdrawn.
b. Reason and time of withdrawal.
Article 12. Harvest, origin declaration
1. Sustainable-oriented aquaculture establishment shall establish the origin declaration document for each of the product consignments after harvest. The origin declaration document shall clearly indicate the name, weight, size of product; name, address and recognition code of aquaculture establishment; date of issuance; code of transport vehicle; name, address of product purchasing place (see form in Annex 3).
2. The origin declaration document shall be made into three copies, one copy shall be in attachment with the product consignment during circulation; one copy shall be filed in the aquaculture establishment; one copy shall be sent to the recognition agency after harvest.
Chapter III
ASSESSMENT, APPOINTMENT OF AGENCIES IN CHARGE OF SUSTAINABLE-ORIENTED AQUACULTURE INSPECTION AND RECOGNITION
Article 13. Conditions of agencies in charge of inspection and recognition
1. The inspection agency shall:
a. Have legal entity status, be allowed to work in inspection of product quality control system.
b. Have at least two qualified staff (in aquaculture, food processing, veterinary service, bio-technology fields) with university degree, have certificate issued by competent agencies confirming the attendance to training course on sustainable-oriented aquaculture (BMP, GaqP, CoC) and work in the inspection of sustainable-oriented aquaculture (BMP, GaqP, CoC) at least two years.
c. Have the lab with sufficient facilities for the testing of indicators relating to food security, fish farming environment and fish disease detection. Or have the contract of leasing the labs as appointed by competent agencies.
2. Recognition agency: shall have sufficient conditions as stated in point b, c of clause 1 of this Article.
Article 14. Procedures of assessment and appointment of inspection and recognition agencies
1. Registration dossier applying for the appointment of inspection and recognition agencies of sustainable-oriented aquaculture shall be sent to department of fisheries, agriculture and forestry product quality control. The dossier shall include:
a. Application form applying for the appointment of inspection and recognition agencies of sustainable-oriented aquaculture (see form in Annex 4).
b. List of conditions as stated in Article 13 of this Regulation.
c. Other relevant documents (if any).
2. Within five working days upon the reception of registration dossier, department of fisheries, agriculture and forestry product quality control shall look through the dossiers, provide guidance in writing to the registered agencies in case their dossiers are not in accordance with regulation.
3. Within 15 working days upon the reception of proper registration dossiers, department of fisheries, agriculture and forestry product quality control shall make appraisal and appoint the agencies in charge of inspection and recognition. The task group can be established to conduct the appraisal at the registered agencies if necessary.
4. Should the agencies/organizations registered are qualified according to Article 13 of this Regulation, department of fisheries, agriculture and forestry product quality control shall issue decision to appoint the agencies in charge of inspection and recognition of sustainable-oriented aquaculture. The Decision shall clearly state the subject and scale of aquaculture establishment that the recognition agency is authorized to recognize.
5. Should the agencies/organization are not qualified according to Article 13 of this Regulation, department of fisheries, agriculture and forestry product quality control shall inform in writing the reason and time of overcoming for the agencies/organization registered. At the termination of overcoming time, if the appraisal result is not satisfied, that agency and organization shall not be appointed as inspection and recognition agencies.
6. The valid duration of the decision appointing the inspection and recognition agencies shall be three years long as maximum. One month before the decision is expired, if the inspection and recognition agencies wish to continuously be appointed or if there is any change, the application form (see Annex 4) shall be sent to department of fisheries, agriculture and forestry product quality control for consideration of renewal.
Article 15. Examination of operation of inspection and recognition agencies
1. Once a year or in extraordinary circumstance, department of fisheries, agriculture and forestry product quality control shall examine the operation of inspection and recognition agencies for the appointment. The examination shall be conducted at the inspection and recognition agencies and at least at one aquaculture establishment which is inspected and recognized by these agencies in a year.
department of fisheries, agriculture and forestry product quality control shall withdraw the decision on the appointment if the inspection and recognition agencies are not qualified according to Article 13 of this Regulation or the examination conducted at the aquaculture establishment is not objective, honest.
Chapter IV
DUTIES AND AUTHORITIES
Article 16. Duties and authorities of aquaculture establishment
1. Duties of aquaculture establishment
a. It shall apply for the inspection and recognition of sustainable-oriented aquaculture and shall comply with the inspection as regulated in this Regulation.
b. It shall provide sufficient information and dossiers related and facilitate the duty performance of competent agencies.
c. It shall regularly maintain the conditions for sustainable-oriented aquaculture practice as recognized.
d. It shall seriously correct the mistakes as stated in the report of recognition agency.
e. It shall pay inspection and recognition fee and charges as regulated.
f. It shall declare the origin of products as regulated and shall be responsible to the law for the declaration.
g. It shall use the recognition code as granted.
2. Authorities of aquaculture establishment
a. It shall reserve its opinions if not agree with the assessment results of inspection group.
b. It shall complain the results of inspection and recognition and any negative practices (if any) of the inspection group as regulated.
c. It shall be allowed to use the recognition code for advertisement.
Article 17. Duties and authorities of recognition agencies
1. Duties
a. It shall inspect and recognize the sustainable-oriented aquaculture establishments according to this Regulation.
b. It shall ensure the objectiveness and equality in the recognition process, shall keep secret the information collected through the inspection and recognition process.
c. It shall regularly or extraordinarily examine the recognized aquaculture establishment in order to maintain the farming conditions and comply with the national standards/regulations relating to sustainable-oriented aquaculture.
d. It shall be responsible to the law for its recognition results.
e. It shall report to the DARD where the recognition performance is conducted and department of fisheries, agriculture and forestry product quality control and inform in mass media of the granting and withdrawal of certificate of approval.
2 Authorities
a. It shall grant to withdraw the certificate of approval.
b. It shall monitor and require the aquaculture establishment to overcome the mistake relating to regulation or national standards on sustainable-oriented aquaculture.
c. It shall require the sustainable-oriented aquaculture establishment to provide dossiers, documents and facilitate the inspection group to comply with this Regulation and other relevant legal documents.
d. It shall ask the MARD to revise, supplement the regulations/national standards to match the practical status on the inspection and recognition of sustainable-oriented aquaculture.
Article 18. Duties and authorities of inspection agency
1. Duties
a.aIt shall conduct the inspection within competence of authorization and be responsible to the law for inspection results.
b. It shall file the related dossiers relating to the inspection of sustainable-oriented aquaculture practices; provide dossiers, fully and correctly explanation of inspection results upon request of recognition agency.
c. Keep secret the relevant information relating to the trading and production know-how of aquaculture establishment.
2. Authorities
It shall require the sustainable-oriented aquaculture establishments to provide dossiers and documents and shall facilitate the inspection activities in accordance with this Regulation and other relevant legal documents.
Article 19. Duties and authorities of department of fisheries, agriculture and forestry product quality control
1. Duties
a. It shall formulate the guidelines relating to inspection and recognition for the sustainable-oriented aquaculture establishment and proper to specific farming forms and species.
b. It shall formulate the guidelines relating to the taking of samples, appraisal, indicators for the examination of fish farmed and proper to specific farming forms and species.
c. It shall receive the registration dossiers, organize the inspection and issue Decision appointing the inspection and recognition agencies.
d. Once a year or extraordinary circumstances, it shall inspect and examine the operation of inspection and recognition agencies appointed.
e. It shall post on the website of department of fisheries, agriculture and forestry product quality control the list of appointed inspection and recognition agencies and list of aquaculture establishments recognized to conduct farming in sustainable manner.
f. It shall monitor and synthesize and report to the MARD the list of appointed inspection and recognition agencies and list of aquaculture establishments recognized to conduct farming in sustainable manner.
g. It shall solve the complaints of sustainable-oriented aquaculture establishments as regulated by law.
2. Authorities
a. It shall require inspection and recognition agencies, sustainable-oriented aquaculture establishment to provide documents and dossiers related and facilitate the appraisal and inspection of the compliance of this Regulation and other related legal documents.
It shall withdraw the Decision of appointment of inspection and recognition agencies if detecting any violations to the Article 13 of this Regulation.
It shall inspect and take action to the organizations and individuals breaking this Regulation as stated in Article 23 of this Regulation.
Article 20. Duties and authorities of Department of Aquaculture
1. Duties
a. It shall formulate regulations/national standards on sustainable-oriented aquaculture proper to specific farming forms and subjects.
b. It shall advocate, provide training courses relating to the implementation of regulations/standards regarding the sustainable-oriented aquaculture to the state competent agencies at local level and fish farmers.
2. Authorities
It shall propose recommendations of revision of Regulation to fit with practical context.
Article 21. Duties and authorities of DARD
1. Duties
a. It shall formulate and implement the masterplan and manage the local sustainable-oriented aquaculture establishments.
b. It shall direct the functionary units to coordinate with local authorities to advocate, implement and monitor the implementation of this Regulation.
c. It shall guide the local authorities in the establishment of communities (cooperatives, collective groups etc) in the sustainable-oriented aquaculture activities.
2. Authorities
a. It shall require department of fisheries, agriculture and forestry product quality control to report the inspection, monitoring and recognition of sustainable-oriented aquaculture practices.
b. It shall propose the revise the Regulation to fit with local practical context.
Chapter V
AWARDS, SANCTION AND DENUNCIATION SETTLEMENT
Article 22. Awards
1. Organizations and individuals who have made significant contribution to the implementation of this Regulation shall be awarded as per Law on Emulation and Awards.
2. Awards regime shall be carried out according to the legislation.
Article 23. Sanction
1. Any organization an individual violate this Regulation shall be administratively punished according to Government regulations on administrative violations in fisheries field and other relevant regulations.
2. The interference with and protest against the performance of inspection and recognition agencies, the violation of this Regulation that causes seriously consequences shall be criminally prosecuted as regulated.
Article 24. Complaints and denunciation settlement
1. Organization and individual shall have right to complain and denounce the violations of this Regulation according to the Law on complaints and denunciation and its guidelines.
2. Recognition agency shall timely solve the problems in accordance with procedures regulated relating to the complaints on the inspection and recognition agencies.
Chapter VI
EXECUTIVE PROVISIONS
Article 25. Process to apply the registration for inspection and recognition of sustainable-oriented aquaculture practices
The application of sustainable-oriented fish farming at BMP, GaqP shall be applied to follow species:
1. Tiger shrimp and white-leg shrimp:
a. Establishments specialized in intensive, semi-intensive culture that are newly established shall apply this Regulation after its entry into force.
b. Establishments specialized in intensive, semi-intensive which were already established shall apply this Regulation since first of January 2009.
c. Establishments specialized in extensive, advance extensive culture shall apply this Regulation since first of January 2010.
2. Tra/basa bocourti catfish farming establishments shall apply this Regulation since first of January 2009.
3. It is encouraged the aquaculture establishments to comply with CoC regulations.
Article 26. Revision and supplement of Regulations
During the implementation, department of fisheries, agriculture and forestry product quality control shall synthesize comments contributed by organizations and individuals related to submit Minister of MARD for consideration and decision.

The code includes a digits and characters xxx-aa-bbb-cccc (distance by a dash), of which:
- xxx indicates the sign of recognition agency.
- Aa indicates the code of province where the aquaculture establishment situated.
- Bbb indicates the code of BMP or GaqP or CoC.
- Cccccc indicates the code of each establishment, starting at 00001.
