REGULATION

ON PROCEDURES TO GRANT THE PRECIOUS STONE MINING LICENSE MINISTER OF HEAVY INDUSTRY

- Based on the Ordinance dated July 28th, 1989 regarding natural resources of minerals;

- Based on the Management regulation of activities on geology investigating, mining, precious stone processing and trading promulgated accompany of Decree No 67 - CP dated October 7th, 1993 of the Government;

- Hereby regulates the procedures to grant the precious stone mining license as follows:

Article 1.

Vietnamese and foreign organizations, individuals that have won bid for mining precious stone, shall send 3 sets of file to the State Bureau of natural Minerals management to submit to Minister of Heavy Industry for granting the precious stone mining licence.The file includes.

- Application form for mining;

- Exploitation project, including the projects on restoring, protecting related environment;

- Map of the won bid area with scale not less than 1/5000, designed according to the map template of mining area (KVKTM) promulgated in accompanying of Decision No 588 CNNg/QLTN dated August 1st, 1992 of the Ministry of Heavy Industry (hereinafter briefly called Decision No.588 CNNg/QLTN).

- Document of Decision of the Government approving the results of bid and document proof of payment for buying bid according to the rule; 

A copy of foreign investment license (for foreign organization, individuals)

Article 2.

In the case that mining license is not based on the result of bid but based on the regulations in Art.15 of the Regulation promulgated in accompanying of Decree No.67/CP dated October 7 the Government, then it shall be applied according to Art. 12, 13, 14, 15, 16., and 17 of Regulation on principle and procedures in application of exploitation and State registration in the solid minerals mining region promulgated in accompany of Decision No.588 CNNg/QLTN, currently there shall be the decision of Prime Minister regarding the permission to implement according to Art. 15 of Regulation No.67/CP as above mention.

Article 3.

Other regulations on procedures of granting the license and registering the mining area shall be observed with the Regulation on principles and procedures in application of exploitation and State registration in the solid minerals mining region promulgated in accompanying of Decision No 588 CNNg/QLTN

Article 4.

This Regulation comes into force identically in whole country from the date of signing, concurrently the validity of the Regulation on procedures in application for the natural resources of precious stone exploitation license promulgated in accompanying of Decision No 102 CNNg/QLTN dated March 13th, 1992 of Ministry of Heavy Industry.

Article 5.

Head of the State Bureau of Natural Minerals Management shall guide and control the implementation of this Regulation.
