DECISION

PROMULGATION ON AVOIDED COST TARIFF FOR 2009

DIRECTOR OF ELECTRICITY REGULATORY AUTHORITY OF VIETNAM

Pursuant to the Decree No. 153/2008/QD-TTg dated 28 November 2008 by the Prime Minister stipulating functions, duties, power and organization structure of Electricity Regulatory Authority of Vietnam;
Pursuant to the Decree No. 189/2007/ND-CP dated 27 December 2007 by the Government stipulating functions, duties, power and organization structure of Ministry of Industry and Trade;
Pursuant to the Decision No. 18/2008/QD/BCT dated 18 July 2008 by the Minister of Industry and Trade promulgating on regulation on Avoided Cost Tariff and Standardized Power Purchase Agreement for small renewable energy power plants;
Considering the Avoided Cost Tariff for 2009 presented in the letter No. 206/DDQG-KT dated 16 December 2008 by the National Load Dispatching Unit;
Considering the proposal of the Manager of Department of electricity tariff and fees,

DECIDES:

Article 1. Promulgate the Avoided Cost Tariff for 2009 for grid connected renewable energy power plants which meet the conditions set out in the Decision No. 18/2008/QD/BCT dated 18 July 2008 by the Minister of Industry and Trade promulgating on regulation on Avoided Cost Tariff and Standardized Power Purchase Agreement for small renewable energy power plants;

Article 2. The tariff promulgated along with this Decision will be in effect from 1 January 2009 to 31 December 2009.

Article 3. When applying the Avoided Cost Tariff for 2009, power companies must use the Standardized Power Purchase Agreement for small renewable energy power plants stipulated in the Decision No. 18/2008/QD/BCT dated 18 July 2008 by the Minister of Industry and Trade.

The Seller is responsible to send a copy of the Power Purchase Agreement to Electricity Regulatory Authority of Vietnam within 30 days from the signing date.

Article 4. Manager of Administration Office, Managers of Departments under the Electricity Regulatory Authority of Vietnam, General Director of Electricity of Vietnam Group, Directors of Power companies and organizations, individuals operating in electricity field are responsible for implementation of this Decision./.
